رابعا - اما الارض الخالية من البناء فقد وافقت وسمحت بان ينشأ عليها مدرسة وان يكون السيد سليم داود اسحق توفيق متوليا عليها بالشروط الاتية :- أ - ان تنشأ المدرسة المذكورة من التبرعات او اي مورد آخر برأى المتولي السيد سليم المذكور وان يكون البناء بالمساحة والمقدار والهندسة والشكل التي يرتأيها برأيه المطلق . ب - ان تستعمل المدرسة لغرض التدريس وتلقي العلوم الدينية من قبل اولاد - الطائفة الاسرائيلية في العراق بالطريقة والاصول التي يراها المتولي موافقة على تراعى في ذلك القوانين الموضوعة من قبل الحكومة العراقية . ج - ان يكون من جملة الدروس التي تلقى في المدرسة المذكورة درس التورات - ست ساعات في الاسبوع على الاقل . د - ان تسمى المدرسة باسم مدرسة مير ابراهيم طويق وعلى ان لا يتغير هذا الاسم على مرور السنين والاجيال . هـ - يجوز قبول العدد الذي يقرره المتولي وبالنسبة التي يعينها من اولاد الفقراء مجانا واما الاجور المدرسية التي تستحصل من الذين يتمكنون من دفعها وكذلك التبرعات ان وجدت فتصرف اولا على تعمير البناء وترميمه وثانيا تسديد رواتب المدرسين والخدم واذا حصلت فضلة فيجوز ارصادها الى الكنيس المذكور المسمى باسم زوجها بغية تسديد المصاريف التي تقتضيها ادارته واذا زادت الواردات في الكنيس فترصد لتسديد مصاريف المدرسة . و - للمتولي ان يستعين بلجنة يعينها هو لاجل القيام بشئون ادارة المدرسة تحت رئاسته وله الحق بتبديلهم من وقت لاخر او الغاء اللجنة بتاتا وله ايضا ان يعطي ادارة المدرسة الى الطائفة الاسرائيلية في بغداد او الى اي هيئة من الطائفة سواء كانت موجودة او يطلب تشكيلها للغرض المذكور على ان تبقى التولية بيده مطلقا وله الحق بتبديل هيئة ادارة المدرسة اذا وجدت ضرورة لذلك . ز - وان تكون التولية الى السيد سليم المومى اليه مدة حياته ومن بعده الى اولاده الذكور او الاناث واولاد اولاده بطنا بعد بطن على ان يراعى فيها الاكبر سنا وارشدهم ثم الى اي شخص من ذريته وعند انقطاعهم فتنتقل التولية الى رئيس المجلس الجسماني للطائفة الاسرائيلية في بغداد . وعلى هذه الصورة طلبت اصدار حجة بالوقف كما وانها ايدت مندرجات الطلب ثم افاد المتوليان السيد داود اسحق توفيق والسيد سليم داود اسحق توفيق وذلك بعد تعريفهما من قبل شهود التعريف بانهما قبلا التولية على الكنيس المذكور وعلى المدرسة التي تنشأ على الارض المذكورة وتعهدا بشرط الواقفة تماما وطلبا اصدار حجة بالوقف المذكور . ثم ان الواقفة طلبت الرجوع عن الوقف المذكور وطلبت عدم اصدار حجة بذلك فافادا كل من المتوليان الحاضرين في المجلس بان لا حق للواقفة بالرجوع عن الوقف

Continued - 2 Fourth - As for the land vacant of construction, I have agreed and permitted that a school be established on it and that Mr. Selim Daoud Isaac Tawfiq be the trustee over it under the following conditions:- A - That the aforementioned school be established from donations or any other source in the opinion of the trustee, Mr. Selim mentioned above, and that the construction be of the area, amount, engineering, and form that he deems appropriate in his absolute opinion. B - That the school be used for the purpose of teaching and receiving religious sciences by the children of the Israelite community in Iraq in the manner and principles that the trustee deems appropriate, provided that the laws established by the Iraqi government are observed in this regard. C - That among the lessons taught in the aforementioned school shall be the study of the Torah - at least six hours per week. D - That the school be named Meir Ibrahim Tweig School, and this name shall not be changed over the passage of years and generations. E - It is permissible to accept the number decided by the trustee and in the proportion he designates of the children of the poor for free, and as for the school fees obtained from those who are able to pay them, as well as donations, if any, they shall be spent first on the renovation and maintenance of the building and second on paying the salaries of teachers and servants, and if there is a surplus, it may be allocated to the aforementioned synagogue named after her husband for the purpose of paying the expenses required for its management, and if the revenues increase in the synagogue, they shall be allocated to cover the school's expenses. F - The trustee may seek the assistance of a committee appointed by him to carry out the affairs of the school's management under his chairmanship, and he has the right to replace them from time to time or abolish the committee entirely, and he also has the right to give the management of the school to the Israelite community in Baghdad or to any body from the community whether existing or requested to be formed for the aforementioned purpose, provided that the trusteeship remains in his hand absolutely, and he has the right to change the school management body if he finds it necessary. G - The trusteeship shall be to the aforementioned Mr. Selim for his lifetime, and after him to his children, males or females, and his children's children, generation after generation, provided that the eldest and most rational among them is considered, then to any person from his lineage, and upon their cessation, the trusteeship shall pass to the President of the Lay Council of the Israelite Community in Baghdad. بما ان المفتى به ان الواقفة بعد ان وقفت وسلمت الموقوف الى المتوليين مستجمعا الشروط المطلوبة في صحة الوقف فليس لها حق الرجوع عن الوقف وبما انه قد ثبت من اعتراف الواقفة انها اوقفت الملك قطعة ( ٣ ) المرقمات تسلسل ٧ / ٩ و ٨ / ٩ و ٩ / ٩ الواقعات في محلة البتاويين مع البناء عليها كنيس ( مصلى ) او الذي سينشأ عليه مدرسة لتدريس العلوم الدينية اولاد الطائفة الاسرائيلية في العراق ونصبت السيد داود اسحق توفيق متوليا على الكنيس والسيد سليم اسحق توفيق متوليا على المدرسة الدينية وسلمت الموقوف اليهما على الشروط المحررة اعلاه وان يكون الشخصان المذكوران متوليان على الوقف المذكور وعليه فقد تم الوقف ولزم وحكم به على الشروط المبينة اعلاه فاصبح وقفا صحيحا شرعيا وحرر ما هو الواقع - ٢٠ / ٥ / ١٩٤٣ .

اني الموقع ادناه سليم بن داود اسحق توفيق اصرح ان الكنيس المشيدة على القطعتين تسلسل ٨/٩ و ٩/٩ بتاوين والموحدة برقم تسلسل ٨/٩ بتاوين والمسجلة في دائرة الطابو ببغداد بالعدد ١٦ وتاريخ كانون الاول سنة ١٩٤٤ جلد ٤٦٦ وكذلك المدرسة المشيدة على القطعة تسلسل ٧/٩ بتاوين المسجلة بدائرة طابو بغداد بعدد ١٧ وتاريخ كانون الاول سنة ١٩٤٤ جلد ٤٦٦ هما وقف من اوقاف مير ابراهيم طويق الخيري والموقوفة بموجب الحجة الوقفية الصادرة من محكمة المواد الشخصية ببغداد بتاريخ ٣٠ / ٥ / ١٩٤٣ وعدد ٥٦ / ٤٣ ش اما التولية على الكنيس كانت الى والدي المرحوم داود اسحق توفيق المتوفى بتاريخ ١٦ / ٧ / ١٩٥٨ ثم آلت لي بعد وفاته واما التولية على المدرسة المذكورة فهي لي اصلا بموجب الحجة المذكورة وحيث اني عاجز عن القيام بالتولية المذكورة ولا يوجد من ذريتي من يستطيع توليتها فاني قد تنازلت عن تولية الوقفين المذكورين الى المجلس الاداري لادارة الاموال العامة لليهود العراقيين المجلس المتشكل بموجب تعليمات وزارة العدل المنشورة في الجريدة الرسمية بعدد ٤١٠٤ وتاريخ ٢٥ شباط سنة ١٩٥٨ ومن بعده الى اي لجنة او جهة ⟦وكلت⟧ اخرى قد تتشكل رسميا لادارة الاموال العامة لليهود العراقيين ولاجل تنفيذ ما تقدم فقد عني وانبت منابي السيدين المحامي صيون شوع جيجي ومنشي يوسف كوهين مجتمعا ومنفردا لمراجعة المحاكم اواية جهة رسمية اخرى مختصة لانجاز تنازلي المذكورة وللغاية المذكورة لكل من وكيليّ ان يقوم مقامي في اية دعوى او قضية او معاملة رسمية مهما كان نوعها وباية صفة كانت وان يستعمل جميع الصلاحيات والحقوق والمراجعات القانونية من عادية وفوق العادة وتعقيبها حتى لحوق القرار النهائي فيها وتنفيذها في الدوائر المختصة ولكل منهما حق الاخذ والقبض والصلح والابراء والاسقاط وتوكيل غيره في جميع هذه الصلاحيات او ببعضها وعزله مرة بعد اخرى ان التفصيلات المذكورة اعلاه لا تحدد من صلاحية وكيليّ باية وجهة وانما لكل منهما بشأن ما تقدم ان يقم مقامي بكل ما استطيع قانونا ان افعل شخصيا بصورة عامة ومطلقة ومفوضة واشعارا بما تقدم وقعت ادناه تحريرا ببغداد في كانون الاول سنة ١٩٦٣

General Power of Attorney I, the undersigned Salim bin Daoud Ishaq Tawfiq, declare that the synagogue built on plots sequence 8/9 and 9/9 Bataween, and unified under sequence number 8/9 Bataween, registered in the Land Registry Office in Baghdad under number 16 and dated December 1944, volume 466, as well as the school built on plot sequence 7/9 Bataween, registered in the Land Registry Office of Baghdad under number 17 and dated December 1944, volume 466, are endowments (waqf) of the endowments of Meir Ibrahim Twayq Charitable Trust, endowed under the Waqf deed issued by the Court of Personal Matters in Baghdad on 30/5/1943, number 56/43 Sh. As for the guardianship (tawliya) of the synagogue, it belonged to my late father Daoud Ishaq Tawfiq, who died on 16/7/1958, and then it passed to me after his death. As for the guardianship of the mentioned school, it was mine originally under the mentioned deed. Since I am unable to carry out the mentioned guardianship and there is no one among my descendants who can handle it, I have waived the guardianship of the two mentioned endowments to the Administrative Council for the Administration of Public Funds of Iraqi Jews, the council formed under the Ministry of Justice instructions published in the Official Gazette under number 4104 dated February 25, 1958, and after it to any committee or ⟦I appointed⟧ other body that may be officially formed to manage the public funds of Iraqi Jews. To implement the above, I have appointed as my representatives and deputies the lawyers Mr. Sion Shua Giji and Munshi Yousef Cohen, jointly and severally, to approach the courts or any other competent official body to complete my mentioned waiver. For the mentioned purpose, each of my agents may act in my stead in any lawsuit, case, or official transaction of any kind and in any capacity, and to exercise all legal powers, rights, and appeals, ordinary and extraordinary, and to follow them up until a final decision is reached and implemented in the competent departments. Each of them has the right of taking, receiving, reconciliation, acquittal, dropping claims, and appointing others in all or some of these powers, and dismissing them time after time. The details mentioned above do not limit the authority of my two agents in any way, but rather each of them regarding the above may act in my stead in everything I can legally do personally in a general, absolute, and delegated manner. 43/56 Sh The Noble Sharia Council convened on 20 / 5 / 43 by the Judge Mr. Mahmoud Izzat and issued the following decision:- The Endower - Khatun Yusuf Masri Based on the verified excuse, I attended the house of Khatun daughter of Yusuf Masri located in the neighborhood of Al-Bataween at four o'clock in the afternoon, accompanied by the clerk Muhammad Said and the process server Abbas, in order to take the confession of Khatun daughter of Yusuf Masri regarding the endowment of plot - (2) numbered sequence 7/9, 8/9, and 9/9. Accordingly, Khatun Yusuf Masri attended the council and after her identification by the identification witnesses, who are the lawyer Salman Shina, Harun Ibrahim Ovadia, and Hamid son of Kadhim, the Mukhtar of Al-Bataween neighborhood, the aforementioned Khatun stated, while in full possession of her mental faculties and maturity, that she owns the plot of land numbered 2, numbered sequence 7/9, 8/9, and 9/9 located in Al-Bataween neighborhood on part of which a two-story building is constructed to be used as a synagogue, i.e., Torah, by worshippers from the Israelite community. As for the other part of the land, it remains vacant without construction. She has endowed the mentioned land along with the buildings established on it as a perpetual and eternal endowment according to the following conditions:- First - That the mentioned synagogue be named after her deceased husband, Meir Ibrahim Tweig, provided that this name shall not be changed. Second - That the mentioned synagogue be used by Israelite worshippers in the manner and method followed in Iraq. Third - That Mr. Daoud Ishaq Tawfiq, of Iraqi nationality and residing in Baghdad, shall be the trustee over the mentioned synagogue for the duration of his life, and he has the absolute right to supervise the synagogue from both administrative and religious aspects, and he is authorized to form a committee to carry out administrative tasks under his chairmanship or supervision. He has the right to replace committee members from time to time according to his opinion or to dissolve the committee and the administration remains without any person or any official in the community having the right to interfere in the affairs of the synagogue, and the following principles shall be observed:- A - All revenues obtained from donations of worshippers and others, including subscriptions and others paid in any form whatsoever. B - Appointing employees and servants with the salary he assigns, dismissing them, and appointing others. C - Spending necessary expenses for construction, renovation, purchasing furniture, and others. D - That the mentioned Mr. Daoud shall be the trustee for his life, and after him, the trusteeship shall pass to his mentioned children, then to his grandchildren and his grandchildren's grandchildren, generation after generation, provided that the trusteeship is assigned to the eldest and most mature among them, and then to any male of his descendants. General Power of Attorney I, the undersigned, Salim bin Dawood Ishaq Tawfiq, declare that the synagogue built on the two plots sequence 8/9 and 9/9 Batawin, unified under sequence number 8/9 Batawin and registered in the Land Registry Department in Baghdad under No. 16 and dated December 1944, Volume 466, as well as the school built on plot sequence 7/9 and registered in the Land Registry Department in Baghdad under No. 17 and dated December 1944, Volume 466, and currently occupied by the Directorate of Travel and Nationality in Baghdad, are both endowments of the Meir Ibrahim Twig Charitable Endowment, endowed according to the endowment deed issued by the Court of Personal Status in Baghdad on 20 / 5 / 1943, number 56 / 43 Sh. In my capacity as the trustee of the mentioned endowment, I have appointed as my attorney and representative by this Mr. ⟦...⟧ son of ⟦...⟧ in his capacity as the President of the Administrative Council for the Administration of Public Property for Iraqi Jews. ج - ان يكون من جملة الدروس التي تلقى في المدرسة المذكورة درس التورات - ست ساعات في الاسبوع على الاقل .

هـ - يجوز قبول العدد الذي يقرره المتولي وبالنسبة التي يعينها من اولاد الفقراء مجانا واما الاجور المدرسية التي تستحصل من الذين يتمكنون من دفعها وكذلك التبرعات ان وجدت فتصرف اولا على تعمير البناء وترميمه وثانيا تسديد رواتب المدرسين والخدم واذا حصلت فضلة فيجوز ارصادها الى الكنيس المذكور المسمى باسم زوجها بغية تسديد المصاريف التي تقتضيها ادارته واذا زادت الواردات في الكنيس فترصد لتسديد مصاريف المدرسة .
و - للمتولي ان يستعين بلجنة يعينها هو لاجل القيام بشئون ادارة المدرسة تحت رئاسته وله الحق بتبديلهم من وقت لآخر او الغاء اللجنة بتاتا وله ايضا ان يعطي ادارة المدرسة الى الطائفة الاسرائيلية في بغداد او الى اى هيئة من الطائفة سواء كانت موجودة او يطلب تشكيلها للغرض المذكور على ان تبقى التولية بيده مطلقا وله الحق بتبديل هيئة ادارة المدرسة اذا وجدت ضرورة لذلك .
ز - وان تكون التولية الى السيد سليم المومى اليه مدة حياته ومن بعده الى اولاده الذكور او الاناث واولاد اولاده بطنا بعد بطن على ان يراعي فيها الاكبر سنا وارشدهم ثم الى اى شخص من ذريته وعند انقطاعهم فتنتقل التولية الى رئيس المجلس الجسماني للطائفة الاسرائيلية في بغداد .
وعلى هذه الصورة طلبت اصدار حجة بالوقف كما وانها ايدت مندرجات الطلب ثم افاد المتوليان السيد داود اسحق توفيق والسيد سليم داود اسحق توفيق وذلك بعد تعريفهما من قبل شهود التعريف بانهما قبلا التولية على الكنيس المذكور وعلى المدرسة التي تنشاء على الارض المذكورة وتعهدا بشرط الواقفة تماما وطلبا اصدار حجة بالوقف المذكور . ثم ان الواقفة طلبت الرجوع عن الوقف المذكور وطلبت عدم اصدار حجة بذلك فافادا كل من المتوليان الحاضرين في المجلس بان لا حق للواقفة بالرجوع عن الوقف

Continued - 2 Fourth - As for the vacant land, I have agreed and permitted that a school be established on it and that Mr. Selim Daoud Isaac Tawfiq be the trustee over it according to the following conditions: A - That the aforementioned school be built from donations or any other resource according to the opinion of the trustee, Mr. Selim, and that the construction be of the area, amount, engineering, and shape that he deems appropriate in his absolute opinion. B - That the school be used for the purpose of teaching and receiving religious knowledge by the children of the Jewish community in Iraq in the manner and principles that the trustee deems appropriate, while observing the laws established by the Iraqi government. C - That among the lessons taught in the aforementioned school shall be the study of the Torah for at least six hours a week. D - That the school be named Meir Ibrahim Tuwayq School, and this name shall not change over the passage of years and generations. E - It is permissible to accept the number decided by the trustee, and in the proportion he determines, of poor children free of charge. As for the school fees collected from those who are able to pay, as well as donations, if any, they shall be spent first on repairing and restoring the building, and second on paying the salaries of teachers and servants. If there is a surplus, it may be allocated to the aforementioned synagogue named after her husband for the purpose of paying the expenses required for its management. If the revenues in the synagogue increase, they shall be allocated to cover the school's expenses. F - The trustee may seek the assistance of a committee appointed by him to carry out the school's administrative affairs under his chairmanship, and he has the right to replace them from time to time or to abolish the committee altogether. He also has the right to give the management of the school to the Jewish community in Baghdad or to any body from the community, whether existing or requested to be formed for the stated purpose, provided that the trusteeship remains in his hands absolutely, and he has the right to replace the school's management body if he finds it necessary. G - The trusteeship shall be held by the aforementioned Mr. Selim during his lifetime, and after him by his children, males or females, and their grandchildren generation after generation, provided that the eldest and most capable among them be considered, then to any person from his descendants. If they cease to exist, the trusteeship shall pass to the President of the Lay Council of the Jewish community in Baghdad. In this manner, she requested the issuance of an endowment deed (Hujja), and she confirmed the contents of the request. رابعا - اما الارض الخالية من البناء فقد وافقت وسمحت بان ينشاء عليها مدرسة وان يكون السيد سليم داود اسحق توفيق متوليا عليها بالشروط الاتية :-
آ - ان تنشاء المدرسة المذكورة من التبرعات او اى مورد آخر برأى المتولي السيد سليم المذكور وان يكون البناء بالمساحة والمقدار والهندسة والشكل التي يرتأيها برأيه المطلق .
ب - ان تستعمل المدرسة لغرض التدريس وتلقي العلم الدينية من قبل اولاد - الطائفة الاسرائيلية في العراق بالطريقة والاصول التي يراها المتولي موافقة على تراعى في ذلك القوانين الموضوعة من قبل الحكومة العراقية .
ج - ان يكون من جملة الدروس التي تلقى في المدرسة المذكورة درس التورات - ست ساعات في الاسبوع على الاقل .
د - ان تسمى المدرسة باسم مدرسة مير ابراهيم طويق وعلى ان لا يتغير هذا الاسم على مرور السنين والاجيال .
هـ - يجوز قبول العدد الذي يقرره المتولي وبالنسبة التي يعينها من اولاد الفقراء مجانا واما الاجور المدرسية التي تستحصل من الذين يتمكنون من دفعها وكذلك التبرعات ان وجدت فتصرف اولا على تعمير البناء وترميمه وثانيا تسديد رواتب المدرسين والخدم واذا حصلت فضلة فيجوز ارصادها الى الكنيس المذكور المسمى باسم زوجها بغية تسديد المصاريف التي تقتضيها ادارته واذا زادت الواردات في الكنيس فترصد لتسديد مصاريف المدرسة .
و - للمتولي ان يستعين بلجنة يعينها هو لاجل القيام بشئون ادارة المدرسة تحت رئاسته وله الحق بتبديلهم من وقت لآخر او الغاء اللجنة بتاتا وله ايضا ان يعطي ادارة المدرسة الى الطائفة الاسرائيلية في بغداد او الى اى هيئة من الطائفة سواء كانت موجودة او يطلب تشكيلها للغرض المذكور على ان تبقى التولية بيده مطلقا وله الحق بتبديل هيئة ادارة المدرسة اذا وجدت ضرورة لذلك .
ز - وان تكون التولية الى السيد سليم المومى اليه مدة حياته ومن بعده الى اولاده الذكور والاناث واولاد اولاده بطنا بعد بطن على ان يراعى فيها الاكبر سنا وارشدهم ثم الى اى شخص من ذريته وعند انقطاعهم فتنتقل التولية الى رئيس المجلس الجسماني للطائفة الاسرائيلية في بغداد .
وعلى هذه الصورة طلبت اصدار حجة بالوقف كما وانها ايدت مندرجات الطلب ثم افاد المتوليان السيد داود اسحق توفيق والسيد سليم داود اسحق توفيق وذلك بعد تعريفهما من قبل شهود التعريف بانهما قبلا التولية على الكنيس المذكور وعلى المدرسة التي تنشاء على الارض المذكورة وتعهدا بشرط الواقفة تماما وطلبا اصدار حجة بالوقف المذكور . ثم ان الواقفة طلبت الرجوع عن الوقف المذكور وطلبت عدم اصدار حجة بذلك فافادا كل من المتوليان الحاضرين في المجلس بان لا حق للواقفة بالرجوع عن الوقف

Continued - 2 Fourth - As for the land vacant of building, she has agreed and permitted that a school be established on it and that Mr. Salim Daoud Isaac Tawfiq be the trustee (Mutawalli) over it according to the following conditions: A - The aforementioned school shall be built from donations or any other source according to the opinion of the trustee, Mr. Salim aforementioned, and the building shall be of the area, size, engineering, and shape that he deems appropriate in his absolute discretion. B - The school shall be used for the purpose of teaching and receiving religious knowledge by the children of the Israelite community in Iraq in the manner and principles that the trustee deems appropriate, provided that the laws established by the Iraqi government are observed in that regard. C - Among the subjects taught in the aforementioned school shall be the study of the Torah - at least six hours per week. D - The school shall be named Meir Ibrahim Twayq School, and this name shall not be changed over the years and generations. E - It is permissible to accept the number decided by the trustee and in the proportion he designates of the children of the poor free of charge. As for the school fees obtained from those who are able to pay them, as well as donations, if any, they shall be spent first on the construction and renovation of the building, and second on paying the salaries of teachers and servants. If there is a surplus, it may be allocated to the aforementioned synagogue named after her husband for the purpose of paying the expenses required for its management. If the income increases in the synagogue, it shall be allocated to pay the school's expenses. F - The trustee may seek the assistance of a committee appointed by him to manage the school's affairs under his chairmanship, and he has the right to replace them from time to time or abolish the committee altogether. He also has the right to give the management of the school to the Israelite community in Baghdad or to any body from the community, whether existing or requested to be formed for the stated purpose, provided that the trusteeship remains in his hands absolutely, and he has the right to replace the school's management body if he finds it necessary. G - The trusteeship shall be held by the aforementioned Mr. Salim during his lifetime, and after him by his children, males and females, and the children of his children, generation after generation, provided that the eldest and most competent of them is observed, then to any person from his descendants. Upon their cessation, the trusteeship shall pass to the President of the Lay Council of the Israelite community in Baghdad. In this manner, she requested the issuance of an endowment deed (Hujjat Waqf), as she confirmed the contents of the request. Then the two trustees, Mr. Daoud Isaac Tawfiq and Mr. Salim Daoud Isaac Tawfiq, testified after their identification by the identification witnesses that they accepted the trusteeship over the aforementioned synagogue and the school to be established on the aforementioned land and pledged to fulfill the conditions of the endower completely and requested the issuance of a deed for the aforementioned endowment. As for the trusteeship over the shares, it belonged to my father, the late Daoud Ishaq Tawfiq, who passed away on 16/7/1958, and then it passed to me after his death. As for the trusteeship over the mentioned shares, it belongs to me originally according to the mentioned deed. Since I am unable to carry out the mentioned trusteeship and there is no one among my descendants who can take it over, I have waived the ⟦illegible⟧ trusteeship of the two mentioned endowments to the Administrative Council for the Administration of General Funds for Iraqi Jews, which was dissolved according to the instructions of the Ministry of Justice published in the Official Gazette under number 4104 dated 25/10/1958 and thereafter to any other committee that may be officially formed to manage the general funds of Iraqi Jews. General Power of Attorney ⟦line⟧ I, the undersigned, Salim bin Daoud Isaac Tawfiq, declare that the synagogue built on plots sequence 8/9 and 9/9 Bataween and unified under sequence number 8/9 Bataween and registered in the Baghdad Land Registry Office under No. 16 dated December 1944, Volume 466 as well as the school built on plot sequence 7/9 Bataween registered in the Land Registry Office of Baghdad under No. 17 dated December 1944, Volume 466, both are an endowment of the endowments of Meir Ibrahim Tawfiq Al-Khayri, endowed according to the endowment deed issued by the Personal Status Court in Baghdad on 5/20/1943, No. 56/43 Sh. As for the ⟦private⟧ guardianship over the synagogue, it belonged to my late father, Daoud Isaac Tawfiq, who passed away on 7/16/1958, then it devolved to me after his death. As for the guardianship over the mentioned school, it is mine originally according to the mentioned deed. And since I am unable to carry out the mentioned guardianship and there is no one among my descendants who can undertake its guardianship, I have waived the guardianship of the two mentioned endowments to the Administrative Council for the Administration of General Funds for Iraqi Jews, the Council formed according to the Ministry of Justice instructions published in the Official Gazette under No. 4104 dated February 25, 1958, and after it to any committee or entity that may be officially formed to manage the general funds of Iraqi Jews. To implement the foregoing, I ⟦appointed as attorney⟧ on my behalf and delegated my place to the lawyers Mr. Zion Shohet Gigi and Munshi Yusuf Cohen, jointly and severally, to approach the courts or any other specialized official authority to complete my mentioned waiver. ⟦For the mentioned purpose⟧, each of my "attorneys" shall stand in my place in any lawsuit, case, or official transaction of whatever type and in whatever capacity, and to use all powers, rights, and legal reviews, whether ordinary or extraordinary, and to pursue them until the final decision is reached and implemented in the specialized departments. Each of them has the right to receive, collect, reconcile, discharge, waive, and appoint others in all or some of these powers, and to dismiss them repeatedly. The details mentioned above do not limit the authority of my "attorneys" in any way, but rather each of them regarding the above shall stand in my place for everything I can legally do personally in a general, absolute, and delegated manner. الواقفة - خاتون يوسف مصرى
بناء على المعذرة المتحققة فقد حضرت لدار خاتون بنت يوسف مصرى الكائن في محلة البتاويين وذلك في الساعة الرابعة زوالية بعد الظهر مستصحبا الكاتب محمد سعيد والمباشر عباس وذلك لاخذ اعتراف خاتون بنت يوسف مصرى بشأن ايقاف قطعة - ( ٣ ) المرقمات تسلسل ٧ / ٩ و ٨ / ٩ و ٩ / ٩ وعليه فقد حضرت المجلس خاتون يوسف مصرى وبعد تعريفها من قبل شهود التعريف وهم المحامي سلمان شنينه وهارون ابراهيم عوبديا وحميد بن كاظم مختار محلة البتاويين افادت المزبورة خاتون وهي بكمال عقلها ورشدها بانها تملك قطعة الارض المرقمة ٣ المرقمة تسلسل ٧ / ٩ و ٨ / ٩ و ٩ / ٩ الواقعة في محلة البتاويين والمشيد على قسم منها بناء ذات طابقين لاستعماله بصفة كنيس اى تورات من قبل المصلين من الطائفة الاسرائيلية واما القسم الاخر من الارض فلم يزل خاليا بدون بناء وانها اوقفت الارض المذكورة مع الابنية المنشأة عليها وقفا ابديا مخلدا على الشروط الاتية :-
اولا - ان يسمى الكنيس المذكور باسم زوجها المتوفي ميرا براهيم طويق على ان لا يتغير هذا الاسم .
ثانيا - ان يستعمل الكنيس المذكور من قبل المصلين من الاسرائيليين بالكيفية والطريقة المتبعة في العراق .
ثالثا - ان يكون السيد داود اسحق توفيق العراقي الجنسية والمقيم في بغداد متوليا على الكنيس المذكور مدى حياته وله الحق المطلق بالاشراف على الكنيس من الوجهتين الادارية والدينية كما وانه مخول بتشكيل لجنة تقوم بالاعمال الادارية تحت رئاسته او اشرافه وله ان يستبدل اعضاء اللجنة من وقت لآخر حسب رأيه او يلغي اللجنة وتبقى الادارة بدون ان يكون لاى شخص او اى موظف في الطائفة الحق بالمداخلة في امور الكنيس وان يراعي الاصول الاتية :-
آ - جميع الواردات التي تحصل من تبرعات المصلين وغيرهم بما في ذلك الاشتراكات وغير التي تدفع باى صورة كانت . ب - تعيين الموظفين والخدم بالراتب التي ينسبها وعزلهم وتعيين غيرهم . ج - صرف المصاريف الضرورية للتعمير والترميم وشراء الاثاث وغيرها . د - ان يكون السيد داود المذكور متوليا مدى حياته ومن بعده تنتقل التولية الى اولاده الذكور ثم الى احفاده واحفاد احفاده بطنا بعد بطن على ان ترصد التولية الى اكبرهم سنا وارشدهم وثم الى اى ذكر من ذريته وعند انقطاعهم فتعطى التولية الى رئيس المجلس الروحاني للطائفة الاسرائيلية .

43 / 56 Sh The Noble Sharia Council convened on 20 / 5 / 43 under the Judge Mr. Mahmoud Izzat and issued the following decision :- The Endower - Khatoun Yusuf Masri Based on the verified excuse, I attended the house of Khatoun daughter of Yusuf Masri located in the neighborhood of Al-Bataween at four o'clock in the afternoon, accompanied by the clerk Muhammad Saeed and the bailiff Abbas, to take the confession of Khatoun daughter of Yusuf Masri regarding the endowment of a plot - ( 3 ) numbered sequences 7 / 9, 8 / 9, and 9 / 9. Accordingly, Khatoun Yusuf Masri attended the session and after her identification by the identification witnesses, who are the lawyer Salman Shanina, Harun Ibrahim Ovadia, and Hamid son of Kadhim, the Mukhtar of Al-Bataween neighborhood, the aforementioned Khatoun stated, while in her full mental capacity and maturity, that she owns the plot of land numbered 3, sequence numbers 7 / 9, 8 / 9, and 9 / 9 located in Al-Bataween neighborhood on part of which a two-story building is constructed to be used as a synagogue, i.e., Torah, by worshippers of the Israelite community, while the other part of the land remains vacant without construction. And she has endowed the mentioned land with the buildings established upon it as a perpetual, eternal endowment under the following conditions :- First - That the mentioned synagogue be named after her deceased husband Meir Ibrahim Tweig, provided that this name shall not be changed. Second - That the mentioned synagogue be used by the Israelite worshippers in the manner and method followed in Iraq. Third - That Mr. Dawood Ishaq Tawfiq, of Iraqi nationality and residing in Baghdad, shall be the trustee over the mentioned synagogue for his lifetime, and he has the absolute right to supervise the synagogue from both the administrative and religious aspects, as he is also authorized to form a committee to carry out administrative tasks under his presidency or supervision, and he may replace committee members from time to time according to his opinion or dissolve the committee and the administration shall remain without any person or any official in the community having the right to interfere in the affairs of the synagogue, and that the following principles be observed :- A - All revenues obtained from donations of worshippers and others, including subscriptions and others that are paid in any form whatsoever. B - Appointing employees and servants at the salary he designates, dismissing them, and appointing others. C - Spending the necessary expenses for construction, renovation, purchasing furniture, and others. D - That the mentioned Mr. Dawood shall be the trustee for his lifetime, and after him, the trusteeship passes to his male children, then to his grandchildren and great-grandchildren, generation after generation, provided that the trusteeship is assigned to the eldest and most mature among them, and then to any male of his descendants, and upon their cessation, the trusteeship shall be given to the head of the Spiritual Council of the Israelite community.
