بعد التحية بالاشارة الى كتاب السيد صالح يوسف المهندس المؤرخ ٧ / ٢ / ١٩٥٧ المعنون الى لجنتكم المحترمة ونسخة منه إلينا ، يرجى إحاطتكم علماً بما يأتي :

١- لم يتم لحد الآن بناء سقف بيت الحباب الذي كان قد خربه عمال المقاول حين اشتغالهم بالبناء الجديد مع العلم ان ذلك يسبب تلويث حباب ماء الشرب بالاتربة ومياه الامطار على الدوام . ٢- لم يتم لحد الآن تغيير أقفال الابواب الخمسة كما هو مشروط في المقاولة حسب ما ذكره السيد صالح يوسف . ٣- لا زالت هناك بعض الصبغات في شبابيك البناء التي لم تتم بعد . ٤- من الضروري اكمال صبغ الجدران نهائياً من الخارج والداخل واصلاح بعض البقع في الجدران الداخلية بعد اكمال الصبغات في شبابيك الغرف . ٥- من الضروري تبديل أحد الابواب نظراً لكونه أصغر من فتحة الباب بحوالى نصف قدم . ٦- وهناك قسم من السطح الذي فوق دورة المياه مباشرة قد بقي بدون تهوير وبدون منفذ لتصريف الماء عنه مما يضر بجدران الغرفة الجديدة .

هذا وان هذه النواقص وإن لم تكلف نفقات كبيرة لاكمالها إلا أنها تمنعنا من استعمال الغرف الجديدة التي نحن بامس الحاجة إليها في الوقت الحاضر . لذا يرجى الطلب الى المقاول باكمالها قبل تسديد ما بقي له من ديون باسرع وقت ممكن . وتفضلوا بقبول فائق الاحترام

B03 · paragraph / arabic تقرير لجنة التحقيق في الحادث الذي وقع في حفلة المدرسة السنوية يوم : ⟦illegible⟧ في الساعة ٧/٣٠ من مساء يوم الخميس المصادف ٥ / ٦ / ١٩٥٨ وبينما كانت الحفلة مستمرة في تقديم منهاجها الفني ، حدث ما يلي : ١ - بينما كانت احدى التلميذات تلقي كلمة باللغة الانكليزية ، حدثت ضجة في الجهة الخلفية من الساحة المخصصة للمدعوين بسبب خلاف وقع بين احد الحراس وبين احد الاشخاص الذين حاولوا الدخول بدون بطاقة دعوة ، وقد استطاع الحراس اخراجه . ٢ - بعد فترة لا تتجاوز الخمس دقائق تكررت الضجة في نفس المكان ثانية ، فأسرعنا نحن اعضاء اللجنة الى مكان الحادث وتبين لنا ان الحارس المذكور قد اصيب بجرح في رأسه . ٣ - قمنا على الفور بطلب الاسعاف للمصاب ونقله الى المستشفى ، كما قمنا بابلاغ مركز الشرطة بالحادث ، وقد حضر مأمور المركز واجرى التحقيق اللازم في حينه . ٤ - تبين من التحقيق ان الشخص الذي احدث الضجة هو المدعو ( ⟦illegible⟧ ) من سكنة منطقة البتاوين ، وقد تم القاء القبض عليه من قبل الشرطة . ٥ - استمرت الحفلة في تقديم فقراتها كالمعتاد ولم يؤثر هذا الحادث على سير البرنامج ، وقد انتهت الحفلة في الساعة الحادية عشرة مساءً . هذا ما لزم بيانه .

Frank Iny School In the Mixed Bataween Telephone - In New Baghdad Telephone Number: 93313 Number 75 / 102 Date 8 / 6 / 1958 FRANK INY SCHOOL Intermediate & Primary New Alwiyah - Baghdad TELEPHONE NO. 93313 Report of the investigation committee on the incident that occurred at the school's annual party on: ⟦illegible⟧ At 7:30 PM on Thursday, corresponding to 5 / 6 / 1958, while the party was continuing to present its artistic program, the following occurred: 1 - While one of the female students was delivering a speech in English, a commotion occurred in the rear side of the area designated for invitees due to a dispute between one of the guards and a person who tried to enter without an invitation card, and the guards were able to remove him. 2 - After a period not exceeding five minutes, the commotion was repeated in the same place again, so we, the members of the committee, rushed to the scene of the incident and it became clear to us that the mentioned guard had suffered a wound to his head. 3 - We immediately requested an ambulance for the injured person and transferred him to the hospital, and we also informed the police station of the incident, and the station officer arrived and conducted the necessary investigation at the time. 4 - It appeared from the investigation that the person who caused the commotion is the one named ( ⟦illegible⟧ ) from the residents of the Bataween area, and he was arrested by the police. 5 - The party continued presenting its segments as usual, and this incident did not affect the progress of the program, and the party ended at eleven o'clock in the evening. فيها الا بموافقة الطائفة الاسرائيلية الخطية .

١١ -- ⟦line⟧ طرد مستخدمي المقاول للمهندس صلاحية تامة لان يطلب من المقاول طرد او اقصاء اي كان من مستخدميه عما ترى الطائفة عدم مرغوبية وصلاحية استمرارهم في العمل وعلى المقاول ان ينفذ تلك الطلبات فور صدورها ولا يحق له المطالبة بأي تعويض او تضمين قد يترتب على ذلك بأي شكل كان .

١٢ -- السلفــــــات تدفع الطائفة سلفات نقدية في نهاية كل شهر عن الاعمال المنجزة والمواد المجهزة في موقع العمل بعد استحصال شهادة من المهندس بذلك وذلك على اساس ٩٠ بالمائة من كلفة الاعمال المنجزة بموجب اسعار المقاولة و ٧٥ بالمائة من قيمة المواد الانشائية المجهزة في موقع العمل حسب تقديرها المحلي . على ان لا تعتبر هذه السلفات الممنوحة الى المقاول بمثابة اعتراف بقبول العمل من جانب الطائفة بل تطبق شروط المقاولة على جميع العمل المنجز وغير المنجز الى ان يتم تسليمه نهائيا الى الطائفة .

١٣ -- الذرعة النهائية وتسديد حساب المقاول بعد اكمال العمل تماما من كافة الوجوه بشهادة مهندس الطائفة تقوم الطائفة الاسرائيلية باستلام العمل استلاما موقتا ويسدد حساب المقاول بموجب المبلغ الاجمالي المقطوع المتفق عليه في هذه المقاولة بعد طرح كافة السلف المدفوعة الى المقاول على حساب اعماله اما تأمينات المقاول فتحتفظ بها الطائفة مدة الصيانة وتعاد اليه بانتهائها وبعد الاستلام النهائي للعمل .

١٤ -- رفض العمــــــل يحق للمهندس رفض اي مواد يجهزها المقاول او اي عمل يكون بنظر المهندس قائما على جودة وصنعة غير مستوفيتين للمستوى المطلوب او غير مطابق للمواصفات او الخرائط المختصة بالمقاولة وعلى المقاول ان يرفع المواد والعمل المرفوض ويعيد تنفيذه على نفقته الخاصة بما فيه المواد الموجودة في العمل المرفوض . كل عمل يقام به بدون تفويض بالاضافة الى التفاصيل المعطاة في الخرائط او التعليمات الصادرة سوف <del>لا</del> يعترف به ولا يقام بذرعته ولا يدفع الى المقاول قيمة المواد المستعملة في تنفيذ مثل هذه الاعمال .

١٥ -- مدة الصيانــــــــة على المقاول ان يقوم بصيانة العمل لمدة ثلاثة اشهر من تاريخ استلام الطائفة للعمل منه استلاما موقتا وعليه ان يصلح جميع النواقص او العيوب التي قد تظهر ابان مدة

Page 2 therein except with the written consent of the Jewish Community. 11 -- ⟦line⟧ Dismissal of the Contractor's Employees The Engineer has full authority to request the Contractor to dismiss or exclude any of his employees whom the Community deems undesirable or unfit to continue in the work, and the Contractor must implement those requests immediately upon their issuance. He has no right to claim any compensation or damages that may result from that in any form whatsoever. 12 -- Advances The Community pays cash advances at the end of each month for the work completed and materials provided at the work site after obtaining a certificate from the Engineer to that effect, based on 90 percent of the cost of the work completed according to the contract prices and 75 percent of the value of the construction materials provided at the work site according to its local estimation. Provided that these advances granted to the Contractor shall not be considered an admission of acceptance of the work by the Community; rather, the contract terms apply to all completed and uncompleted work until it is finally handed over to the Community. 13 -- Final Measurement and Settlement of the Contractor's Account After the work is completely finished in all respects as certified by the Community's Engineer, the Jewish Community shall take over the work provisionally, and the Contractor's account shall be settled according to the total lump sum amount agreed upon in this contract after deducting all advances paid to the Contractor on account of his work. As for the Contractor's securities, the Community shall retain them for the maintenance period and they shall be returned to him upon its expiration and after the final handover of the work. 14 -- Rejection of Work The Engineer has the right to reject any materials provided by the Contractor or any work that is, in the Engineer's view, based on quality and workmanship that do not meet the required standard or are not in accordance with the specifications or drawings pertaining to the contract. The Contractor must remove the rejected materials and work and re-execute it at his own expense, including the materials present in the rejected work. Any work carried out without authorization in addition to the details given in the drawings or the issued instructions will <del>not</del> be recognized, nor will it be measured, and the Contractor will not be paid the value of the materials used in the execution of such works. 15 -- Maintenance Period The Contractor must maintain the work for a period of three months from the date the Community takes over the work from him provisionally, and he must repair all deficiencies or defects that may appear during the period

استنادا الى المقاولة المعقودة بين رئاسة اللجنة الادارية للطائفة الاسرائيلية ببغداد وبينكم ، تعهدتم باتمام العمل بمدة اقصاها شهرين ونتيجة للزيادة الحاصلة في البناء والتي لا تتعدى باية حال من الاحوال ٢٥ ٪ تكون مدة العقد لا تتجاوز ٧٥ يوما بينما مضى على البناء مدة تتجاوز الـ ١٠٠ يوم بموجب كتاب الطائفة المؤرخ ١٠ / ٣ / ١٩٥٦ والمرقم م / ٣٦٥ / ٥٦ الذي يامركم فيه بالعمل وبما ان من حق الطائفة ان تستقطع من تاميناتكم ثلاثة دنانير يوميا حسب المادة ـ ٦ ـ من صحيفة الشروط العامة وليس لك عذر باي حال من الاحوال حسب نفس المادة التي تنص ( وسوف يرفض اي اعتراض يقدم من قبل المقاول لتأخره بالعمل ) وخلافك مع مهندس الطائفة لا يبرر تخلفك او تأخرك حسب المادة الخامسة من نفس الصحيفة والتي تنص :-

للمهندس المشرف الحق في تعديل الخرائط والكميات حسب ما يراه مناسبا ولا يحق للمقاول الاعتراض على ذلك وان الكميات الزائدة والناقصة تسعر حسب سعر المقاول في جدول الكميات .

لذا فاللجنة الادارية تنذركم بموجب المادة السادسة من الصفحة الثانية من الشروط العامة التي تنص يتنازل الفريقان المتعاقدان عن توجيه الانذارات من احدهما الى الاخر بواسطة كاتب العدل في شؤون هذه المقاولة وكل انذار موجه من احد الفريقين ينبغي اما ان يسلم بعنوان الفريق الاخر او ان يرسل اليه بالبريد المسجل .

ان اللجنة الادارية تنذركم بموجب هذه المادة بالبدأ بالعمل في تأريخ اقصاه يوم الثلاثاء الموافق ٢٢ / ١ / ١٩٥٧ وفي حالة عدم بدأكم بالتأريخ المذكور فقد تضطر الطائفة باستعمال حقها حسب المادة ـ ١٨ ـ وتقوم هي باتمام العمل على حسابكم استنادا الى بنود تلك المادة .

فاذا لم تبدأ في العمل في التأريخ المذكور فيرجى منكم الحضور يوم الثلاثاء من نفس التأريخ السابق مساء لاجراء الجرد اللازم حسب ما تنص المادة ـ ١٨ ـ وفي حالة عدم حضوركم او حضور من يمثلكم فسوف تضطر الطائفة الى القيام بالجرد اللازم حسب ما ينص عليه البند ج من المادة ـ ١٨ ـ التي تنص :-

فاذا لم يحضر المقاول او لم يرسل مندوبا ينوب عنه فيجرى الجرد بغيابه ويعلمكم بذلك بان الطائفة سوف تتوقف عن دفع مبلغ لكم الى حين اتمام العمل حسب ما تنص عليه المادة ـ ١٨ ـ والذى هو ( يمكن للطائفة ان تمتنع عن صرف اي مبالغ تكون مستحقة له حتى يتم تسوية هذه النفقات والخسائر ) ان الطائفة تمنعكم من رفع اية مواد او ادوات او مكائن عائدة لكم في حالة عدم بدأكم بالعمل في التأريخ المذكور حسب المادة ـ ١٨ ـ من الشروط العامة .

ان هذا الانذار لا يمنع الطائفة من التمسك بحقها بتغريمكم حسب ما تنص عليه المقاولة (٦) كما ان امرها لكم بالبدأ بالعمل لا يعتبر اعترافا بجودة العمل الذي تم .

18 – سحب العمل من المقاول وما يترتب عليه ⟦line⟧

أ – اذا عجز المقاول عن البدأ بالعمل بسرعة لمجرد استلامه اخطارا كتابيا بذلك . ب – او اذا قصر في القيام بتنفيذ الاعمال بالسرعة المطلوبة . ج – او اذا عجز عن القيام بتنفيذ الاعمال بما يطابق العقد . د – او اذا تأخر في اكمال الاعمال عن الميعاد المحدد في العقد . هـ – او اذا اوقف العمل فعلا لمدة اربعة عشر يوما بدون تصريح كتابي من الطائفة الا اذا اثبت وجود قوة قاهرة واخبر المهندس والطائفة بها فورا وكتابة . و – او اذا عجز عن توريد او تركيب آلات وعمال ومواد ومهمات كافية ومناسبة حتى يمكن ان ينفذ العمل الدائم بسرعة وبدون انقطاع . ز – او اذا ارتكب بالذات او بالواسطة اية مخالفة لاى نص او نصوص المقاولة ملزم بتنفيذه او بملاحظته واستمر في هذه المخالفة مدة 14 يوما ( مع مراعاة اى شرط خاص ينص على مدة اقصر ) بعد انذاره كتابة من المهندس باصلاح هذه المخالفة . ح – او اذا ترك العمل كليا . ط – او اذا اصبح المقاول ( سواء كان في العراق او في الخارج ) مفلسا او اذا قدم طلبا بالافلاس او ثبت عسره المالي او تصالح مع دائنه او اذا كان المقاول شركة وجرت تصفيتها سواء أكانت التصفية جبرية ام اختيارية ( الا اذا كانت التصفية اختيارية يقصد اعادة تأليف الشركة على اساس مقررة كتابة من الحكومة ) او اذا كان المقاول شركة وجرى حلها او اذا اعطى المقاول او وعد او قدم هدية او سلفة او مكافئة او منفعة مهما كانت نوعها لاى موظف او عامل من موظفي الطائفة سواء أكان مستقلا او له اى علاقة بالعمل موضوع هذا العقد فللطائفة في اى حالة من هذه الاحوال :ـ

1 – ان تسحب من المقاول تنفيذ باقي الاعمال . 2 – ويكون سحب تنفيذ باقي الاعمال طبقا لما ذكر آنفا بموجب ارسال انذار كتابي بأمر من رئيس اللجنة الادارية للطائفة الاسرائيلية الى المقاول ويكون هذا الانذار صحيحا نافذ المفعول بدون اتخاذ اى اجراءات قانونية او رسمية . 3 – واذا منح المقاول اى مهلة او تساهل فأن ذلك لا يقلل او يخل بحقوق الطائفة بمقتضى هذه المادة ولا تمس الاحكام السابقة بحق الطائفة في المطالبة بالتعويضات المقررة بمقتضى القوانين المرعية . 4 – وفي حالة سحب العمل او جزء منه من المقاول طبقا لما سبق بيانه او طبقا لاى احكام اخرى واردة بالعقد للطائفة تبعا لتقديرها الكلفة ان تستعمل احد الحقوق الاتية :ـ

أ – ان تقوم بنفسها على حساب المقاول بتنفيذ جميع الاعمال التي لم تتم بعد او اى جزء منها . ب – ان تضع كل او بعض الاعمال التي لم تتم بعد في المناقصة من جديد .

Page 3 18 – Withdrawal of Work from the Contractor and its Consequences ⟦line⟧ A – If the contractor fails to start the work promptly upon receiving written notice to do so. B – Or if he falls short in performing the execution of works with the required speed. C – Or if he fails to perform the execution of works in accordance with the contract. D – Or if he delays in completing the works beyond the deadline specified in the contract. E – Or if he actually stops work for a period of fourteen days without written permission from the Community, unless he proves the existence of force majeure and immediately informs the Engineer and the Community in writing. F – Or if he fails to supply or install machinery, labor, materials, and equipment that are sufficient and appropriate so that the permanent work can be executed quickly and without interruption. G – Or if he commits, personally or through an intermediary, any violation of any provision or provisions of the contract he is bound to execute or observe, and continues in this violation for a period of 14 days (taking into account any special condition stipulating a shorter period) after being warned in writing by the Engineer to rectify this violation. H – Or if he abandons the work entirely. I – Or if the contractor becomes (whether in Iraq or abroad) bankrupt, or if he files an application for bankruptcy, or if his financial insolvency is proven, or if he reaches a settlement with his creditors, or if the contractor is a company and it has been liquidated, whether the liquidation was compulsory or voluntary (unless the voluntary liquidation is intended for the re-formation of the company on a basis approved in writing by the government), or if the contractor is a company and it was dissolved, or if the contractor gives, promises, or offers a gift, advance, reward, or benefit of any kind to any employee or worker among the Community's employees, whether he is independent or has any relation to the work subject of this contract, then the Community may, in any of these cases:ـ 1 – Withdraw from the contractor the execution of the remaining works. 2 – The withdrawal of the execution of the remaining works shall be according to what was previously mentioned by sending a written warning by order of the President of the Administrative Committee of the Israelite Community to the contractor, and this warning shall be valid and effective without taking any legal or official procedures. 3 – If the contractor is granted any extension or leniency, this does not reduce or prejudice the rights of the Community under this article, and the preceding provisions do not affect the Community's right to claim the compensations established under the laws in force. 4 – In the event of withdrawing the work or part of it from the contractor according to what was previously explained or according to any other provisions contained in the contract, the Community may, at its discretion regarding cost, exercise one of the following rights:ـ A – To perform itself, at the contractor's expense, the execution of all the works that have not been completed yet, or any part thereof. ٦- اذا تأخر المقاول في انجاز العمل ضمن المدة المعينة من قبله عليه ان يدفع خمسة دنانير ( -/٥ دنانير ) يوميا للطائفة الاسرائيلية ببغداد وسوف يرفض اي اعتراض يقدم من قبل المقاول لتأخره بالعمل وتستقطع هذه التعويضات من استحقاقه او تأميناته .

٧- عند عدم ذكر نوعية اية مادة موجودة في جدول الكميات سيكون المهندس المشرف وحده مسؤولا باختيارها حسب ما يراه مناسبا ولا يحق للمقاول الاعتراض على ذلك مطلقا .

ج - أن تتفق مع احد المقاولين بصورة خصوصية لاتمام العمل . وفي كل هذه الاحوال يكون للطائفة الحق في حجز كل او بعض الآلات والادوات والمواد التي استحضرها المقاول وفي استعمالها في اتمام العمل وذلك بدون ان تكون مسؤولة لدى المقاول او غيره عن هذه الآلات والادوات والمواد وعما يصيبها من تلف او نقص في القيمة لاى سبب ومن دون ان تكون مسؤولة ايضا عن دفع اى مبلغ يستحق عنها لفريق آخر او دفع اى اجر عنها للمقاول او لغيره . ويكون للطائفة الحق على كل حال في حجز كل او بعض الآلات والادوات والمواد حتى بعد انتهاء العمل وذلك ضمانا لحقوقها ويجب على المقاول ان يدفع للطائفة كل ما تتكبده من النفقات في هذا السبيل زيادة عن قيمة العقد وعليه ان يعوضها عن كل الخسائر التي تتكبدها بسبب ذلك . وللطائفة ان تخصم قيمة النفقات والخسائر المشار اليها من مبلغ التأمينات او من طلبات المقاول او من اى مال يعود له اما اذا كلف العمل باقل من اسعار المقاولة فلا يرجع الفرق الى المقاول .

ولهذا الغرض يمكن للطائفة ان تمتنع عن صرف اى مبالغ تكون منحته له حتى يتم تسوية هذه النفقات والخسائر وللطائفة ان تبيع الآلات والادوات او المواد التي استحضرها المقاول من دون ان تكون مسؤولة عن اى خسارة تلحق به من جراء بيعها .

في حالة سحب العمل من المقاول ينظم كشف جرد عن الاشغال والمباني والادوات والمعدات والمواد التي تكون بموقع العمل وعن العمل الذي تم بحالة مرضية وذلك بمعرفة مهندس الطائفة المسؤول ويحصل هذا الجرد بحضور المقاول الذي يجب انذاره رسميا للحضور هو او مندوبه فاذا لم يحضر المقاول او لم يرسل مندوبا عنه فيجرى الجرد بغيابه .

ويثبت هذا الجرد بموجب محضر موقع عليه من قبل مهندس الطائفة والمقاول او من ينوب عنه فاذا قام اى خلاف او نزاع بشأن حالة العمل الموجود فيجب اثبات هذا الخلاف او النزاع وطبيعة المحضر المشار اليه .

The Sect shall have the right in any case to seize all or some of the machinery, tools, and materials even after the completion of the work as a guarantee for its rights. The contractor must pay the Sect all the expenses it incurs in this regard in excess of the contract value, and he must compensate it for all the losses it incurs because of that. The Sect may deduct the value of the expenses and losses referred to from the amount of insurance or from the contractor's claims or from any money belonging to him; however, if the work costs less than the contract prices, the difference shall not be returned to the contractor. For this purpose, the Sect may refrain from paying any amounts that have been granted to him until these expenses and losses are settled, and the Sect may sell the machinery, tools, or materials brought by the contractor without being responsible for any loss incurred by him as a result of their sale. استنادا الى المقاولة المعقودة بين رئاسة اللجنة الادارية للطائفة الاسرائيلية ببغداد وبينكم ، تعهدتم باتمام العمل بمدة اقصاها شهرين ونتيجة للزيادة الحاصلة في البناء والتي لا تتعدى باية حال من الاحوال ٢٥ ٪ تكون مدة العقد لا تتجاوز ٧٥ يوما بينما مضى على البناء مدة تجاوز ال ١٠٠ يوم بموجب كتاب الطائفة المؤرخ ٣ / ١٠ / ٩٥٦ والمرقم م / ٣٦٥ / ٥٦ الذى يامركم فيه بالعمل وبما ان من حق الطائفة ان تستقطع من تاميناتكم ثلاثة دنانير يوميا حسب المادة ـ ٦٠ ـ من صحيفة الشروط العامة وليس لك عذر باى حال من الاحوال حسب نص المادة التي تنص ( وسوف يرفض اى اعتراض يقدم من قبل المقاول لتاخره بالعمل ) وخلافك مع مهندس الطائفة لا يبرر تخلفك او تأخرك حسب المادة الخامسة من نفس الصحيفة والتي تنص "ـ

للمهندس المشرف الحق في تبديل الخرائط والكميات حسب ما يراه مناسبا ولا يحق للمقاول الاعتراض على ذلك وان الكميات الزائدة والناقصة تسعر حسب سعر المقاول في جدول الكميات .

لذا فاللجنة الادارية تذكركم بموجب المادة السادسة من الصفحة الثانية من الشروط العامة التي تنص يتنازل الفريقان المتعاقدان عن توجيه الانذارات من احدهما الى الاخر بواسطة كاتب العدل في شؤون هذه المقاولة وكل انذار موجه من احد الفريقين ينبغي اما ان يسلم بعنوان الفريق الاخر او ان يرسل اليه بالبريد المسجل .

ان اللجنة الادارية تنذركم بموجب هذه المادة بالبدء بالعمل في تأريخ اقصاه يوم الثلاثاء الموافق ٢٢ / ١ / ١٩٥٧ وفي حالة عدم بدائكم بالتأريخ المذكور فقد تضطر الطائفة بأستعمال حقها حسب المادة ـ ١٨ ـ وتقوم هي باتمام العمل على حسابكم استنادا الى بنود تلك المادة .

الصيانة على نفقته الخاصة وتعاد اليه التأمينات او ما تبقى منها بعد استقطاع المبالغ المترتبة عليه اصوليا عند نهاية مدة الصيانة وبعد ان يكون المقاول قد وفى التزاماته وتم استلام العمل منه نهائيا .

على المقاول ان يقوم بالاصلاحات التي تطلبها منه الطائفة خلال اسبوع من تاريخ تبليغه كتابة وعند تخلفه عن القيام بالعمل تقوم الطائفة بسحب التأمينات العائدة له اذا كانت بشكل كفالة مصرف وتقوم بالعمل على حسابه وتستقطع المبلغ منه .

١٦- الانذارات يتنازل الفريقان المتعاقدان عن حق توجيه الانذارات من احدهما الى الاخر بواسطة كاتب العدل في شؤون هذه المقاولة . وكل انذار موجهة من احد الفريقين ينبغي اما ان يسلم بعنوان الفريق الاخر او ان يرسل اليه بالبريد المسجل .

١٧- قوانين العمال المقاول مسؤول عن تطبيق قانون العمال فيما يتعلق بكافة شؤون العمال ومراعاتها بشأن اجور العطل الرسمية والاعياد والتعويضات كما وانه مسؤول عن الحوادث التي تقع لمستخدميه في محل العمل وعليه ان يدفع جميع التعويضات المترتبة على ذلك حيث ان الطائفة غير مسؤولة على الاطلاق فيما يتعلق بالعمال .

سحب العمل من المقاول وما يترتب عليه

أ - اذا عجز المقاول عن البدء بالعمل بسرعة لمجرد استلامه اخطارا كتابيا بذلك . ب - او اذا قصر في القيام بتنفيذ الاعمال بالسرعة المطلوبة . ج - او اذا عجز عن القيام بتنفيذ الاعمال بما يطابق العقد . د - او اذا تأخر في اكمال الاعمال عن الميعاد المحدد في العقد . هـ - او اذا اوقف العمل فعلا لمدة اسبوع بدون تصريح كتابي من الطائفة الا اذا اثبت وجود قوة قاهرة واخبر المهندس والطائفة بها فورا وكتابة . و - او اذا عجز عن توريد او تركيب آلات وعمال ومواد ومهمات كافية ومناسبة حتى يتمكن ان ينفذ العمل الدائم بسرعة وبدون انقطاع . ز - او اذا ارتكب بالذات او بالواسطة اية مخالفة لأي من نصوص المقاولة ملزم بتنفيذه او بملاحقته واستمر في هذه المخالفة مدة ١٤ يوما ( مع مراعاة اي شرط خاص ينص على مدة اقصر ) بعد انذاره كتابة من قبل المهندس باصلاح هذه المخالفة . ح - او اذا ترك العمل كليا .

الشروط العامة

١- على المناقص تقديم تأمينات نقدية قدرها -/٣٠ دينار ويجوز تقديم هذه التأمينات على شكل كتاب ضمان من احد المصارف الى رئاسة الطائفة الاسرائيلية ببغداد .

٦- اذا تاخر المقاول في انجاز العمل ضمن المدة المعينة من قبله عليه ان يدفع ثلاثة دنانير ( ٣ دنانير ) يوميا للطائفة الاسرائيلية ببغداد وسوف يرفض اي اعتراض يقدم من قبل المقاول لتأخره بالعمل وتستقطع هذه التعويضات من استحقاقه او تأميناته .

لذا فاللجنة الادارية تنذركم بموجب المادة السادسة من الصفحة الثانية من الشروط العامة التي تنص يتبادل الفريقان المتعاقدان عن توجيه الانذارات من احدهما الى الاخر بواسطة كاتب العدل في شؤون هذه المقاولة وكل انذار موجه من احد الفريقين ينبغي اما ان يسلم بعنوان الفريق الاخر او ان يرسل اليه بالبريد المسجل .

ويكون للطائفة الحق على كل حال في حجز كل او بعض الآلات والادوات والمواد حتى بعد انتهاء العمل وذلك ضمانا لحقوقها ويجب على المقاول ان يدفع للطائفة كل ما تتكبده من النفقات في هذا السبيل زيادة عن قيمة العقد وعليه ان يعوضها عن كل الخسائر التي تتكبدها بسبب ذلك . وللطائفة ان تخصم قيمة النفقات والخسائر المشار اليها من مبلغ التأمينات او من طلبات المقاول او من اى مال يعود له اما اذا كلف العمل باقل من اسعار المقاولة فلا يرجع الفرق الى المقاول . ولهذا الغرض يمكن للطائفة ان تمتنع عن صرف اى مبالغ تكون منحته له حتى يتم تسوية هذه النفقات والخسائر وللطائفة ان تبيع الآلات او الادوات او المواد التي استحضرها المقاول من دون ان تكون مسؤولة عن اى خسائر تلحق به من جراء بيعها .

١٩- تشمل الاسعار الواجب وضعها من قبل المقاول تخطيط ارض البناية حسب الخرائط مع تهيئة سطح الارض <del>وذلك</del> برفع الانقاض ونقلها خارجا ( بالسيارات ان تطلب الامر ) بحيث يتخلص منها نهائيا . ويشمل كذلك تنظيف البناية والموقع بعد اكمال العمل بحيث تكون صالحة للاستعمال مباشرة قبل استلامها استلاما مؤقتا من قبل الطائفة او المهندس المشرف .

٢٠- للطائفة الحق بالقيام باية فقرة على مسؤوليتها الخاصة بتجهيز المواد والعمل او المواد فقط ويقوم المتعهد بالعمل وتكون الاجرة حسب الاتفاق اذا ارتأت الطائفة ضرورة لذلك اما اذا قامت الطائفة بتجهيز المواد والعمل فيكون ذلك على حساب المتعهد .

٢١- اذا استحدثت فقرات جديدة غير مذكورة في المقاولة فيتفق عليها من قبل الطائفة ومهندسها من جهة والمقاول من الجهة الاخرى فاذا لم يتفقا فلهم ان يحكموا من لهم خبرة بذلك على ان الاختلاف على ذلك لا يعطي المتعهد اى حق بتأخير العمل .

Page 5 The Community shall have the right in any case to seize all or some of the machinery, tools and materials even after the completion of the work, in order to guarantee its rights, and the contractor must pay to the Community all the expenses it incurs in this regard in excess of the contract value, and he must compensate it for all the losses it incurs because of that. The Community may deduct the value of the expenses and losses referred to from the insurance amount or from the contractor's claims or from any money belonging to him, but if the work cost less than the contract prices, the difference shall not return to the contractor. For this purpose, the Community may refrain from paying any amounts that have been granted to him until these expenses and losses are settled, and the Community may sell the machinery, tools or materials that the contractor brought without being responsible for any losses incurred by him as a result of selling them. In the event that the work is withdrawn from the contractor, an inventory report shall be organized regarding the works, buildings, tools, equipment and materials that are at the work site and regarding the work that has been completed in a satisfactory condition, by the Community's responsible engineer, and this inventory shall take place in the presence of the contractor who must be officially notified to attend, either him or his representative. If the contractor does not attend or does not send a representative on his behalf, the inventory shall be carried out in his absence. ⟦24 / 10⟧ This inventory shall be established by a report signed by the Community's engineer and the contractor or his representative. If any dispute or conflict arises regarding the condition of the existing work, this dispute or conflict and its nature must be established in the aforementioned report. 19- The prices to be set by the contractor include planning the building plot according to the maps with preparing the ground surface <del>and that</del> by removing debris and transporting it outside (by cars if required) so that it is disposed of permanently. It also includes cleaning the building and the site after completion of the work so that it is fit for use immediately before its provisional acceptance by the Community or the supervising engineer. 20- The Community has the right to carry out any item on its own responsibility by providing materials and labor or materials only and the contractor carries out the work and the fee shall be as agreed upon if the Community deems it necessary, but if the Community provides the materials and labor, it shall be at the expense of the contractor. 21- If new items are introduced that are not mentioned in the contract, they shall be agreed upon by the Community and its engineer on one hand and the contractor on the other hand. If they do not agree, they may appoint experts in that, provided that the disagreement on that does not give the contractor any right to delay the work. ⟦illegible⟧

موقع العمل حسب تقديرها المحلي . على ان لا تعتبر هذه السلفات الممنوحة الى المقاول بمثابة اعتراف بقبول العمل من جانب الطائفة بل تطبق شروط المقاولة على جميع العمل المنجز وغير المنجز الى ان يتم تسليمه نهائيا الى الطائفة .

١٣ – الذرعة النهائية وتسديد حساب المقاول

بعد اكمال العمل تماما من كافة الوجوه بشهادة مهندس الطائفة تقوم الطائفة الاسرائيلية باستلام العمل استلاما موقتا ويسدد حساب المقاول بموجب المبلغ الاجمالي المقطوع المتفق عليه في هذه المقاولة بعد طرح كافة السلف المدفوعة الى المقاول على حساب اعماله اما تأمينات المقاول فتحتفظ بها الطائفة مدة الصيانة وتعاد اليه بانتهائها وبعد الاستلام النهائي للعمل .

١٤ – رفض العمل

بحق للمهندس رفض اي مواد يجهزها المقاول او اي عمل يكون بنظر المهندس قائما على جودة وصنعة غير مستوفيتين للمستوى المطلوب او غير مطابق للمواصفات او الخرائط المختصة بالمقاولة وعلى المقاول ان يرفع المواد والعمل المرفوض ويعيد تنفيذه على نفقته الخاصة بما فيه المواد الموجودة في العمل المرفوض . كل عمل يقام به بدون تفويض بالاضافة الى التفاصيل المعطاة في الخرائط او التعليمات الصادرة سوف لا تعترف به ولا تقوم بذرعته ولا تدفع الى المقاول قيمة المواد المستعملة في تنفيذ مثل هذه الاعمال .

١٥ – مدة الصيانة

على المقاول ان يقوم بصيانة العمل لمدة ثلاثة اشهر من تاريخ استلام الطائفة للعمل منه استلاما موقتا وعليه ان يصلح جميع النواقص او العيوب التي قد تظهر ابان مدة الصيانة على نفقته الخاصة وتعاد اليه التأمينات او ما تبقى منها بعد استقطاع المبالغ المترتبة عليه اصوليا عند نهاية مدة الصيانة وبعد ان يكون المقاول قد وفى التزاماته وتم استلام العمل منه نهائيا . على المقاول ان يقوم بالاصلاحات التي تطلبها منه الطائفة خلال اسبوع من تاريخ تبليغه كتابة وعند تخلفه عن القيام بالعمل تقوم الطائفة بسحب التأمينات العائدة له اذا كانت بشكل كفالة مصرف وتقوم بالعمل على حسابه وتستقطع المبلغ منه .

١٦ – الانذارات

يتنازل الفريقان المتعاقدان عن حق توجيه الانذارات من احدهما الى الاخر بواسطة كاتب العدل في شؤون هذه المقاولة . وكل انذار موجهة من احد الفريقين ينبغي اما ان يسلم بعنوان الفريق الاخر او ان يرسل اليه بالبريد المسجل .

١٧ – قوانين العمال

المقاول مسؤول عن تطبيق قانون العمال فيما يتعلق بكافة شؤون العمال ومراعاتها بشأن اجور العطل الرسمية والاعياد والتعويضات كما وانه مسؤول عن الحوادث التي تقع لمستخدميه في محل العمل وعليه ان يدفع جميع التعويضات المترتبة على ذلك حيث ان الطائفة غير مسؤولة على الاطلاق فيما يتعلق بالعمال .

Page 2 the work site according to its local estimation. Provided that these advances granted to the contractor are not considered an admission of acceptance of the work by the Community; rather, the terms of the contract apply to all completed and uncompleted work until it is finally handed over to the Community. 13 – Final Measurement and Settlement of the Contractor’s Account After the work is fully completed in all respects as certified by the Community's engineer, the Jewish Community shall take provisional delivery of the work, and the contractor’s account shall be settled according to the agreed-upon lump sum amount in this contract, after deducting all advances paid to the contractor on account of his work. As for the contractor’s security deposits, the Community shall retain them for the maintenance period and return them to him upon its conclusion and after the final handover of the work. 14 – Rejection of Work The engineer has the right to reject any materials supplied by the contractor or any work which, in the engineer's view, is based on quality and workmanship that do not meet the required standard or are not compliant with the relevant specifications or drawings of the contract. The contractor must remove the rejected materials and work and re-execute them at his own expense, including the materials present in the rejected work. Any work carried out without authorization in addition to the details given in the drawings or issued instructions will not be recognized, measured, or paid to the contractor for the value of the materials used in the execution of such works. 15 – Maintenance Period The contractor shall maintain the work for a period of three months from the date the Community takes delivery of the work from him provisionally. He must repair all deficiencies or defects that may appear during the maintenance period at his own expense. The security deposits or what remains of them shall be returned to him after deducting the amounts due from him properly at the end of the maintenance period and after the contractor has fulfilled his obligations and the final handover of work from him has been completed. The contractor must carry out the repairs requested by the Community within one week from the date of written notification. If he fails to perform the work, the Community shall withdraw the security deposits belonging to him if they are in the form of a bank guarantee, and carry out the work at his expense and deduct the amount from him. 16 – Notices The two contracting parties waive the right to direct notices from one to the other through the Notary Public regarding the matters of this contract. Every notice directed from one party should either be delivered to the address of the other party or sent to them by registered mail. 17 – Labor Laws The contractor is responsible for applying the Labor Law regarding all labor matters and observing it concerning wages for official holidays, feasts, and compensation. He is also responsible for accidents that occur to his employees at the work site and must pay all compensation resulting therefrom, as the Community is not responsible at all regarding the laborers. ,, Continued ,,
