ان بموجب ملف ص (١١) حسب بينة العدلية ان توفيق بك المسمى الصادر في المحفظة ٢٧/٢/٢٧ هو نفس توفيق احمد ضيف سلطان الوارد اسمه في امرها ص (٦٦) من المحفظة ٦/٤/٢٥ للقبض عليه لكون جرمه سياسياً ولا يطبق المادة ١٠٠ ارجو مراجعة ص (٤٠) من هذه المحفظة ايضاً . ان المخابرة الموجودة في المحفظة الاولى لم يرسل نسخ منها الى المتصرفية او الى الشرطة ، وقد اكدت العدلية في ص (١٤) من هذه المحفظة ما سبق ان بينته في ص (١١) المذكورة اعلاه . لهذا المحفظة الان لم تبق حاجة لاتخاذ اي اجراء سوى هامش كتاب الخارجية ص (١٤)

Eastern Affairs Department 11212 27 December 1933 The Ministry of Foreign Affairs has the honor to refer to the memorandum of the Imperial Iranian Legation in Baghdad numbered 3382 and dated 10 October 1933 regarding the extradition of Iranian criminals and states that it is understood from the Legation's letter that the persons whose extradition is requested are three, namely Muhammad Ridha Beg, Muhammad Rashid Beg, and Tawfiq bin Fayd Allah Beg. Although the place to which these criminals fled was not specified, it has become clear from the specific extradition papers that the criminals whose extradition is requested are two, not three, namely Muhammad Ridha Beg bin Muhammad Rashid Beg and Tawfiq bin Fayd Allah Beg. Therefore, the Ministry requests the Legation to confirm this and to kindly specify the place to which the criminals whose extradition is requested fled in its memoranda in similar cases. The Ministry also wishes to clarify that orders have been issued to carry out the necessary legal proceedings regarding the two aforementioned criminals only, according to the clarity of the extradition papers pertaining to them, awaiting the Legation's confirmation that those whose extradition is requested are two criminals not three. We report that one of the criminals named Muhammad Salih al-Mulla Ali, aged 35 years, entered and surrendered himself to the Iraqi authorities in Halabja. Upon investigation into his nationality, it appeared that he and his father were born in the Iraqi village of Tawila within the Sulaymaniyah Governorate, and he was formerly Ottoman, having resided in that village habitually from 23 / 8 / 21 to 6 / 8 / 24, and he left Iraq for Iran seven years ago and worked as a servant for Jaafar Sultan in Nowsud for a period exceeding one year, then returned to Iraq and did not leave it again. تتشرف المفوضية الايرانية الامبراطورية بان تحيط وزارة الخارجية العراقية الملكية علما بان خمسة اشخاص من سكان قرية نول - جوانرود وهم الاتي ذكرهم فيما يلي :- احمد ، عزيز ، محمد ، مجيد ، مصطفى . ذهبوا في ٦ شباط ١٩٣٦ الى باغ كهنه لزيارة الشيخ حسام الدين ثم توجهوا نحو جوانرود وذلك بصحبة ستة اشخاص من اهالي قرية (طويلة) كانوا قد غادروا الاراضي العراقية وبينما كانوا سائرين في الطريق اذ التقوا بشخصين من الاشقياء المسلحين وهما المدعوان احمد بن قادر الثورباني ويوسف الغسودي وذلك بين قريتي (بلخه) و (بياره) وقد قام الشقيان المذكوران بالقاء القبض على الاشخاص الانفي الذكر غير انهما اطلقا سراح الستة الذين هم من اهالي الطويلة وذهبا بالخمسة الذين هم من اهالي جوانرود الى جبل واقع بالقرب من قرية كريدانه وحبساهم في غار كان فيه محمد رضا بك ومحمد تقي بك ابنا جعفر سلطان واربعة اشخاص اخر من الاشقياء وهم : اوله ، محمد صالح ، محمد سعيد ، صالح کرده . وقالا لهما بانهما سوف يقومان بقتلهم لو لم يدفعوا مئة تومان وبالنتيجة تمكن هؤلاء من الفرار وذلك في فرصة سنحت لهم بيد ان احد رفاقهم وهو المدعو علي محمد اصبح مفقودا عند عبوره الماء الكائن بجوار قرية كريدانه . فبناء على ما مر يرجى التفضل بالتوسط في القاء القبض على الاشقياء السالفي الذكر الذين سبق ان كانت قد ارسلت اوراق استردادهم الى الوزارة وتسليمهم الى سلطات الحدود الايرانية لكي يوضع حد للوضعية الراهنة وفي انتظار نتيجة ما يبذل من المساعي الحسنة بهذا الشأن تعرب المفوضية الخ .....

Copy of the memorandum of the Iranian Legation in Baghdad No. 1094 dated 4 May 1936 addressed to the Ministry of Foreign Affairs The Imperial Iranian Legation has the honor to inform the Royal Iraqi Ministry of Foreign Affairs that five individuals from the inhabitants of Nul village - Javanrud, who are mentioned below:- Ahmed, Aziz, Muhammad, Majid, Mustafa. went on 6 February 1936 to Bagh Kohneh to visit Sheikh Husam al-Din, then they headed towards Javanrud accompanied by six people from the residents of the village of (Tawila) who had left Iraqi territory. While they were walking on the road, they met two armed outlaws, namely Ahmed bin Qadir al-Thurbani and Yusuf al-Ghasoudi, between the villages of (Balkha) and (Byara). The two aforementioned outlaws arrested the previously mentioned persons, but they released the six who were from the people of Tawila and took the five who were from the people of Javanrud to a mountain located near the village of Kridaneh and imprisoned them in a cave where Muhammad Reza Bek and Muhammad Taqi Bek the sons of Jafar Sultan were, along with four other outlaws, namely: Awla, Muhammad Salih, Muhammad Said, Salih Kurda. They told them that they would kill them if they did not pay one hundred tomans. Consequently, these individuals managed to escape at an opportunity that arose for them, however, one of their companions, named Ali Muhammad, went missing while crossing the water located next to the village of Kridaneh. Based on the above, please be so kind as to mediate in the arrest of the aforementioned outlaws whose extradition papers had previously been sent to the Ministry, and hand them over to the Iranian border authorities in order to put an end to the current situation. تتشرف وزارة الخارجية بان تشير الى مذكرة المفوضية الايرانية الامبراطورية فــــــي بغداد المرقمة ٣٣٨٢ والمؤرخة في ١٠ تشرين الاول ١٩٣٣ حول استرداد مجرمــــــين ايرانيين وتبدي ان المفهوم من كتاب المفوضية ان الاشخاص المطلوب استردادهم ثلاثة وهــــــم محمد رضا بك ومحمد رشيد بك وتوفيق بن فيض الله بك ومع انه لم تعين الجهة التي التجاء اليها هؤلاء المجرمون فقد اتضح من اوراق الاسترداد الخاصة ان المجرمين المطلوب استردادهــــــم اثنان لا ثلاثة وهما محمد رضا بك بن محمد رشيد بك وتوفيق بن فيض الله بك فعليه ترجــــــو الوزارة ان تؤيد المفوضية ذلك وان تتفضل في تعيين الجهة التي التجاء اليها المجرمونــــــ المطلوب استردادهم في مذكرتها في القضايا المماثلة ومما ترجو الوزارة ايضاحه انه صدرتــــــ الاوامر لاجراء المعاملة القانونية المقتضاة فيما يخص المجرمين الاثنين المذكورين فقط حســــــب صراحة اوراق الاسترداد المختصة بهما منتظرة تأييد المفوضية كون المطلوب استردادهم مجرمين لا ثلاثة .

Eastern Affairs Division 11213 27 December 1933 The Ministry of Foreign Affairs has the honor to refer to the Imperial Iranian Legation memorandum in Baghdad No. 3382 dated 10 October 1933 concerning the extradition of Iranian criminals and states that the understanding from the Legation's letter is that the persons whose extradition is requested are three, namely: Muhammad Reda Bey, Muhammad Rashid Bey, and Tawfiq bin Faizullah Bey. Although the place to which these criminals fled was not specified, it has become clear from the specific extradition papers that the criminals requested for extradition are two, not three, namely Muhammad Reda Bey bin Muhammad Rashid Bey and Tawfiq bin Faizullah Bey. Therefore, the Ministry requests the Legation to confirm this and to kindly specify the place to which the criminals requested for extradition fled in its memorandum in similar cases. What the Ministry also requests clarification on is that orders have been issued to carry out the necessary legal proceedings regarding the two mentioned criminals only according to the clarity of the extradition papers concerning them, awaiting the Legation's confirmation that those requested for extradition are two criminals, not three. تدل الاخبار الواصلة الينا على ان ستة اشخاص ⟦...⟧ رعايا قرى جوانرود قد ذهبوا بصحبة ستة اشخاص آخرين من اهالي طويلة عند حضرة الشيخ حسام الدين لزيارته ، وعند عودتهم ووصولهم الى الطريق بين قريتي بلخه ودركشيخان قد هجم عليهم الشقاة والقوا القبض على الايرانيين الستة واخذوهم معهم بعد اطلاقهم سراح العراقيين الذين كانوا معهم . عندئذ اعلم احد الدراويش الشيخ حسام الذي بالامر وقام الاخير بدوره باعلامكم به . والآن نرجو من حضرتكم التفضل باتخاذ التدابير المقتضية لانقاذ لهؤلاء الايرانيين من ايدي الشقاة وللقبض على الشقاة انفسهم ومعاقبتهم شديداً وكذلك نرجو اعلامنا بالنتيجة ولكم الاحترام

Acting Governor of Sulaymaniyah Liwa A copy to - General Police Directorate Halabja District Sub-prefecture - in reference to our letter numbered S / 726 dated 5 / 7 / 936 210 / 2 The Iranian Legation has claimed that the outlaws belonging to Mahmud Khan attacked the neighboring villages and (5) Iranian individuals who came to Iraq to visit Sheikh Hussam al-Din and stayed for a period in a cave located in Iraqi territory until they were able, when the opportunity arose, to escape to Iranian territory. But it appeared that the attack took place during their departure. The aforementioned Legation requested the arrest of the said outlaws and their extradition. It appears from this response of the Administration that the case mentioned therein is the same case about which the correspondence was detailed in the Administration's letter S (758), in which the Iraqi ⟦Consul⟧ mentioned to his Iranian colleague that the investigation proved the incident occurred in Iranian territory, not in Iraqi territory, and it did not show that any of the outlaws were in Iraqi territory. Aziz . Muhammad . Majid . Mustafa went on February 6, 1936, to Bagh Kohneh to visit Sheikh Hussam al-Din, then they headed towards Javanrud in the company of six persons from the residents of the village of (Tawila) who had left Iraqi territory. While they were walking on the road, they met two armed outlaws, namely the ones called Ahmed bin Qadir al-Nuryani and Yusuf al-Nowsudi, between the villages of (Balkha) and (Byara). The two aforementioned outlaws arrested the previously mentioned persons, but they released the six who are from the residents of Tawila and took the five who are from the residents of Javanrud to a mountain located near the village of Kridaneh and imprisoned them in a cave where Muhammad Reza Bek and Muhammad Taqi Bek, the sons of Jaafar Sultan, and four other outlaws were present, namely: Awla = Muhammad Salih = Muhammad Said = Salih Kurdah. And they told them that they would kill them if they did not pay one hundred Tomans. As a result, these people managed to escape at an opportunity that arose for them, however, one of their companions, named Ali Muhammad, went missing while crossing the water located next to the village of Kridaneh. Based on the above, please be so kind as to mediate in the arrest of the aforementioned outlaws whose extradition papers had previously been sent to the Ministry, and hand them over to the Iranian border authorities in order to put an end to the current situation. تتشرف المفوضية الامبراطورية في بغداد بان ترسل بطيها اوراق الاسترداد المتعلقة بالمدعوين حمد رضا بك ومحمد رشيد بك توفيق بن فيض الله بك الذين كانــــــوا قد ارتكبوا السرقات وقاموا بمقابلة القوات الايرانية الى وزارة الخارجية العراقية الملكية وترجــــــو منها التفضل بالايعاز الى السلطات المختصة بان تقوم باتخاذ الاجراءات السريعة في القاء القبض على الاشقياء المذكورين وتسليمهم الى السلطات الايرانية على الحدود وانباء المفوضية بالنتيجة .

الحاقا بكتابنا المرقم ٢٢٥٦٢ والمؤرخ في ١٢ / ١١ / ١٩٣٦ . نعرض بان احد المجرمين المدعو محمد صالح الملا علي البالغ عمره ٣٥ سنة قدم دخالته وسلم نفسه الى السلطات العراقية في حلبجة . ولدى التحقيق عن نية جنسيته ظهر بانه ووالده مولودان في قرية طويلة العراقية ضمن لواء السليما وكان عثماني سابقا اقام في تلك القرية عادة من ٢٣ / ٨ / ٢١ الى ٦ / ٨ / ٢٤ وقد غادر العراق الى ايران قبل سبع سنوات واشتغل خادما عند جعفر سلطان في نوسود لمدة تزيد على السنة الواحدة ثم عاد الى العراق ولم يغادره ثانية . فبالنظر لما تقدم يعتبر المجرم محمد صالح عراقيا بمقتضى المادة الثالثة من قانون الجنسية العراقية .

Further to our letter numbered 22562 and dated 12/11/1936. We report that one of the criminals named Muhammad Salih al-Mulla Ali, aged 35 years, surrendered and turned himself in to the Iraqi authorities in Halabja. Upon investigating his nationality, it appeared that he and his father were born in the Iraqi village of Tawila within the Sulaymaniyah Governorate, and he was previously an Ottoman subject who habitually resided in that village from 23/8/21 to 6/8/24 and had left Iraq for Iran seven years ago and worked as a servant for Jafar Sultan in Nowsud for more than one year, then returned to Iraq and did not leave it again. In view of the above, the criminal Muhammad Salih is considered Iraqi according to Article 3 of the Iraqi Nationality Law. ⟦signature⟧ Director General of Police
