B06 · paragraph / arabic هذا هو القسم الاخير من خطاب معالي الاستاذ علي ممتاز وزير المالية الذي القاه في جلسة النواب الاخيرة عند افتتاح مناقشة الميزانية العامة وتطرق فيه الى وضع البلاد المالي وقد نشرنا القسمين الاول والثاني من الخطاب في العددين الماضيين . وزارة الاقتصاد درجت نفقات هذه الوزارة (٣٢٧,١٤٥ ديناراً) ، وهو مبلغ يزيد عن تخصيصات السنة الماضية بمقدار (٢٦,٣٢٥) ديناراً . ويلاحظ ان وزارة الاقتصاد قد سبق لها العمل على تنظيم التجارة الخارجية ، وهي ماضية في هذا السبيل وقد تم تنظيم شؤون الشحن البحري للخارج فقد عقدت اتفاقات تجارية مع كل من لبنان والهند وباكستان والمانيا الغربية وايطاليا ، ويجري العمل الآن على تعديل بعض هذه الاتفاقات ، وعقد اتفاقات جديدة مع اليابان . ومصر والاردن كما ان الجهود مبذولة لتأليف شركة النقل البحري العراقية لحل مشكلة الشحن البحري حلاً يتفق مع مصالح المنتج العراقي . وتحقيقاً لاغراض قانون رقم ٩ لسنة ١٩٥٢ فقد تم تأسيس مصلحة مصافي النفط الحكومية ، واصبحت ادارة شؤون المنتجات النفطية المعدة للاستهلاك المحلي منوطة بها . ولا يزال العمل جارياً في تأسيس مصفى النفط في بغداد ، ولتحقيق مشروع مصفى الاسفلت وزيوت التزييت . وقد اولت الوزارة شؤون تطوير العشائر وتوطينها والصناعة اهتماماً كبيراً ، اذ انجزت حفر ١١ بئراً ارتوازياً جديداً ، بالاضافة الى ١٥٤ بئراً سبق حفرها بقصد تشجيع المشائر الرحالة على التوطين وممارسة الزراعة ، كما ان النية متجهة الى مسح جميع مناطق العراق جيولوجياً لاغراض التحري عن المعادن واستثمارها . ولاضافة الى ذلك فان اعمال البحث العلمي في الشؤون الصناعية ، وتقديم المعلومات الفنية لاصحاب المشاريع الصناعية والراغبين في تأسيس الصناعات الجديدة ، قد استمرت بانتظام ، ومن المنتظر توسيع مثل هذه الاعمال وزيادة كفاءتها .

B04 · paragraph / arabic علقت جريدة مانجستر غارديان على الحوادث في جنوب شرقي آسيا فقالت من قلة الاهتمام بالحوادث الخطيرة في ذلك الجزء من العالم حيث ترى ان غزو قوات فيت مينه لمنطقة لاوس ربما قد بدأ مرحلة يتغير فيها الوضع كله تغيراً كبيراً . ولكنها اضافت ان هجوم قوات فيت مينه ربما كان اعترافاً منها بانها قد اخفقت في مكان آخر او بانها قد تجابه هجوماً فرنسياً قوياً ولكن لا يبدو ان في هذه الحجج سنداً قوياً وواضح اذ ان قوات فيت مينه قد حسنت امكان سيطرتها على الهند الصينية ككل واذا استطاع الشيوعيون ان يجعلوا دولة سيام الجديدة حقيقة فاكبر الظن انهم سيتمكنون بدون تدخل سافر من جانب الصينيين من ان يهددوا حكومة سيام الحالية ويقلبوها آخر الامر . وليس ببعيد ان نجاحاً كبيراً يحرزه الشيوعيون في جنوب شرقي آسيا قد يمحو بين عشية وضحاها أثر الكبير مما عمله الجنرال تمبلر ويستطيع الشيوعيون ان يظهروا حركتهم بمظهر ثورات داخلية ليشوهوا حقيقة الوضع في نظر الامم المتحدة . واذا بقيت الدول الشيوعية الجديدة في المنطقة خاضعة لبكين فقد تدعمت الامبراطورية الصينية القديمة عن وعي او عن غير وعي . ومن جملة الانتصارات الصينية الاخيرة نجاح الصين في علاقاتها مع الشعوب المجاورة لها وربما يبرهن ذلك على مقدرة الصينيين على جعل البلدان الموالية لهم مقتنعة بمكتفية خططها على ان القول بذلك انما هو من سبق الامور ومع ذلك اذا كانت بيفان قد اتسعت فشملت الصين كلها افلا يمكن ان تتسع فيت مينه فتشمل جميع شعوب جنوب شرقي آسيا او معظمها ؟ ان هذه الحوادث وما يمكن ان يتأتى عنها لابد ان يكون لها اثرها على السياسة في مفاوضات الهدنة في بانمونجوم ، هذه المفاوضات التي يجب اتخاذها وسيلة لاستطلاع ما تنطوي عليه النوايا السوفياتية السلمية من معنى . ولعل اسبوعين من الزمن يكفيان لبيان ذلك . وحتى يمكن ان ذلك سينتظر الفرنسيون مرة اخرى في امكان عرض النزاع في الهند الصينية على هيئة الامم المتحدة .

B06 · paragraph / arabic بقلم فائق روفائيل بطي نحيي اليوم الذكرى الثامنة عشرة لوفاة الشيخ عبد المحسن الكاظمي شاعر العراق المنفي في صبيحة اول ايار سنة ١٩٣٥ قضت روح شاعرنا المغترب في مصر الجديدة ودفن فيها وحيداً بعيداً عن وطنه الذي دافع عنه بصيحاته المتكررة ، وسبق ان ضاق ذرعاً بالحكم الاستبدادي في العهد العثماني ، فهجر بلده واتخذ مصر وطناً ثانياً واقام فيها ما يقارب خمساً وثلاثين سنة . وعند وفاته نعته صحف مصر وابنه كبار الشعراء والادباء المصريين ، رددت واشادت بمزايا الشاعر ومكانته وصحف العراق التي اهملته معظمها حيا وذكرته ميتا . احييت في هذه الذكرى أن ألم بطرف من سيرة الكاظمي ليطلع عليها الجيل الجديد من الناشئة ليخلد ذكر شاعرنا المجيد الذي افنى زهرة شبابه في تسجيل مفاخرهم وكان وهو بعيد عنهم قريباً منهم في الروح والفكر . ولد عبد المحسن في بغداد سنة ١٨٦٥ ونشأ في الكاظمية ولذا سمي بها . درس الادب العربي واللغة الفارسية وزاول مهنة أبيه التجارة في أول الامر ثم تركها واحترف الزراعة فلم يلق نجاحاً ، فنبذها وانكف على الادب والمطالعة بمساعدة شقيقه محمد حسين الشاعر ، وأخذ يقرأ ويحفظ الاشعار وبلغ ما حفظه من جيد الشعر القديم نحو اثني عشر الف بيت وهو في سن العشرين وصادف أن تعرف على الشاعر السيد ابراهيم الطباطبائي النجفي ، فتتلمذ عليه وأخذ يباهي بروعة شعره . وفي ذلك الوقت وفد على بغداد رائد النهضة الشرقية جمال الدين الافغاني منفياً من ايران حيث لازمه شاعرنا وأخذ عنه بعض العلوم معتنقاً مبادئه ومن هنا هنأ هنري الكاظمي الشعر الاجتماعي فامتاز عن بقية الشعراء بخلو قصائده من التعقيد والاغراب ، ولكن الدهر لم يلبث أن قلب له ظهر المجن على أثر اخراج الافغاني من العراق ، حيث تناولته عيون السلطة ولاحقته النقمة لملازمته جمال الدين فغادر بغداد خفية الى البصرة ومنها الى ايران وشخص الى الهند وتوجه بعدها الى مصر على أن يبرحها الى استانبول في طريق عودته الى وطنه ولسوء الحظ اصيب بمرض خطير أضعف بصره ، وكتب له استيطان مصر الى نهاية عمره . وكانت نتيجة اسفاره واطلاعه على البقية على ص ٨

بقية . خطاب وزير المالية وذلك عن طريق تعديل نظام الضرائب ⟦illegible⟧ اخرى دون تكليف الاغلبية الساحقة بالرغم من خفض ضريبة الاملاك ولا سيما الضرائب غير المباشرة من الجمهور بأي عبء جديد . فلقد ورسوم الطوابع وضريبة الدخل ولهذا الغرض فقد تقدمت الوزارة ارتفع تخمين الايراد من ضريبة الدخل على الارباح الصغيرة . اليكم بعدد من التشريعات ، منها قانون ولا سيما الضرائب من شركات النفط ، كان الباب الرابع ، وهو الباب تعديل قانون رسوم الاستهلاك ، بمقدار ٨٨١ر٩١٤ر٥ ديناراً عن الخاص بايرادات الرسوم الكمركية وقانون رسوم استهلاك المواشي تخمينات السنة المالية السابقة بسبب والمكوس ، قد ارتفعت نسبة الايراد ومنتجاتها ، قاصدة من وراء هذين النشاط الملحوظ في اعمال استيراد النفط منه الى ( ٣٥,١ بالمائة ) من مجموع القانونين الغاء رسوم ما يستهلك محلياً وتصديره ، وزاد تخمين رسوم الاستيراد ايرادات الميزانية ، مقابل ( ٢٨,٨ بالمائة ) من اللحوم والسمن والصوف والجلود الكمركية بمقدار ٢,٠٠٠,٠٠٠ دينار في السنة الماضية ، حيث زاد تخمين والاقطان وطائفة اخرى من المنتجات نتيجة للتوسع المنتظر في تجارة الاستيراد ، حصيلته من ٠٠٠ر٣٥٠ر١٣ دينار الى المحلية ، بحيث تهبط تكاليف فقرات كما ان الضريبة على السمنت وزيادة ٠٠٠ر٨٩٠ر١٤ دينار ، بالرغم من هامة من غذاء الشعب وكسائه . المكس على البيرة قد انتجتا زيادة في الهبوط الملحوظ في الايرادات المخمنة يضاف الى ذلك الغاء رسوم الحراسة ايرادات الدولة تخميناً بـ ١٥٠,٠٠٠ دينار ، لرسوم التصدير . التي لم يعد لبقائها اي مبرر ، وتعديل وبذلك يكون مجموع الزيادة المخمنة في واما الابواب الاخرى للايراد ، قانون رسوم الطوابع بما يخفف وطأة ايرادات الفقرات المالية ٨٤١ر٠٦٤ر٨ وهي الباب الثالث والبابان الخامس هذه الرسوم على المعاملات ، وما سبق ديناراً . والسادس ، الخاصة بالايرادات المتنوعة ، اقراره من الغاء رسوم الاستهلاك على ولقد كان الحاصل من هذه التطورات وايرادات دوائر البريد والبرق المخضرات والتمور ، وتخفيض ضريبة الجوهرية - بمجموعها - ان هبطت والمصالح والدوائر الحكومية الاخرى ، الاملاك عن دور السكن ، وتعديل نسبة الايراد من الباب الاول ، المتضمن فقد ظلت تسميتها ثابتة نوعاً ما ، حيث قانون ضريبة الدخل بما يضمن التخفيف ايراد الضرائب والرسوم على المنتجات بلغ تخمين حصيلتها ٧,٣٥٠,٣٧٠ ديناراً عن ذوي الدخل المحدود . الزراعية والحيوانية من ( ٢٠,٤ بالمائة ) مقابل ٧,٢٦١,٣٦٠ دينار في السنة كما ان النية قد اتجهت ، على نحو ما من مجموع ايرادات السنة الماضية الى السابقة ، وبلغت نسبة هذه الحصيلة سبقت الاشارة اليه ، الى الاستقدام بنخبة ( ٨,٨ بالمائة ) في الميزانية الحاضرة ، الى مجموع الايرادات ( ٧,٤ بالمائة ) من الخبراء لدراسة نظام الضرائب من اذ انخفض تخمين هذا الايراد من مقابل ( ٦,٧ بالمائة ) خلال المدة جميع نواحيه ، وتعديل التشريعية ٠٠٠ر٩٣٥ر٨ دينار الى ٥١٥ر٤,١٠٥ ذاتها . الكمركية بما يحقق المبادىء الاقتصادية ديناراً . خلاصة الوضع المالي السليمة ويلاءم ظروف البلاد الخاصة . اما الباب الثاني المتضمن ضريبة الدخل وينتهي بنا ما تقدم بيانه من اسس ولا شك انكم قد لاحظتم ما تضمنته على شركات النفط فقد ارتفعت النسبة تنظيم هذه الميزانية ، ومبادىء توزيع التعديلات التي ادخلت على رسوم بين ايراده وبين مجموع الايرادات الى نفقاتها وايراداتها ، الى ذكر خلاصة الاستهلاك من تيسير على الصناعة ( ٤٣,٣ بالمائة ) ، مقابل ( ٤٠,٤ بالمائة ) الوضع المالي في اول السنة المالية البدوية والالية ذات العلاقة بالمنتجات في السنة الماضية ، حيث ارتفعت الحاضرة ، وتجلى هذا الوضع في آخرها . المحلية التي تناول التعديل رسومها حصيلته من ٠٠٠ر٧١٧ر١٧ دينار الى فقد بلغت الفضلة المدورة من كالصوف والجلود والاقطان ، ومن ١٧,٩٢٨,٨٨٠ دينار بين السنتين ، سنة ١٩٥٠ المالية الى سنة ١٩٥١ المالية تشجيع للمصادرات الفائضة عن الحاجة ٠٠٠ر٣٩٠ر٣ دينار ثم زادت تلك المحلية بالغاء رسم التصدير الكمركي على الفضلة فبلغ المدور منها الى سنة ١٩٥٢ التمور والشعير وبعض المحاصيل المالية ٧,٧٩٩,٠٠٠ دينار . ويؤمل الاخرى . ان تسفر الحسابات النهائية للسنة ويقابل ما تقدم ان الحكومة قد الاخيرة عن فضلة اخرى تخمنها حرصت على تجنيب تبديد ايراداتها ٠٠٠ر٣,١٢٤ دينار ، بحيث يصبح الحيوية دون مبرر ، فزادت نسب مجموع الوفر المتراكم في الخزينة في الرسوم على بعض المنتجات التي انفق اول سنة ١٩٥٣ المالية ٠٠٠ر٨١٣ر١٠ المستهلك منها عاليا من رسوم الاستهلاك، دينار . وذلك عند تصديرها ، مع التأكد من وعلى اساس هذا المبلغ الاخير ، ان مثل هذه الزيادة لن تضر بتجارة وتحقق تخمينات النفقة والايراد في التصدير . كما ان الحكومة قد فرضت الميزانية المعروضة على حضراتكم ، فان ضريبة جديدة على بعض المنتجات الوفر المدور في السنة الحاضرة الى الصناعية ، وزادت مكس البعض السنة القادمة سيبلغ تخميناً الاخر ، وهي كما بينته من كلف الظروف ٠٠٠ر٤٢٨ر٢٥ دينار . والنتائج الاقتصادية والمالية المترتبة وانه ليسرني ان اختم خطابي هذا على ذلك . بالشكر الجزيل لحضرات اعضاء تطوير الايرادات الرئيسية ونسبها اللجنة المالية المحترمين على ما بذلوه لقد استتبع تحقيق مبدأينا الاول من جهود صادقة في تدقيق هذه والثاني ، وهما تخفيف عبء الطبقات الميزانية وتقديمها الى مجلسكم الموقر ذات الدخل المحدود والتيسير على بالسرعة المطلوبة ، وما ابدوه من الانتاج القومي وتجارة التصدير ، ملاحظات وآراء قيمة كانت كلها نقصاً في ايراداتنا المخمنة قدره محل الاعتبار والتقدير .

رفع النائب الاستاذ عبد الغني دلي استقالته من مقررية اللجنة المالية بمجلس النواب الى معالي رئيس مجلس النواب ، وكان الاستاذ الدلي قد نظم تقرير اللجنة المالية حول الميزانية العامة الجديدة موصيا بفرض ضريبة على الدخل الزراعي ويقول الاستاذ الدلي في استقالته انه قدمها بناء على الضجة التي اثارها بدون مبرر بعض اعضاء لجنة الشؤون المالية حول ما ورد في التقرير بشأن الضريبة على الدخل الزراعي وان بعض الاعضاء الذين اثاروا هذه الضجة سبق لهم ان وافقوا دون اعتراض على عبارات مماثلة وردت في تقرير اللجنة المالية لسنة ١٩٥١ وفيما يلي نص الاستقالة :

للحسم الملات والمساعدات الممكنة لمن يخفق في منصب المقررية . ولا يفوتني بهذه المناسبة ان انوه بالمساعدات القيمة التي لقيتها من معالي رئيس لجنة الشؤون المالية ونائب رئيسها ومعظم اعضائها المحترمين . ولمعاليكم مزيد الشكر والاحترام .

معالي رئيس مجلس النواب المحترم . تحية واحتراما . بناء على الضجة التي اثارها بدون مبرر بعض اعضاء لجنة الشؤون المالية المحترمين حول بعض الفقرات الواردة في الصحيفة ( ٥ ) من التقرير الذي قمت بتنظيمه وبناء على ان الاعضاء الذين اثاروا هذه الضجة سبق لهم ان وافقوا من دون اعتراض على عبارات مماثلة وردت في تقرير لجنة الشؤون المالية لسنة ١٩٥١ في الصحيفة ( ٧ ) منه كما يتبين من مقارنة النصوص التالية : -

« الفقرات الواردة في الصحيفة (٧) من تقرير لجنة الشؤون المالية لسنة ٩٥١ » « ولقد ناقش الاعضاء المحترمون موضوع الضرائب ... اما بشأن رسوم الاستهلاك فيجب ابدالها بوضع الضريبة على الارض على اساس الدونم هذا اذا لم يشمل المزارعون وملاك الاراضي بضريبة الدخل اسوة بمواطنيهم الاخرين . وقد اجمعت اللجنة على ضرورة الاسراع في اعادة النظر في الضرائب بصورة عامة ووضع اسس علمية تؤمن المصلحة العامة وتحقق مبدأ العدالة في فرض الضرائب واسوة بما صنعته بريطانيا ومصر ... » « الفقرات الواردة في الصحيفة (٥) من تقرير لجنة الشؤون المالية لسنة ١٩٥٣ » « وقد اشاروا ( الاعضاء ) الى ان الايراد الزراعي لا يساهم بنصيبه العدل من الضرائب ووجهوا انتقاداتهم الى ضرائب الاستهلاك وكميتها من الضرائب غير المباشرة .. فيجب ان تعمل الحكومة على الغاء هذه الضريبة المالية وفرض ضرائب جديدة على الايراد الزراعي اما على اساس المساحة المزروعة او على اساس الدخل الزراعي المقدر او غير ذلك وطالبوا بان تضع الحكومة الاسس اللازمة لفرض مثل هذه الضريبة في الميزانية الحالية . » وقد كان من جملة الموقعين على تقرير لجنة الشؤون المالية في عام ١٩٥١ السادة عبد المحسن الجريان وعبد المنعم الرشيد وغيرهم . اما مقرر اللجنة فكان آنذاك السيد محمد جواد الخطيب . لهذه الاسباب ارى الواجب يدعوني الى رفع استقالتي من مقررية لجنة الشؤون المالية لنقدان الانسجام مع العلم انني مستعد لتقديم جميع

قصر اعمال المجلس العرفي العسكري على جرائم الشيوعية والصهيونية والبابين ١٢ و ١٣

اصدر سعادة قائد القوات العسكرية بمنطقة بغداد المعلنة فيها الاحكام العرفية البيان رقم ( ٢٤ ) التالي : الحاقا ببياننا المرقم ( ١٢ ) والمؤرخ في ( ٢٦ ) تشرين الثاني ٩٥٢ واستناداً الى المادة العاشرة من مرسوم الادارة العرفية رقم ١٨ لسنة ١٩٣٥ ، قررنا تحديد اعمال المجلس العرفي العسكري بأن تكون مقتصرة على النظر في الجرائم التالية : ١ - الجرائم المنصوص عليها في البابين الثاني عشر والثالث عشر من قانون العقوبات البغدادي ٢ - الجرائم المذكورة في ذيل قانون العقوبات رقم ٥١ لسنة ٩٣٨ وتعديله ، الخاصة بالشيوعية ( الفوضوية ) والاباحية والصهيونية .

قرر مجلس ادارة شركة الغزل والنسيج العراقية المحدودة منح اكرامية عن اجور يومية سبعة ايام لكافة عمال الشركة مع نصف راتب الى كافة الموظفين الذين يتقاضون راتب ثمانية عشر ديناراً فما دون . وذلك بمناسبة تتويج حضرة صاحب الجلالة الملك فيصل الثاني المعظم .

مجلس الاعمار يعلن غدا عن مناقصة لمشروع كبير تيمنا بانتقال السلطات الدستورية لجلالة الملك

تيمنا بانتقال السلطات الدستورية لحضرة صاحب الجلالة الملك فيصل الثاني المعظم قرر مجلس الاعمار الاعلان عن مناقصة مشروع خزان دوكان في ٢ مايس ١٩٥٣ ويتألف المشروع من سد مقوس سيتم بناؤه على الزاب الصغير في موقع قرب من قرية دوكان في لواء السليمانية طوله ٣٣٠ مترا وارتفاعه ١٠٠ وتقريبا وفيه خمس فتحات تستعمل لغرض توليد القوة الكهربائية في المستقبل اما سعة الخزان فتبلغ حوالي الستة مليارات من الامتار المكعبة من المياه ستستخدم لارواء مليوني مشارة من الاراضي الاميرية الصرفة الواقعة في مخمور والحويجة والعظيم والتي ستوزع على صغار المزارعين بموجب قانون اعمار واستثمار الاراضي الاميرية . كما يشمل المشروع انشاء نفق في الجانب الايمن لتحويل مجرى المياه اثناء العمل واستعماله كمسيل لاخذ مياه الفيضان بعد اتمام العمل وانشاء نفق مماثل على الجانب الايسر لضبط كمية خزن المياه وتصريفها .

احدث خارطة لبغداد تضعها « مصلحة » نقل الركاب العامة

يبذل سعادة الاستاذ ممتاز العمري مدير مصلحة نقل الركاب العام ورئيس مجلس ادارة المصلحة ، جهوداً ضخمة في تنظيم النقل والحركة في بغداد ، في وقت بلغت فيه كثافة التنقل بين اطراف العاصمة ذروتها ، وقد استطاع خلال اكثر من سنتين من توليه ادارة هذه المصلحة المهمة ان يخلق من عدد من السيارات الخربة « اسطولا » ضخماً من احدث سيارات الباص يتحرك بنظام دقيق وبادارة عظيمة الكفاءة ليضمن للناس حاجة اساسية من حاجات حياتهم اليومية ، وتمكنهم من الوصول الى مراكز اعمالهم في الوقت المناسب ويعيدهم الى بيوتهم من دون مشقة او انتظار ولعل الايام الحالية التي تمر بها بغداد هي من احفل وادق الفترات التي مرت بها هذه المصلحة بالنظر لكثرة الوفود والزوار الاجانب الذين جاءوا الى بغداد ليحضروا احتفالات التتويج . وبهذه المناسبة ولتيسير التنقل واعطاء فكرة واضحة عن شبكة طرق بغداد واتجاهاتها ، فقد اصدرت مديرية مصلحة نقل الركاب العامة خارطة تفصيلية انيقة ليستفيد منها الضيوف والزوار الاجانب في تنقلاتهم ، والخارطة في ذات الوقت ، توضح مدى التوسع الذي وصلت اليه خطوط المصلحة في الوقت الحاضر بحيث شملت جميع اطراف العاصمة وضواحيها .

اسعافات للطوارئ في مهرجانات التتويج

بمناسبة مهرجانات عيد تسلم حضرة صاحب الجلالة الملك فيصل الثاني المعظم سلطاته الدستورية فقد قررت وزارة الصحة تهيئة وسائل اسعاف تكون تحت الانذار للعمل للطوارىء خلال الايام الثلاثة التي تقام فيها المهرجانات . وسترا بط رئاسة الملك سيارات للاسعاف في ساحة الملك فيصل الثاني وفي ساحة الامين وساحة الفتح وساحة الباب الشرقي قرب تمثال فخامة المرحوم عبد المحسن السعدون . كما ستقوم أربع وحدات للاسعاف من المشاة بأعمالها على طول الطريق الممتدة من شارع الملك فيصل الاول حتى ساحة الفتح . هذا بالاضافة الى مراكز الاسعاف الثابتة في المستشفى الملكي التعليمي ومستشفى الكرخ التي ستكون على أهبة الاستعداد للعمل فوراً .

لندن ٣٠ منه – كتبت جريدة فاينانشل تايمس تقول ان مؤتمر جزر الهند الغربية في لندن قد اتخذ خطوة حاسمة الى الامام في سبيل تشكيل اتحاد بين الجزر البريطانية في بحر كاريبا . اما كم سيمضي من الوقت قبل ان تخرج هذه الوحدة الجديدة من الكومنونلث الى حيز الوجود فلم يتضح بعد على ان النتيجة ستتوقف اكثر مما تتوقف على تفاعل القوى السياسية الداخلية في كل من جزر الهند الغربية وقد انتهت الخبرة ان التحكيم استناداً الى ذلك التفاعل لا يركن اليه . ولكن يستدل من الوضع في الوقت الحالي على انه من الممكن حل المشاكل المعلقة حلا سريعاً عادلاً . واضافت الجريدة الى ما تقدم قولها ان السياسة الرامية الى الاتحاد تبدو من الناحية السياسية شرطاً لازماً في اي تقدم نحو اكتساب الجزر المتحدة درجة الدومنيون . وانه من المشكوك فيه ان تستطيع كل من الجزر المذكورة وحدها اكتساب الاستقلال الداخلي والاكتفا بمواردها لاغراض الدفاع العسكري عن النفس .

اقيمت قبل مدة دعوى في محكمة بداءة بغداد ، ادعت فيها المدعية بانها أعطت المدعى عليه مبلغاً من النقود كعربون لشراء داره ، وطلبت الحكم لها باعادة العربون . وفي المرافعة ، انكر المدعى عليه هذه الصفقة وقبضه العربون ، فابرزت المدعية ورقة عادية مختومة بابهام ادعت المدعية بانه أثر ابهام المدعى عليه ، وفي هذه الورقة اقرار بقبض العربون . فلما اجرى خبير الشرطة تدقيق طبعة الابهام تبين للخبير بان الطبعة ملونة ومطموسة ولا يمكن لذلك اجراء المضاهاة بالنسبة لها وتعيين صاحبها . فاعتبرت محكمة البداءة المدعية عاجزة عن الاثبات ، فطلبت المدعية تحليف المدعى عليه اليمين القانونية وحلف المدعى عليه هذه اليمين ينفي انشغال ذمته بالعربون . لكن المدعية لم تكتف بذلك ، فراجعت جهة التحقيق المختصة وادعت بان اليمين المؤداة كانت كاذبة ، فاتخذت جهة التحقيق الاجراءات الاصولية بهذا الخصوص وأحالت المدعى عليه الى محكمة الجزاء كمتهم بجريمة حلف يمين كاذبة . وفي محكمة الجزاء استندت المحكمة الى شهادة شخصين اثنين قدمتهما المدعية المشتكية ، فقررت المحكمة ادانة المدعى عليه بالتهمة وحكمت عليه بالحبس الشديد لمدة ثلاثة اشهر . وقد افاد الشاهدان بانهما كانا قد حضرا الصفقة وعاينا كيف اعطت المدعية مبلغ العربون الى المتهم واخذت بصمة ابهامه على الورقة المبرزة في محكمة البداءة . وأيدت المحكمة الكبرى لمنطقة بغداد حكم محكمة الجزاء . فلما نظرت القضية من قبل محكمة التمييز قررت الامتناع عن تصديق القرار واطلاق سراح المتهم من السجن إذ لم تقتنع محكمة التمييز بصحة الشهادة المسموعة ، وقالت بهيئتها المؤلفة برئاسة معالي الاستاذ حسن سامي التاتار وعضوية أصحاب السعادة الأساتذة حمدي صدر الدين وعبد العزيز ماجد وأحمد طه « ترى هذه المحكمة ان السند المستند اليه كان خالياً من توقيع الشاهدين المذكورين مما يوجب الريبة والشك في صحة شهادتهما . إذ لو كانا حاضرين حقيقة عند العقد وتنظيم السند وتوقيعه لوقعا فيه بصفتهما شاهدين بعد أن طلب اليهما الحضور لهذه الغاية . الأمر الذي يوجب عدم الاعتماد على صحة شهادتهما والأخذ بها كتوكيل مؤيد للشكوى » ويلاحظ أن هذا القرار التمييزي يقطع أيضاً في قضية خلافية اخرى . فقد اتجهت بعض المحاكم الى لزوم التقيد في القضايا الجزائية بالأدلة التي يوجبها القانون في القضايا الحقوقية . وهذا الاتجاه نص صريح في بعض القوانين الأجنبية كالقانون المصري الذي يفرض على المحكمة أن لا تخرج في تكوين قناعتها على نصاب الأدلة الذي يستلزمه القانون ، لو كانت المحكمة قد نظرت في القضية كمحكمة مدنية وليست كمحكمة جزاء . فكان ينبغي في منطق هذا الرأي عدم الاستماع الى البينة الشخصية في هذه القضية أصلا لأنها بينة غير مقبولة في محكمة البداءة . لأن القانون قد أوجب اثبات الحق باستعادة العربون بدليل كتابي . والواقع ان هذا الاجتهاد غير مصيب لأن قانوننا لم يقتض ذلك ، وبعكسه فقد اكتفى القانون بالشهادة الواحدة والقرينة لتقرير الادانة ، ولو كان القانون يطلب التقيد بأدلة لاثبات المدني لما كان ارتضى بأقل من شاهدين وفي قرار محكمة التمييز اقرار منها لعدم التقيد بنصاب المحكمة الحقوقية .

The two witnesses testified that they had attended the transaction and witnessed how the plaintiff gave the amount of the down payment to the accused and took his thumbprint on the paper presented in the Court of First Instance. And the Grand Court of the Baghdad region upheld the criminal court's ruling. When the case was reviewed by the Court of Cassation, it decided to refrain from ratifying the decision and to release the accused from prison as the Court of Cassation was not convinced of the validity of the heard testimony, and said in its panel composed under the chairmanship of His Excellency Mr. Hassan Sami al-Tatar and the membership of Their Excellencies Messrs.
