B04 · paragraph / arabic اقيمت الدعوى لدى محكمة البداءة في الكرادة برقم 185/ب/1948 من قبل المدعي صالح يوسف ساسون بصفته وصيا على القاصرين سليم وادمون ولدي يوسف ساسون وطلب فيها الحكم له بمبلغ 1500 دينار قيمة حصة القاصرين المذكورين في الدار المرقمة 15/18 في محلة البتاوين بزعم ان جدهم يوسف ساسون كان قد سجل الدار المذكورة باسم زوجته سارة ساسون في دائرة الطابو في سنة 1938 وان المذكورة قد باعت الدار المذكورة الى المدعى عليها الطائفة الاسرائيلية بموجب المقاولة المؤرخة في 22/10/1946 بمبلغ 3000 دينار وان المذكورة سارة ساسون قد توفيت في سنة 1947 وان البيع المذكور لم يسجل في دائرة الطابو وان المدعى عليها الطائفة الاسرائيلية قد وضعت يدها على الدار المذكورة وتصرفت بها تصرف المالكين وطلبت المدعية ابطال المقاولة المذكورة والحكم لها بالمبلغ المذكور الذي يمثل حصة القاصرين في الدار المذكورة باعتبار ان البيع لم يسجل في دائرة الطابو وان المدعى عليها قد وضعت يدها على الدار المذكورة بدون وجه حق وقد ردت المحكمة المذكورة دعوى المدعي المذكور لعدم ثبوت ملكية القاصرين للدار المذكورة بموجب قرارها المرقم 185/ب/1948 والمؤرخ في 18/1/1949 واستأنف المدعي المذكور الحكم المذكور لدى محكمة استئناف بغداد بالرقم 15/1949 وقد قررت المحكمة المذكورة بقرارها المرقم 15/1949 والمؤرخ في 18/4/1949 رد الاستئناف وتأييد الحكم المستأنف لعدم ثبوت ملكية القاصرين للدار المذكورة باعتبار ان المقاولة المذكورة هي مقاولة بيع خارجية لم تسجل في دائرة الطابو وان الدار المذكورة مسجلة باسم سارة (ام المورث) وان الوصي يطلب حصة مورثيه من ثمن الدار المذكورة وبما ان البيع لم يسجل في دائرة الطابو فلا يترتب عليه اي اثر قانوني وان دعوى المدعي لا تستند الى اساس قانوني سليم فلهذا قرر المجلس الاداري للطائفة الاسرائيلية في جلسته المنعقدة في 11/5/1949 رد طلب الوصي المذكور لعدم ثبوت ملكية القاصرين للدار المذكورة وان الدار المذكورة مسجلة باسم الطائفة الاسرائيلية في دائرة الطابو بموجب سند الطابو المرقم 1188 والمؤرخ في 2/12/1948 وان الطائفة قد اشترت الدار المذكورة من مالكتها المسجلة باسمها في دائرة الطابو وهي سارة ساسون بموجب المقاولة المذكورة اعلاه وان الطائفة قد دفعت الثمن المذكور الى البائعة المذكورة بموجب وصولات رسمية موقعة من قبلها ومصدقة من قبل كاتب العدل وان الوصي المذكور لم يقدم اي دليل يثبت ملكية القاصرين للدار المذكورة وانما هو الوصي يطالب بالثمن الذي قبضته جدتهم سارة ساسون من الطائفة المذكورة بموجب المقاولة المذكورة اعلاه.

Presidency of the Jewish Community Baghdad Committee for the Administration of Minors' Property Subject: Petition submitted by Saleh Youssef Sassoon Property Records Register: Number: 327 119 Dossier 24 A lawsuit was filed in the Karrada Court of First Instance under number 185/B/1948 by the plaintiff Saleh Youssef Sassoon in his capacity as guardian of the minors Salim and Edmond, sons of Youssef Sassoon, requesting a judgment for 1500 Dinars, representing the share of the aforementioned minors in the house numbered 15/18 in the Battaween neighborhood, claiming that their grandfather Youssef Sassoon had registered the mentioned house in the name of his wife Sarah Sassoon at the Land Registry Department in 1938, and that she had sold the mentioned house to the defendant, the Jewish Community, under the contract dated 10/22/1946 for the sum of 3000 Dinars, and that the mentioned Sarah Sassoon died in 1947, and that the mentioned sale was not registered in the Land Registry Department, and that the defendant, the Jewish Community, had taken possession of the mentioned house and acted as its owners. The plaintiff requested the annulment of the mentioned contract and a judgment for the mentioned amount representing the minors' share in the house, considering that the sale was not registered in the Land Registry and that the defendant had taken possession of the house without right. The mentioned court dismissed the plaintiff's lawsuit due to lack of proof of the minors' ownership of the house by its decision number 185/B/1948 dated 1/18/1949. The plaintiff appealed the judgment to the Baghdad Court of Appeal under number 15/1949. The mentioned court decided in its decision number 15/1949 dated 4/18/1949 to dismiss the appeal and uphold the appealed judgment due to lack of proof of the minors' ownership of the house, considering that the mentioned contract is an external sale contract not registered in the Land Registry, and that the house is registered in the name of Sarah (the mother of the deceased), and that the guardian is requesting the share of his wards from the price of the house. Since the sale was not registered in the Land Registry, it has no legal effect, and the plaintiff's claim has no sound legal basis.
