- 1 - Internal Regulations of Hebra Qadisha Introduction Chapter One Article One - These regulations shall be called the "Internal Regulations of the Hebra Qadisha Association." Article Two - This association has absolutely no connection to politics. Article Three - The purposes of this association are to carry out the preparation, shrouding, and burial of the deceased from members of the Mosaic community, and to provide and manage the necessary requirements for that. Article Four - The center of the association is the headquarters of the presidency of the Israelite community in Baghdad, and it has a special seal with which all its transactions are stamped. Article Five - The association consists of the following: a - The General Assembly b - The Administrative Board. Chapter Two The General Assembly Article Six - A member of the General Assembly is considered to be: a - Every Mosaic who has paid an affiliation fee of no less than 250 fils and an annual subscription fee of no less than 500 fils. b - Anyone who has provided assistance or service to the association and has been granted the right of honorary membership by the Administrative Board. c - The head of the Israelite community in Baghdad and the members of the Lay Council or whoever takes their place or performs their duties shall be considered a permanent member of the General Assembly. Article Seven - A person shall not be a member of the association if they are: a - Under eighteen years of age. b - Convicted of bankruptcy and has not been legally rehabilitated. c - Under interdiction and the interdiction has not been lifted. d - Sentenced to imprisonment for a period of no less than one year for a non-political crime or convicted of a crime involving dishonor. e - Insane or demented. Article Eight - Membership of a member shall lapse when the conditions of membership no longer apply to them. Article Nine - The General Assembly shall hold its ordinary meeting in January of each year upon the invitation of the Chairman of the Administrative Board once to audit and approve its budget. A quorum is considered achieved by the presence of the majority of members in ordinary and extraordinary meetings. When a quorum is not achieved the first time, the meeting is postponed for ten days, and at this time the quorum is considered achieved regardless of the number of members present, provided their number is not less than ten. Article Ten - The General Assembly shall be chaired by the Chairman of the Administrative Board or his deputy. In their absence, the members present shall elect from among themselves someone to chair the meeting. Decisions are taken by a majority of votes, and in the event of a tie, the Chairman shall have two votes.

المادة الثانية والعشرون - للجمعية شخصية حكمية ولها ان تتصرف بالاموال المنقولة وغير المنقولة كـ تصرف الملاك بملكه . المادة الثالثة والعشرون - تحفظ نقود الجمعية لدى احد البنوك التي تقرره هيئة الادارة باسم الجمعية ولا يجوز ان يبقى في صندوق الجمعية اكثر من المبلغ الذي تقرره هيئة الادارة . المادة الرابعة والعشرون - يوقع على الصكوك واوراق السحب رئيس هيئة الادارة وامين الصندوق مجتمعا . اما الوصولات فيوقع عليها من قبل امين الصندوق وحده ، وتختم ويجرى السحب بقرار من قبل هيئة الادارة لاغراض هذه الجمعية .

الفصل الخامس

مـــــواد متفرقــــــــــــــــــــة

المادة الخامسة والعشرون - يمثل الجمعية رئيسها وهو مأذون بتوقيع جميع المخابرات وتعاطي المعاملات الرسمية في دوائر الحكومة والمحاكم والمجالس الرسمية وغير الرسمية على اختلاف انواعها وعند عدم وجود الرئيس لغيابه او تعذر قيامه بالرئاسة يقوم نائبه بدلا عنه بالامور المذكورة . المادة السادسة والعشرون - تصدر هيئة الادارة تقريرا سنويا يتضمن الواردات والمصروفات والاعمال التي قامت بها ويوزع نسخ منه على اعضاء الهيئة العامة . المادة السابعة والعشرون - للمجلس الجسماني للطائفة الاسرائيلية في بغداد او من يقوم مقامه او باعماله حق الاشراف على كافة اعمال الجمعية وعلى وارداتها وصرفياتها . وعلى هيئة الادارة الامتثال لقرارات المجلس المذكور . المادة الثامنة والعشرون - ان هذا النظام قابل للتعديل والتغيير متى مست الضرورة كما جاء في الفقرة - د - من المادة الحادية عشرة من هذا النظام بقرار ثلثي اعضاء الحاضرين في اجتماع تعقده الهيئة العامة على ان يتأيد هذا التعديل من قبل المجلس الجسماني للطائفة او من يقوم مقامه او باعماله . ولا يكون التعديل نافذا الا بعد مصادقة وزارة الداخلية عليه . المادة التاسعة والعشرون - لا تحل هذه الجمعية الا بقرار ثلثي الاعضاء الحاضرين في اجتماع تعقده الهيئة العامة ولا يعتبر قرار الحل هذا نافذا الا اذا تأيد بقرار من قبل المجلس الجسماني للطائفة الاسرائيلية ببغداد او من يقوم مقامه . المادة الثلاثون - عند حل الجمعية سواء كان هذا الحل اختياريا او اداريا تسلم جميع ممتلكاتها من اموال منقولة وغير منقولة الى ادارة الطائفة الاسرائيلية ببغداد .

- 3 - Article Twenty-Two - The association has a legal personality and has the right to dispose of movable and immovable property as owners dispose of their property. Article Twenty-Three - The association's funds shall be kept in one of the banks decided by the Board of Directors in the name of the association, and it is not permitted for more than the amount decided by the Board of Directors to remain in the association's fund. Article Twenty-Four - Instruments and withdrawal papers shall be signed by the Chairman of the Board of Directors and the Treasurer jointly. As for receipts, they shall be signed by the Treasurer alone, and stamped, and withdrawals shall be made by a decision of the Board of Directors for the purposes of this association. Chapter Five Miscellaneous Articles Article Twenty-Five - The association is represented by its president, who is authorized to sign all correspondence and conduct official transactions in government departments, courts, and official and unofficial councils of all kinds. In the absence of the president due to his absence or the impossibility of his presidency, his deputy shall perform the aforementioned matters in his stead. Article Twenty-Seven - The Lay Council of the Jewish community in Baghdad, or whoever takes its place or performs its duties, has the right to supervise all the association's activities, its revenues, and its expenditures. The Board of Directors must comply with the decisions of the aforementioned council. Article Twenty-Eight - This constitution is subject to amendment and change whenever necessary, as stated in paragraph - d - of Article Eleven of this constitution, by a decision of two-thirds of the members present at a meeting held by the General Assembly, provided that this amendment is endorsed by the Lay Council of the community or whoever takes its place or performs its duties. The amendment shall not be effective until after the Ministry of Interior approves it. Article Twenty-Nine - This association shall not be dissolved except by a decision of two-thirds of the members present at a meeting held by the General Assembly, and this dissolution decision is not considered effective unless it is supported by a decision by the Lay Council of the Jewish community in Baghdad or whoever takes its place. To the Honorable President of the Court of Cassation of Iraq Through the Honorable Head of Karrada Execution Appellant - President of the Administrative Committee for Iraqi Jews in his capacity as trustee of the Ezra Menahem Daniel Waqf Appellees - Heirs of Abdul Majeed Kashif al-Ghita - in addition to the estate of their predecessor Subject of Cassation First - Facts of the Case 1- The Personal Status Court in Baghdad had authorized the agent of the trustee of the aforementioned Waqf to lease plots 6, 7, 8, 9, and 1/66 Al-Bataween under conditions including: That the lease term be 12 years only and the annual rent be 3850 Dinars, as stated in the Sharia deed No. 220 / Sh / 956 dated 12/25/1956. 2- Based on this deed, the trustee's agent leased the mentioned plots to the late Abdul Majeed Kashif al-Ghita under the same conditions contained therein, pursuant to the contract certified by the Notary Public of South Baghdad I, under general number 59 and dated 1/2/1957. 3- The tenant consolidated the mentioned plots into two plots: 6/66 with an area of 1567 m2 and 8/66 with an area of 1614 m2. The tenant constructed a two-story building on the consolidated plot 6/66, then the trustee's agent and the tenant submitted a joint request to the Personal Status Judge in Karrada to extend the contract term from 12 years to 30 years provided that the tenant constructs two additional floors at a cost of no less than (40) thousand Dinars. The mentioned court authorized the extension of the contract to 30 years in exchange for the mentioned conditions as stated in the Sharia deed No. 8 / Sh / 1958 dated 8/6/1958. 4- Based on this deed, the tenant and the trustee's agent extended the lease term to 30 years pursuant to the contract certified by the Notary Public of South Baghdad I, under general number 4008 and dated 8/7/1958. 5- The tenant Kashif al-Ghita waived the consolidated plot 8/66 to Ibrahim, who then constructed the Semiramis Cinema building on it and registered the Musataha right in his name at the Land Registry Department, then sold the Musataha right to Abdul Qadir Sharif and Partners. 6- Accordingly, the rent for the consolidated plot 6/66 was set at 2350 Dinars, then Kashif al-Ghita sold 22 shares out of 40 shares to Hassan Al-Kahmachi, Muhammad, and Ali Al-Qat'an. ١٣ - من هذا العرض نرى . ( ان دين الوقف نشأ بعد وفاة كاشف الغطاء اذ هو اجرة العرصة الموحدة ٦/٦ للمدة من ١ / ١ / ١٩٦٤ لغاية ١٥ / ٧ / ١٩٧٠ بمعدل -/٢٣٥٠ دينار سنويا يتحمل الورثـــــــة بنسبة سهامهم البالغة ١٨ سهما ويتحمل الشركاء بنسبة سهامهم البالغة ٢٢ سهما . ولما كانت المحكمة الشرعية قد وضعت يدها على العمارة واستوفت بدلات ايجارها ودفعت الى الشركاء استحقاقهم من بدل الايجار محسوما منه ضريبة العقار ورسم المجاري واجرة الارض وقد استوفت من الشركاء للمدة من ١ / ١ / ١٩٦٤ لغاية ١٥ / ٧ / ١٩٧٠ مبلغ ٥٠٠ / ٨٤٥٣ دينارا وهو ما يصيب سهامهم من اجرة العرصة وهذا المبلغ يعود اصلا لجهة الوقف اذ لا علاقة له بالمتوفـــــــى ولا بالتركة والواجب الدفع وقبل كل شيء .

اما ما يصيب الورثة من اجرة الارض للمدة من ١ / ١ / ١٩٦٤ لغاية ١٥ / ٧ / ١٩٧٠ فهـــــذا ايضا لا علاقة له لا بالمتوفى ولا بالتركة اذ انه نشأ على ذمة الورثة وعندما كانت المحكمة الشرعية واضعة اليد على العمارة وتقوم بادارتها واستيفاء بدلات ايجارها . وهذا ما قالته المحكمة الشرعية في كتابها المؤرخ ٥ / ٥ / ١٩٧٠ وما ايدته بكتابها المؤرخ ٢٨ / ١ / ١٩٧١ وتستند المحكمة الى قرار محكمتكم المحترمة المرقم ٢٧ / حجة شرعية / ١٩٦٥ .

ثانيا - اسباب التمييز

١٤ - لقد نظمت رئاسة التنفيذ قرار الاشتراك واعطت جهة الوقف الدرجة الاولى واصدرت قرارها المؤرخ ٢٦ / ٥ / ١٩٧١ وقد بينت الاسس القانونية التي استندت اليها في اعطاء الدرجات . وقد طلبت اخراجنا من قرار الاشتراك اذ لا علاقة لنا بالمتوفى ولا بتركته فرد طلبنـــــا بتاريخ ٢ / ٧ / ١٩٧١ .

ولكن الرئاسة تعرضت لدين الوقف في قرارها المؤرخ ٢ / ٧ / ١٩٧١ المتخذ على اعتراض الدائن عزيز ليلو وقد جاء قرار رد الاعتراض ما يلي .

( دققت هذه الرئاسة اعتراض الدائن عزيز ليلو المؤرخ ٢١ / ٦ / ١٩٧١ وملحق اللائحـــــة الاعتراضية المؤرخ ٦ / ٧ / ١٩٧١ فقررت ما يلي

اولا - بالنسبة لاعتراضه على امتياز دين وقف عزرا مناحيم دانيال قررت تعديل قرار الاشتراك وجعل مدة الامتياز لثلاث سنوات فقط استنادا الى احكام المادة ١٣٧٤ من القانـــــــون المدنـــــــي . ويكون باقي الدين الخاص بوقف الطائفة حسب تاريخ ثبوته رسميا بموجب عقود الايجار المربوطة في الاضبارة .)

١٥ - ولما كان هذا القرار غير واضح فقد قدمت استيضاحا مؤرخا ٨ / ٧ / ١٩٧١ اطلب فيه توضيـــــح هذه الفقرة للاسباب المبسوطة في استيضاحي واهمها بالنسبة للشق الاول .

آ - ان قرار الاشتراك تضمن الفقرة التالية . دين وقف عزرا دانيال ٥٠٠ / ٨٤٥٣ دينارا المستلم من حسن الكاهه جي ومحمد وعلي

- 3 - The decision of participation, and upon objecting to this decision, our objection was rejected, and upon its appeal, ⟦the legal ruling⟧ was confirmed. The request for correction was rejected. 13 - From this presentation we see: (That the debt of the Waqf arose after the death of Kashif Al-Ghita, as it is the rent for the unified site 6/6 for the period from 1/1/1964 until 15/7/1970 at a rate of -/2350 Dinars annually, borne by the heirs at the rate of their shares amounting to 18 shares, and the partners bear it at the rate of their shares amounting to 22 shares. And since the Sharia Court had taken possession of the building and collected its rental amounts and paid the partners their entitlement of the rent after deducting the real estate tax, the sewage fee, and the land rent, and it collected from the partners for the period from 1/1/1964 until 15/7/1970 an amount of 8453.500 Dinars, which is what concerns their shares of the site rent, and this amount originally belongs to the Waqf authority as it has no relation to the deceased nor to the estate, and it is mandatory to pay before everything else. As for what concerns the heirs regarding the land rent for the period from 1/1/1964 until 15/7/1970, this also has no relation to the deceased or the estate as it arose as a liability of the heirs when the Sharia Court was in possession of the building and was managing it and collecting its rental amounts. This is what the Sharia Court stated in its letter dated 5/5/1970 and what it supported with its letter dated 28/1/1971, and the court relies on the decision of your esteemed court numbered 27 / Sharia Argument / 1965. Second - Grounds for Appeal 14 - The Presidency of Execution organized the decision of participation and gave the Waqf authority the first degree and issued its decision dated 26/5/1971 and explained the legal foundations on which it relied in granting the degrees. It requested our exclusion from the decision of participation as we have no relation to the deceased or his estate, so our request was rejected on 2/7/1971. But the Presidency addressed the Waqf debt in its decision dated 2/7/1971 taken upon the objection of the creditor Aziz Lilu, and the decision to reject the objection stated the following: (This Presidency examined the objection of the creditor Aziz Lilu dated 21/6/1971 and the supplement of the objection statement dated 6/7/1971 and decided the following: First - Regarding his objection to the privilege of the Ezra Menachem Daniel Waqf debt, it decided to amend the participation decision and make the duration of the privilege for three years only, based on the provisions of Article 1374 of the Civil Law. Article Twenty-Seven – The Lay Council of the Jewish Community in Baghdad or whoever takes its place or performs its duties has the right to supervise all the association's activities and its revenues and expenditures. The Board of Directors must comply with the decisions of the aforementioned Council. Article Twenty-Eight – This bylaws is subject to amendment and change whenever necessity arises as stated in paragraph (d) of Article Eleven of these bylaws by a decision of two-thirds of the members present at a meeting held by the General Assembly, provided that this amendment is confirmed by the Lay Council of the Community or whoever takes its place or performs its duties. The amendment shall not be effective until after the Ministry of Interior approves it. Article Twenty-Nine – This association shall not be dissolved except by a decision of two-thirds of the members present at a meeting held by the General Assembly, and this dissolution decision is not considered effective unless it is confirmed by a decision of the Lay Council of the Jewish Community in Baghdad or whoever takes its place. ٨- ولما كان كاشف الغطاء قد استأجر سهام شركائه لمدة عشر سنوات ببدل سنوي قدره -/ ٥٥٠٠ دينارا قامت المحكمة الشرعية بادارة العمارة واستيفاء بدلات الايجار وقد ارتأت تنفيذ هذا العقد لانه في مصلحة الورثة والتركة وقررت دفع بدل الايجار الى الشركاء فاعترض الدائن عزيز ليلو على هذا القرار فردت اعتراضه ولدى تمييزه صدق من قبل محكمتكم المحترمة بقرارها المرقم ٢٧/حجة شرعية/١٩٦٥ والمؤرخ ١٣ / ١٢ / ١٩٦٥ . وبهذا القرار والادارة اصبحت المحكمة الشرعية مسؤولة عن اجرة العرصة كاملا ورسوم المجاري وضريبة العقار كاملا .

٩- وهنا لابد من القول ان المحكمة الشرعية كان همها منصبا على استيفاء بدلات الايجار للعمارة فقط دون تسديد الحقوق المنصبة عليها من ضريبة عقار بلغت -/ ١٢٧٤٧ دينارا ورسوم مجاري بلغت -/ ٧٨٧١ دينارا واجرة العرصة البالغة -/ ١٥٣٧٠ دينارا للمدة من ١٥ / ١ / ١٩٦٤ لغاية ١٥ / ٧ / ١٩٧٠ علما ان المحكمة الشرعية قد استقطعت من الشركاء ما يصيب سهامهم من المبالغ المذكورة دون ان تقوم بتسديدها الى اصحابها الشرعيين ولم تكتف بهذا وانما عمدت الى عبد القادر شريف وشركائه اصحاب حق المساطحة على العرصة ٦/٨ تطلب منهم تسديد بدل ايجار العرصة اليها دون وجه حق وبكتب شديدة قاسية اتهمتهم فيها بالكذب والمماطلة واكل الحقوق مما حملتهم على تسديد -/ ٧٥٠٠ دينار بمعدل -/ ١٥٠٠ دينار سنويا . وان هذا المبلغ قد استلمته جهة الوقف مؤخرا ، يلاحظ كتاب شرعية الكرادة المؤرخ ١١ / ٥ / ١٩٧١ .

١٠- وازاء هذا الموقف غير العادل وغير القانوني والشرعي تمت بتوجيه انذار الى المحكمة الشرعية بواسطة كاتب عدل شمالي بغداد بتاريخ ٢١ / ١١ / ١٩٦٧ اطلب منها تسديد اجرة العرصة ولكن دون جدوى مما اجبرنا على اقامة الدعوى المرقمة ١٢٣ / ١٩٦٨ لدى محكمة بداءة الكرادة ونطلب فيها فسخ عقود الايجار استنادا للمادة ١٢٦٨ مدني لتأخر المساطح عن دفع الاجرة لمدة تزيد على الثلاث سنوات . ورغم اقامة هذه الدعوى فان المحكمة الشرعية لم تعرها اي اهتمام كما ان جهة الوقف لم تكن راغبة في الفسخ لظروف معلومة .

١١- وبالنظر لاستغراق التركة بالديون فقد ارسلت المحكمة الشرعية ما تجمع لديها من رصيد نقدي الى رئاسة تنفيذ الكرادة لتوزيعه على الدائنين بعد تنظيم قرار الاشتراك واستثنت من قرار الاشتراك دين الوقف كما جاء في كتابها المؤرخ ١١ / ٢ / ١٩٦٩ . ولدى مراجعة رئاسة التنفيذ لصرف بدل ايجار العرصة ٦/٦ المشاعة والمبلغ المستلم من عبد القادر شريف وشركائه فقد اتخذت الرئاسة قرارات كان طابعها التسرع والتسويف وبعضا منها خروجا على اختصاصها .

١٢- واخيرا لجأت رئاسة التنفيذ الى المحكمة الشرعية طالبة ابداء رايها واصدار قرار بتثبيت دين الوقف وصرفه فاتخذت المحكمة القرار اللازم ووجهت كتابها المؤرخ ٥ / ٥ / ١٩٧٠ وطلبت فيه صرف المبلغ بعد حضور المتولي الى رئاسة التنفيذ وتعهده بابطال دعوى الفسخ وعدم المطالبة بالفوائد المترتبة على هذا المبلغ فحضر المتولي وتعهد بابطال الدعوى وعدم المطالبة بالفوائد ولكن رئاسة التنفيذ لم تنفذ قرار المحكمة الشرعية بصرف المبلغ وانما اخرت الصرف الى ان ينظم

- 2 - 8- Since Kashif Al-Ghata had leased the shares of his partners for a period of ten years for an annual sum of -/ 5500 dinars, the Sharia Court undertook the management of the building and the collection of rent allowances. It decided to implement this contract because it was in the interest of the heirs and the estate, and decided to pay the rent allowance to the partners. The creditor Aziz Lilo objected to this decision, but his objection was rejected. Upon his appeal, it was ratified by your esteemed court in its decision No. 27/Sharia Argument/1965 dated 13 / 12 / 1965. By this decision and management, the Sharia Court became responsible for the full ground rent, sewage fees, and the full real estate tax. 9- Here it must be said that the Sharia Court's concern was focused only on collecting the rent allowances for the building, without settling the rights imposed on it, such as the real estate tax, which amounted to -/ 12747 dinars, and sewage fees, which amounted to -/ 7871 dinars, and the ground rent, which reached -/ 15370 dinars for the period from 15 / 1 / 1964 until 15 / 7 / 1970. Note that the Sharia Court had deducted from the partners their shares of the aforementioned amounts without paying them to their legal owners, and did not stop at this, but rather turned to Abdul Qadir Sharif and his partners, the holders of the Musataha right on the land 6/8, demanding that they pay the ground rent allowance to it without right. In harsh and severe letters, it accused them of lying, procrastination, and consuming rights, which forced them to pay -/ 7500 dinars at a rate of -/ 1500 dinars annually. This amount was recently received by the Awqaf department; note the letter from the Karrada Sharia Court dated 11 / 5 / 1971. 10- In the face of this unjust, illegal, and illegitimate position, a warning was directed to the Sharia Court through the Notary Public of North Baghdad on 21 / 11 / 1967, requesting it to pay the ground rent, but to no avail, which forced us to file lawsuit No. 123 / 1968 at the Karrada Court of First Instance, requesting the rescission of the lease contracts based on Article 1268 of the Civil Code due to the Musataha holder's delay in paying the rent for a period exceeding three years. Upon following up with the Execution Presidency to disburse the ground rent for the shared plot 6/6 and the amount received from Abdul Qadir Sharif and his partners, the Presidency took decisions characterized by haste and procrastination, and some of them were outside its jurisdiction. 12- Finally, the Execution Presidency turned to the Sharia Court, requesting its opinion and the issuance of a decision to confirm the Awqaf debt and disburse it. The court took the necessary decision and issued its letter dated 5 / 5 / 1970, requesting the disbursement of the amount after the Mutawalli (trustee) attended the Execution Presidency and pledged to nullify the rescission lawsuit and not to claim the interest accrued on this amount.
