بعد التحية كتابكم المرقم ٨٩٠ والمؤرخ في ٩ / ٢ / ١٩٥٢ . ١ - ان الوقفية المرفقة طي كتابنا المرقم ٢٢٩٨ والمؤرخ في ٣٠ / ١ / ١٩٥٢ والمثبتة لعائدية الدار المرقمة ٢٨ / ١٢٠ الى رئاسة هذه الطائفة بصفتها المتولية على شؤون الوقفية ، غير مسجلة في دائرة الطابو . ٢ - يلزم الوقف بمجرد صدور حكم بذلك من قبل محكمة المواد الشخصية اكتسبت الدرجة القطعية ولا ينتقص من لزوم الوقف عدم تسجيل الوقفية في دائرة الطابو . وبناء عليه لانرى محلا للسؤال الوارد في كتابكم المشار اليه اعلاه مادام حجة الوقفية صريحة لكون الملك المذكور يعود لرئاسة هذه الطائفة ، لذا نؤكد كتابنا السابق راجين تسليم الدار الى رئاسة هذه الطائفة . هذا وتفضلوا بقبول فائق الاحترام .

B02 · paragraph / arabic بناء على حصول المعذرة المشروعة لقد ارسل من قبل هذه المحكمة نائبا عنها الكاتب الاول عبد الجبار افندي لاستماع تقرير الام الواقفة راحيل بنت اليشاع على ايقاف دارها المرقم ١٢٠/٢٨ الواقعة في محلة الست هدية فذهب الكاتب المومى اليه وعقد هناك مجلسا شرعيا حضرت فيه الامرأة المسماة راحيل بنت اليشاع يامين شيخ ساسون بعد تعريف ذاتها من قبل مختار المحلة والشاهدين شمعون روبين وساسون حاحام حسقيل قررت قائلة اني راحيل بنت اليشاع يامين شيخ ساسون لطوعي واختياري وبكمال عقلي ورشدي اقر واعترف باني قد اوقفت ما هو ملكي وتحت تصرفي تمام الدار العائدة لي الواقعة في محلة الست هدية المرقمة ١٢٠/٢٨ وقد اخرجتها من ملكيتي وجعلتها وقفا صحيحا لازما لوجه الله تعالى بخصوصها وعمومها بجميع مشتملاتها لا تباع ولا تشترى ولا تجرى عليها اي معاملة على ان تكون التولية على الشرائط الاتية :- اولا - جعل الدار المذكورة وقفا وحبس غلتها وصرفها اولا على التعمير والترميم المقتضى لها والفضلة من الغلة تصرف على المرضى من الفقراء الاسرائيليين اللذينهم في مستشفى مير الياس وعند عدم وجود هؤلاء الفقراء في المستشفى المذكور تصرف على الفقراء الاسرائيليين الموجودين في مستشفيات الملة الاسرائيلية في بغداد وعند عدم وجود هؤلاء الفقراء في المستشفيات الاسرائيلية تنفق على الفقراء المرضى من الملة الاسرائيلية اينما كانوا في بغداد . ثانيا - ان جعلت المتولي هو رئيس الطائفة الاسرائيلية في بغداد وان يكون الناظر على الوقف المذكور هو اخي الخواجه صالح اليشاع يامين شيخ ساسون وبعد وفاته تنتقل النظارة الى الارشد من اولاده الذكور واولاد اولاده الذكور دون الاناث . ثالثا - ان تكون غلة الدار الموقوفة بيدى ما دمت في قيد الحياة وبعد وفاتي تصرف غلة سنة واحدة فقط على روحي في وجه الخيرات والمبرات بمعرفة المتولي والناظر الانفي الذكر . رابعا - على الناظر ان يلاحظ بنفسه ما يقتضى من المصاريف لاجل التعمير والترميم المقتضى اجراءه لهذه الدار الموقوفة وان تصرف بقية الغلة كما مر ذكره آنفا على الوجوه المذكورة وطلبت الزامها باعترافها هذا واصدار حجة بالوقف وطلبه وتسجيله وقفا بدائرة الطابو حسب الشرائط المذكورة . فعليه بعد ان استمت افادة الواقفة واخذ تقريرها بمعرفة نائب المحكمة الكاتب الاول المومى اليه الينا صورة الضبط وبعد السؤال من دائرة الطابو بالكتاب المؤرخ ٢٢ حزيران ٩٣٢ والمرقم ٢١٦٦ عن بيان اسماء المالكين للدار الموقفة وورود الجواب من الدائرة المذكورة بالكتاب المؤرخ ٢٧ حزيران ١٩٣٢ والمرقم ٣٧٠٣ بان الدار الموقوفة هي ملك الى الواقفة راحيل بنت اليشاع وانها غير مرهونة ولا محجوزة ولا لاحد فيها علاقة فقد حكمت بصحة هذا الوقف بخصوصه وعمومه بجميع مشتملاته لا يباع ولا يشترى ولا تجرى عليه اي معاملة على ان يكون المتولي على هذه الدار الموقوفة هو رئيس الطائفة الاسرائيلية في بغداد وبعد وفاته تنتقل التولية الى من يخلفه في هذا المنصب وهكذا متسلسلا وعلى ان يكون الناظر على المتولي المتولي المذكور هو الخواجه صالح اليشاع يامين شيخ ساسون اخو الواقفة المذكورة وبعد وفاته تنتقل النظارة الى الارشد من اولاده الذكور واولاد اولاده الذكور دون الاناث وعلى ان تصرف غلة هذا الوقف حسب الشرائط المدرجة في <del>حجة الوقف الوقفية وعليه كتب</del>

File Number 33/91 Sequence Number 104 Based on the occurrence of a legitimate excuse, this court has sent as its deputy the First Clerk Abdul Jabbar Effendi to hear the report of the endowing mother, Rachel daughter of Elisha, regarding the endowment of her house numbered 120/28 located in the Sit Hadiya neighborhood. The aforementioned clerk went and held a Sharia council there, attended by the woman named Rachel daughter of Elisha Yamin Sheikh Sassoon, after her identity was verified by the neighborhood mukhtar and the two witnesses, Shimon Reuben and Sassoon Haham Hesqel. She stated, saying: I, Rachel daughter of Elisha Yamin Sheikh Sassoon, by my own will and choice, and in full possession of my mental faculties and maturity, acknowledge and confess that I have endowed what is my property and under my disposal, the entire house belonging to me located in the Sit Hadiya neighborhood, numbered 120/28, and I have removed it from my ownership and made it a valid and binding endowment for the sake of God Almighty, in its specific and general parts with all its contents, not to be sold nor bought, nor shall any transaction be conducted upon it, provided that the trusteeship be according to the following conditions:- First - Making the mentioned house an endowment, sequestering its revenue, and spending it first on the necessary construction and restoration for it, and the surplus of the revenue shall be spent on the sick among the poor Israelites who are in the Meir Elias Hospital. In the absence of these poor people in the mentioned hospital, it shall be spent on the poor Israelites present in the hospitals of the Israelite community in Baghdad. In the absence of these poor people in the Israelite hospitals, it shall be spent on the sick poor of the Israelite community wherever they may be in Baghdad. Second - I have appointed the trustee to be the head of the Israelite community in Baghdad, and the supervisor of the mentioned endowment shall be my brother, Khawaja Saleh Elisha Yamin Sheikh Sassoon, and after his death, the supervision shall pass to the eldest of his male children and his male grandchildren, excluding the females. Third - The revenue of the endowed house shall be in my hands as long as I am alive, and after my death, the revenue of one year only shall be spent on my soul for charitable and benevolent purposes, with the knowledge of the aforementioned trustee and supervisor. Fourth - The supervisor must personally oversee the necessary expenses for the construction and restoration required for this endowed house, and the remainder of the revenue shall be spent as previously mentioned on the stated aspects. She requested to be bound by this confession of hers and the issuance of an endowment deed, and its request and registration as an endowment in the Land Registry Department according to the mentioned conditions. Accordingly, after the statement of the endower was heard and her report was taken by the deputy of the court, the First Clerk, the aforementioned [clerk] brought us the record image. After inquiring from the Land Registry Department by the letter dated 22 June 932 and numbered 2166 regarding the names of the owners of the endowed house, and the arrival of the reply from the mentioned department by the letter dated 27 June 1932 and numbered 3703, stating that the endowed house is the property of the endower Rachel daughter of Elisha, and that it is not mortgaged, nor seized, nor does anyone else have a claim to it, I have ruled on the validity of this endowment in its specific and general parts with all its contents, not to be sold nor bought, nor shall any transaction be conducted upon it, provided that the trustee of this endowed house be the head of the Israelite community in Baghdad, and after his death, the trusteeship shall pass to whoever succeeds him in this position, and so on in succession, and provided that the supervisor over the mentioned trustee be Khawaja Saleh Elisha Yamin Sheikh Sassoon, the brother of the mentioned endower, and after his death, the supervision shall pass to the eldest of his male children and his male grandchildren, excluding the females, and that the revenue of this endowment be spent according to the conditions listed in <del>the endowment deed, and accordingly it was written</del>

B02 · paragraph / arabic لما استلمت من السيد سليم جميع الاملاك التي بحوزته ابتدأت بتفقدها الواحدة بعد الاخرى بعد ذلك اخذت خبراً بان الدار المرقمة ٢٨ الواقعة في محلة تحت التكية هي ملك صرف قد اوقفته راحيل بنت الياع يامي شيخ سلون بموجب الوقفية الصادرة في محكمة مواد الشخصية في محكمة بداءة بغداد ورقمه ٩١ / ٢٢ عدد تسلسل ٤٤ ومؤرخ ١٠ تموز ١٩٢٢ تنطق بوقفية هذه الدار على مرضى فقراء الاسرائيليين اينما كانوا والمتولي يكون رئيس الطائفة هذه في صورة الوقفية ثم ذهبت الى الدار نفسها البلده وسألت ساكنها من انت مؤجر قال لي منذ ٤ سنوات اجرت هذا الدار وما اسمك قال اسمي عريف لازم اجرته من الامانة العامة للاموال المجمدة بخمسة دنانير شهرياً والان قد استملكته ضريبة الدخل لكي تبلع دائرتها واستفسرت عن جوارين هذه الدار هل التقدير كان لعشرة دور المجاورة للضريبة بقيمة جيدة ام لا . قالوا نعم واشاروا الى دار صغيرة جداً واقعة جيران دار الطائفة وقالوا هذه الدار قد قدروها بمبلغ ١٧٠٠ دينار اما دارنا فيبلغ ضعف الدار المجاورة فنرجو من سعادتكم احالة هذه القضية الى المحامي ١- لقبض بدل الايجارات لهذه الاربع السنوات الماضية من الامانة العامة ٢- الاعتراض على التقدير ان كان غير ملائم ٣- قبض الثمن وتسليمه الى رئاسة الطائفة المحترم

After that, I received information that the house numbered 28 located in the neighborhood of Taht al-Takiya is a pure property that was endowed by Rachel daughter of Eliyahu Yami Sheikh Slon according to the endowment deed issued in the Personal Status Court at the Baghdad Court of First Instance, number 91 / 22, serial number 44, dated July 10, 1922, stating the endowment of this house for the poor sick Jews wherever they may be, and the trustee shall be the head of this community in the form of the endowment. Then I went to the house itself in the town and asked its resident, from whom are you renting? He said to me, "I have rented this house for 4 years." And what is your name? He said, "My name is Arif Lazim. I rented it from the General Custodian of Frozen Assets for five dinars per month, and now the Income Tax Department has expropriated it to expand its office." I inquired about the neighbors of this house, whether the appraisal for the ten neighboring houses for the tax was at a good value or not. They said yes, and pointed to a very small house located next to the Community's house and said, "This house was appraised at an amount of 1700 dinars, while our house is double the size of the neighboring house." So we request your Excellency to refer this case to the lawyer: 1- To collect the rent payments for these past four years from the General Custodian. 2- To object to the appraisal if it is inappropriate. 3- To collect the price and hand it over to the respected Head of the Community.
