عرض حوالات خزينة الجمهورية العراقية بمبلغ عشرة ملايين دينار للبيع على الجمهور بموجب قانون اقتراض واصدار حوالات خزينة رقم (٦٣) لسنة ١٩٥٨

١ - استنادا الى احكام الفقرة ( ب ) من المادة الاولى من قانون اقتراض واصدار حوالات خزينة رقم (٦٣) لسنة ١٩٥٨ لقد تقرر ان تعرض على الجمهور للبيع حوالات خزينة الجمهورية العراقية يبلغ مجموعها -/١٠,٠٠٠,٠٠٠ دينار ( عشرة ملايين دينار لا غيرها ) وذلك لغاية الساعة الحادية عشرة قبل الظهر من يوم الخميس الموافق ٣٠/آب/١٩٧٣ وستصدر هذه الحوالات لامر المشتري وستستحق للاداء في ٢٩/ تشرين الثاني/١٩٧٣ وسيسدد البنك المركزي العراقي ببغداد في تاريخ الاداء كامل قيمتها الاسمية وفوائدها لقاء تسليم الحوالات .

٢ - تمنح فائدة بنسبة ٥.٥٪ ( خمسة ونصف بالمائة سنويا ) على حوالات الخزينة المعروضة للبيع وفق هذا البيان وتدفع الفائدة بتاريخ استحقاق الحوالات للاداء .

٣ - يمكن الحصول على الاستمارات الخاصة بالشراء ( للمصارف المجازة والمؤسسات وافراد الجمهور ) من دائرة الصيرفة في البنك المركزي العراقي ببغداد .

٤ - يجب ان تكمل استمارات الشراء بصورة صحيحة وتوقع من قبل المشتري حسب الاصول لاعتبارها مستوفية الشروط وتصحب بشيكات مسحوبة على مصرف مجاز في بغداد ( واذا كان المشتري مصرفا فيجب ان يسحب الشيك على حسابه لدى البنك المركزي العراقي في بغداد ) وذلك بمجموع مبالغ حوالات الخزينة المطلوب شراؤها او دفع المبالغ المذكورة نقدا على ان تسلم هذه الاستمارات الى دائرة الصيرفة - مديرية القروض والاستثمارات في البنك المركزي العراقي ببغداد في او قبل الساعة الحادية عشرة قبل الظهر من يوم الخميس الموافق ٣٠/آب/١٩٧٣ .

٥ - ستكون اوطأ فئة لحوالات الخزينة (-/١٠٠) دينار ولن يقبل أي عرض شراء يقل عن هذا المبلغ أو لم يعبر بمضاعفاته وسيكون للبنك المركزي العراقي الحق في قبول العرض كله أو جزء منه أو عدم قبول أي جزء منه كما وان فئة الحوالات المصدرة بشأن العروض المقبولة أو أي جزء منها ستقرر حسبما يتراءى للبنك المركزي العراقي .

٦ - سيرد البنك المركزي العراقي كل مبلغ زائد استلمه ونتج من العروض التي قبلها جزئيا أو لم يقبلها .

٧ - للبنك المركزي العراقي قطع او اعادة قطع حوالات الخزينة المصدرة بموجب هذا البيان وذلك بالسعر الذي يقرره وحسبما يرتأيه .

Iraqi Gazette Issue 2272 August 22, 1973 Statement No. (44) of 1973 Offering Treasury Bills of the Republic of Iraq amounting to ten million dinars for sale to the public under the Law on Borrowing and Issuance of Treasury Bills No. (63) of 1958 1 - Based on the provisions of paragraph (b) of Article 1 of the Law on Borrowing and Issuance of Treasury Bills No. (63) of 1958, it has been decided to offer for sale to the public Treasury Bills of the Republic of Iraq totaling 10,000,000/- dinars (ten million dinars and no other) until eleven o'clock in the forenoon on Thursday, August 30, 1973. These bills will be issued to the order of the buyer and will fall due for payment on November 29, 1973. The Central Bank of Iraq in Baghdad will pay their full nominal value and interest on the date of performance against the surrender of the bills. 2 - Interest shall be granted at a rate of 5.5% (five and a half percent per annum) on the Treasury Bills offered for sale according to this statement, and the interest shall be paid on the maturity date of the bills for payment. 3 - Purchase application forms (for licensed banks, institutions, and members of the public) can be obtained from the Banking Department at the Central Bank of Iraq in Baghdad. 4 - Purchase forms must be completed correctly and signed by the buyer in accordance with the rules to be considered fulfilling the conditions, and accompanied by checks drawn on a licensed bank in Baghdad (if the buyer is a bank, the check must be drawn on its account at the Central Bank of Iraq in Baghdad) for the total amounts of the Treasury Bills to be purchased, or the mentioned amounts must be paid in cash, provided that these forms are delivered to the Banking Department - Loans and Investments Directorate at the Central Bank of Iraq in Baghdad at or before eleven o'clock in the forenoon on Thursday, August 30, 1973. 5 - The lowest denomination for Treasury Bills will be (100/-) dinars, and no purchase offer less than this amount or not expressed in multiples thereof will be accepted. The Central Bank of Iraq shall have the right to accept the offer in whole or in part, or not to accept any part of it. The denomination of the bills issued regarding accepted offers or any part thereof will be decided as deemed appropriate by the Central Bank of Iraq. 6 - The Central Bank of Iraq will refund any excess amount received resulting from offers it accepted partially or did not accept. 7 - The Central Bank of Iraq may discount or rediscount Treasury Bills issued under this statement at the price it decides and as it deems appropriate. Al-Waqai' al-Iraqiya No. 2271 9 1973/8/21 Republican Decrees No. 716 Based on the provisions of paragraph (A) of Article Forty- two of the Interim Constitution. The Revolutionary Command Council decided at its session held on 16-8-1973 the following: - 1 - Promoting First Policeman Mahmoud Najm Jarjis to the rank of Fifth Commissioner as of 16-8-1973. 2 - The Minister of Interior shall implement this resolution. Ahmed Hassan al-Bakr Chairman of the Revolutionary Command Council No. 312 On 13-5-1973, the Permanent Military Court of the Ministry of Defense, in case number (73/1802), sentenced the conscripted soldier Wissam Abdel Sattar Abdel Jabbar affiliated to the Provisions Department to a fine of (two hundred and ninety Dinars) and in case of non-payment, rigorous imprisonment for a period of twenty-nine months according to Article (41) of the Military Service Law No. 65 of 1969 as amended, and this judgment became final by the decision of the Military Court of Cassation No. 73/1101 on 25-6-1973 after reducing the amount of the fine sentenced against him to (two hundred and sixty Dinars). No. 718 Based on the provisions of paragraph (A) of Article Forty- two of the Interim Constitution. The Revolutionary Command Council decided at its session held on 18-8-1973 the following: - 1 - Seizure of movable and immovable property belonging to Hasib Qader al-Bayati. 2 - The Ministers shall implement this resolution. Ahmed Hassan al-Bakr Chairman of the Revolutionary Command Council And based on the provisions of paragraph (J) of Article (58) of the Interim Constitution and based on what the Minister of Defense presented, and for the existence of reasons calling for leniency. We have decreed the following:- The conscripted soldier Wissam Abdel Sattar Abdel Jabbar affiliated to the Provisions Department is exempted from the penalty sentenced in case (73/1802) Permanent Military Court of the Ministry of Defense. قرار رقم ٧٠٣ باسم الشعب مجلس قيادة الثورة استنادا الى أحكام الفقرة ( آ ) من المادة الثانية والاربعين من الدستور المؤقت وبناء على موافقة رئيس الجمهورية على ما عرضه وزير العمل والشؤون الاجتماعية قرر مجلس قيادة الثورة في جلسته المنعقدة بتاريخ ١٢-٨-١٩٧٣ اصدار القانون الآتي :- رقم ( ٨٧ ) لسنة ١٩٧٣ قانون تعديل قانون العمل رقم ( ١٥١ ) لسنة ١٩٧٠ المادة الاولى - تحذف النسبة ( ٥٠٪ ) الواردة في الفقرة ( أ ) من المادة السابعة والاربعين بعد المائة من القانون وتحل محلها نسبة ( ١٠٠٪ ) . المادة الثانية - ينشر هذا القانون في الجريدة الرسمية ويتولى الوزراء تنفيذ احكامه .

الاسباب الموجبة بما ان الحاجة تقضي بايفاد العمال الى الخارج للتدريب واكتساب وتحسين الخبرة الفنية ، ولارتفاع مستوى المعيشة ونفقات الاقامة في الخارج ولتجنيب العمال الموفدين أية خسارة مادية قد تصيبهم نتيجة هذا الايفاد ، شرع هذا القانون .

الاسباب الموجبة

اعتادت ادارة انحصار التبغ اصدار نظام خاص في بداية كل سنة مالية تعين فيه مقدار العمولة التي تمنحها لتجار بيع التبغ بالجملة مع بيان شروط وكيفية منح اجازات البيع هذه وعددها ، وحيث لم تصدر خلال السنوات العشر الماضية أية تعديلات على هذا النظام واختصارا للروتين ، ولكون ادارة الانحصار هي المسئولة عن تنفيذ احكام قانون تأسيسها ، لذا فقد شرع هذا القانون .

باسم الشعب مجلس قيادة الثورة استنادا الى احكام الفقرة ( آ ) من المادة الثانية والاربعين من الدستور الموقت وبناء على موافقة رئيس الجمهورية على اقتراح وزارة شؤون الشمال . قرر مجلس قيادة الثورة في جلسته المنعقدة بتاريخ ١٨-٨-١٩٧٣ . اصدار القانون الآتي : -

رقم ( ٨٩ ) لسنة ١٩٧٣ قانون التعديل العاشر لقانون انحصار التبغ رقم ( ٥٤ ) لسنة ١٩٥٢

المادة الاولى ـ يلغى نص المادة الرابعة من قانون انحصار التبغ رقم (٥٤) لسنة ١٩٥٢ المعدل ويحل محله النص الآتي : ـ (( المادة الرابعة : تقوم ادارة انحصار التبغ ببيع التبغ بالسعر المعين وفق هذا القانون لاشخاص القطاع الخاص المجازين ببيع التبغ بالمفرد لقاء عمولة تعين مقدارها

وكيفية دفعها وشروطها وعدد الاجازات التي يجوز اصدارها بموجب نظام يصدر لهذا الغرض )) . المادة الثانية ـ ينشر هذا القانون في الجريدة الرسمية ويتولى الوزراء تنفيذه .

To issue the following law: - No. (89) of the year 1973 Law Tenth Amendment to the Tobacco Monopoly Law No. (54) of the year 1952 Article One - The text of Article Four of the Law of Tobacco Monopoly No. (54) of the year 1952, as amended, is repealed and replaced by the following text: (( Article Four: The Tobacco Monopoly Administration shall sell tobacco at the price designated according to this law to licensed private sector persons for retail tobacco sale in exchange for a commission, the amount, method of payment, conditions, and number of licenses of which may be issued under a regulation issued for this purpose )). The Revolutionary Command Council decided in its meeting held on 14-8-1973 the following:- 1 - The Land and Seizure Committees formed under the Agrarian Reform Law No. (117) of 1970 shall undertake the establishment of rights in agricultural lands and orchards located within the boundaries of the Baghdad Municipality or municipalities excluded from settlement or which have not been settled under the provisions of the Land Rights Settlement Law No. (29 of 1938, repealed), and the provisions of the Agrarian Reform Law and the instructions issued thereunder shall apply to them. 2 - The committees mentioned in paragraph (1) of this resolution are specialized in deciding the loss of agricultural status of lands excluded from settlement or which have not been settled located within the boundaries of the Baghdad Municipality or municipalities if their previous records indicate that they were agricultural lands or orchards and had been converted before the enforcement of the Agrarian Reform Law No. (117) of 1970 into real estate lands. 3 - The provisions of paragraphs (1 and 4) of Article 27 of the Agrarian Reform Law shall apply to the decisions issued according to paragraph (2). The cases of establishing rights in the lands related to them, after the decision acquires finality, shall be transferred to the Real Estate Registration departments, and the provisions of the Real Estate Registration Law No. (43) of 1971 and the instructions issued thereunder shall apply to them. 4 - The Supreme Agricultural Council shall issue the necessary instructions to facilitate the implementation of the provisions of this resolution. 5 - This resolution shall be implemented from the date of its publication in the Official Gazette, and its provisions shall apply to cases whose registration has not acquired final form according to the provisions of the Real Estate Registration Law. Ahmed Hassan al-Bakr President of the Republic Instructions No. (71) of 1973 Amendment to Instructions No. 9 of 1970 Based on the provisions of Article Twelve of the Supreme Agricultural Council Law No. (116) of 1970, the Supreme Agricultural Council has issued the following instructions as an amendment to Instructions No. (9) of 1970: Article One - Paragraph (a) of Article One of Instructions No. 9 of 1970 is deleted and replaced by the following: a - A council shall be formed in each governorate under the name of the Agricultural Council, linked to the Supreme Agricultural Council, chaired by the Governor or his deputy, with the membership of each of the Head of the Agricultural Region, the Director of Agricultural Cooperation, the Irrigation Engineer, the Director of Agricultural Services, the Head of the Mechanical Unit, the Director of the Veterinary Hospital, and the Head of the Union of Farmers' Associations in the governorate. The Council may include in its membership no more than three persons with technical expertise, and it may second experts from officials, members of organizations, and private citizens to seek their opinion whenever the need arises. رقم ٧١٥ استنادا الى احكام الفقرة ( آ ) من المادة الثانية والاربعين من الدستور الموقت . قرر مجلس قيادة الثورة بجلسته المنعقدة بتاريخ ١٢-٨-١٩٧٣ مايلي :- اولا - يحصر الاقراض العقاري لكافة منتسبي الدوائر الرسمية وشبه الرسمية والمؤسسات العامة وشركات القطاع العام بالمصرف العقاري وتنصرف كلمة ( الموظف ) اينما وردت في هذا القرار الى الموظف والمستخدم والعامل . ثانيا - على الدوائر والمؤسسات التي لها مشاريع اسكان خاصة بمنتسبيها أو التي تقوم باقراضهم لغرض بناء مساكن لهم تحويل كافة المبالغ المخصصة لهذا الغرض سنويا الى المصرف العقاري ليتولى ادارة هذه المشاريع وتنفيذها حسب الشروط والقواعد التي يضعها مجلس ادارة المصرف العقاري . وتعتبر المبالغ المذكورة قروضا بذمة المصرف العقاري بفائدة يتفق عليها . ثالثا - يمنح القرض العقاري للموظف الذي لا تقل مدة خدمته عن خمس سنوات بما لا يتجاوز خمسين راتبا اسميا . على ان لا يزيد مبلغ القرض على الفين وخمسمائة دينار ولا يقل عن الف دينار ويسدد خلال مدة اقصاها عشرون سنة وبالفائدة التي يقررها مجلس ادارة المصرف العقاري . رابعا - يسدد القرض بطريقة الاستقطاع الشهري من الراتب وبالاسلوب الذي يقرره مجلس ادارة المصرف العقاري وعلى دوائر المقترضين الالتزام بالتنفيذ . خامسا - يجوز للموظف الذي سبق له الاقتراض من المصرف العقاري أو أي مشروع اسكاني آخر الاقتراض مرة اخرى وفق قواعد الاقراض اذا اقتنع مجلس الادارة ان ظروف الموظف تستوجب ذلك .

سادسا - يحصر الاقراض غير العقاري للموظفين بالمصارف التجارية وتحول كافة المبالغ المخصصة لهذا الغرض لدى الدوائر الرسمية وشبه الرسمية والمؤسسات العامة وشركات القطاع العام الى المصارف التجارية وتجرى تسوية الفوائد بين المصارف التجارية وتلك الجهات في نهاية كل سنة مالية . أما الفوائد الخاصة بسلف الزواج وسلف المعالجة الطبية فتتحملها وزارة المالية . سابعا - لا يجوز للموظف ان يقترض أو يشترى من أو بواسطة المصرف العقاري أو المصارف التجارية أو أية جهة حكومية اخرى أو من الجمعيات التعاونية أو شركات القطاع العام مبالغ أو مواد ترتب بذمته ديونا بحيث تؤدى بمجموعها الى تجاوز الاستقطاع الشهري عنها على نسبة ( ٥٠٪ ) من راتبه الاسمي ومخصصات غلاء المعيشة عدا ما يتعلق بالنفقة الشرعية والمهر المؤجل ودين الخزينة . ثامنا - تطبق احكام المادة ( ٢٤٥ ) من قانون العقوبات على الموظف الذي يدلي بمعلومات كاذبة بغية الحصول على القرض خلافا لاحكام هذا القرار وكذلك على الموظف الذي يقوم بتمشية معاملة مثل هذا الموظف مع علمه بعدم صحة المعلومات الواردة فيها . تاسعا - لمجلس ادارة المصرف العقاري ومجالس ادارة المصارف التجارية كل فيما يتعلق به اصدار التعليمات اللازمة لتسهيل تنفيذ احكام هذا القــــــــــــــــرار . عاشرا - لا يعمل بأي نص قانوني يتعارض مع احكام هذا القرار بالنسبة لاغراضه . حادي عشر - ينشر هذا القرار في الجريدة الرسمية وتسرى احكامه على معاملات الاقراض التي تجرى بعد نفاذه مع مراعاة الاحكام الواردة في الفقرة ( سابعا ) اعلاه . ولمجلس ادارة المصرف العقاري شمول المعاملات التي نظمها في أو بعد ١-٤-١٩٧٣ بالحد الاعلى للاقراض بعد دراسة كل حالة بصورة منفردة .

8 Al-Waqai' al-Iraqiya Issue No. 2271 1973/8/21 No. 715 Based on the provisions of Paragraph (a) of Article Forty-Two of the Interim Constitution. The Revolutionary Command Council decided in its session held on 1973-8-12 as follows:- First - Real estate lending for all personnel of official and semi-official departments, public institutions, and public sector companies shall be restricted to the Real Estate Bank, and the word (employee) wherever it appears in this resolution shall apply to officials, employees, and workers. Second - Departments and institutions that have housing projects for their personnel or that provide them with loans for the purpose of building homes for them shall transfer all sums allocated for this purpose annually to the Real Estate Bank to undertake the management of these projects and their implementation according to the terms and rules set by the Board of Directors of the Real Estate Bank. The aforementioned sums shall be considered loans owed by the Real Estate Bank at an agreed interest rate. Third - A real estate loan is granted to an employee whose period of service is not less than five years, not exceeding fifty nominal salaries. Provided that the loan amount shall not exceed two thousand five hundred dinars and not less than one thousand dinars, and it shall be repaid within a maximum period of twenty years and at the interest rate decided by the Board of Directors of the Real Estate Bank. Fourth - The loan shall be repaid by means of monthly deduction from the salary and in the manner decided by the Board of Directors of the Real Estate Bank, and the borrowers' departments must adhere to implementation. Fifth - An employee who has previously borrowed from the Real Estate Bank or any other housing project may borrow again according to lending rules if the Board of Directors is convinced that the employee's circumstances require it. Sixth - Non-real estate lending for employees shall be restricted to commercial banks, and all sums allocated for this purpose in official and semi-official departments, public institutions, and public sector companies shall be transferred to commercial banks, and interest settlements shall be made between commercial banks and those entities at the end of each fiscal year. As for the interest on marriage loans and medical treatment loans, they shall be borne by the Ministry of Finance. Seventh - An employee may not borrow or purchase from or through the Real Estate Bank, commercial banks, or any other government entity, or from cooperative societies or public sector companies, amounts or materials that incur debts against him such that their total monthly deduction exceeds (50%) of his nominal salary and cost of living allowances, except for what pertains to legal alimony, deferred dowry, and Treasury debt. Eighth - The provisions of Article (245) of the Penal Code shall apply to the employee who provides false information for the purpose of obtaining a loan in violation of the provisions of this resolution, as well as to the employee who processes the transaction of such an employee knowing the falsity of the information contained therein. Ninth - The Board of Directors of the Real Estate Bank and the Boards of Directors of commercial banks, each in its respective field, may issue the necessary instructions to facilitate the implementation of the provisions of this Resolution. Tenth - No legal text that contradicts the provisions of this resolution shall be applied regarding its purposes. Eleventh - This resolution shall be published in the Official Gazette and its provisions shall apply to lending transactions that take place after its effective date, taking into account the provisions contained in paragraph (Seventh) above. The Board of Directors of the Real Estate Bank may include transactions organized on or after 1973-4-1 within the maximum lending limit after studying each case individually. Al-Waqai' al-Iraqiya Issue No. 2271 7 1973/8/21 No. 707 Based on the provisions of paragraph (a) of Article 42 of the Interim Constitution and based on the judgment issued by the Special Court on 7-7-1973 in case No. (2) which included sentencing the criminal Ali Ridha Bawa to imprisonment for a period of two years in accordance with Article (247) of the Penal Code. The Revolutionary Command Council decided in its session held on 15-8-1973 the following:- 1 - Dismissal of Ali Ridha Bawa, Director General in the Revolutionary Command Council / Office of the Vice President, from service for a period of five years starting from the date the judgment was issued on 7-7-1973. 3 - The competent ministers shall implement this decision. Ahmed Hassan al-Bakr Chairman of the Revolutionary Command Council No. 708 Based on the provisions of paragraph (a) of Article 42 of the Interim Constitution. The Revolutionary Command Council decided in its session held on 15-8-1973 the following:- 1 - Authorizing the Minister of Communications the power to grant engineers and technicians working in telecommunications and postal services, whose nature of work requires working after official working hours, additional allowances without being restricted by the upper limit stipulated in paragraph (b - 1) of Article 51 of the Civil Service Law No. (24) of 1960. Provided that this is limited to cases of extreme necessity. And that the total of allowances and wages in all cases does not exceed (100%) of the salary or the prescribed wage instead of the salary. 3 - The Ministers of Communications and Finance shall implement this decision. Ahmed Hassan al-Bakr Chairman of the Revolutionary Command Council No. 710 Based on the provisions of paragraph (a) of Article 42 of the Interim Constitution. The Revolutionary Command Council decided in its session held on 15-8-1973 the following:- 1 - Transferring Khairi Othman al-Rawi, Director General of the Land Transport Company, to the Revolutionary Command Council - Office of Popular Organizations, with his same current salary. 2 - The competent ministers shall implement this decision. Ahmed Hassan al-Bakr Chairman of the Revolutionary Command Council No. 712 Based on the provisions of paragraph (a) of Article 42 of the Interim Constitution. The Revolutionary Command Council decided in its session held on 16-8-1973 the following:- 1 - Adding the period from 1965/9/30 to 1966/4/2 to the services of the deceased worker Faraj Hormuz Hamama (formerly a worker in the Irrigation Factory and Warehouse area) for the purpose of his family's entitlement to a pension in accordance with the provisions of Law No. (140) of 1964. 2 - The Ministers of Irrigation and Labor and Social Affairs shall implement this decision. The Revolutionary Command Council decided in its session held on 16-8-1973 the following:- 1 - Allocating a pension for the family of the deceased worker Mawloud Hassan Rasoul on the basis of the weekly contributions recorded to his account, as an exception to the provisions of Article (36) of Law No. (140) of 1964. 2 - The Minister of Labor and Social Affairs shall implement this decision. The Revolutionary Command Council decided in its session held on 16-8-1973 the following:- 1 - The allowances of members of the boards of directors and committees in the departments and institutions affiliated with the Ministry of Finance and members of the Pensioners' Cases Audit Council are excluded from the Revolutionary Command Council Decision No. (536) on 25-7-1972. 2 - This decision shall be effective from the date of its issuance and the Minister of Finance shall implement its provisions.
