B03 · paragraph / arabic ثانياً - الغابيلة هي عبارة عن رسم قدره خمسة عشر فلساً على الكيلو الواحد من اللحم الكاشير والبيض والكلاوى وشحمها والعبار (القوزى) الذى يظهر في جوف امه والمصارين وفقاً للتعامل الجارى على ان يكون العبار خارجاً عن نطاق رسم الغابيلة اذا لم يسمح بذبح النعاج الحاملات لدى اية سلطة حكومية ويستوفى هذا الرسم من ذبيحات المجزرة الخاصة بالطائفة الاسرائيليه في بغداد والاعظمية والكرادة التي تعرض للبيع على الاسرائيليين .

B04 · paragraph / arabic ثالثاً - ان المصارين تؤخذ عيناً من اغنام وماعز وبقر الكاشير والطاريف التي تذبح في مجزرة الطائفة المذكورة في مركز لواء بغداد على ان يستلمها الملتزم مطروحة في المجزرة حيث يكون مكلفاً بمؤونة جمعها ونقلها من دون سبق اى اعتراض منه فيما اذا ظهرت مقطعة او صغيرة او سوداء .

B05 · paragraph / arabic رابعاً - يجب دفع تامينات نقديه بمعدل عشرة بالمائه ١٠ ٪ الى صندوق المجلس الجسماني لحساب بدل الالتزام على ان يحسب منه ذلك للشهرين الاخيرين من مدة الالتزام وان يستوفي الباقي من البدل بعشرين قسطاً يربط كل قسط من الاقساط المذكوره بسند يحرر لامر المجلس الجسماني ويستحق السند الخاص بالقسط الاول في ١٥ نيسان ١٩ وهكذا تتعاقب استحقاقات السندات المربوطة بالاقساط المتعاقبة في كل خمسة عشر يوماً متواليا بحيث ينتهى القسط الاخير في ٣٠ كانون الثاني ١٩ .

B06 · paragraph / arabic خامساً - يؤخذ من الملتزم كفالة معتبرة تتضمن تنفيذ حكم مقاولة الالتزام واداء بدل السندات عند حلول آجالها على التسلسل وعند عدم القيام بذلك تبلغ التأمينات النقدية الى نسبة عشرين بالمائه ٢٠ ٪ بدلا من الكفالة المار ذكرها .

B07 · paragraph / arabic سادساً - ان حلول اجل كل سند من الكمبيالات المذكورة يتضمن وجوب الاداء حالاً وفوراً وعند الامتناع عن الاداء حسبما مر فللمجلس وحده حق الخيار بفسخ الالتزام من دون حاجة الى سبق انذار وباعطائه الى الغير بالبدل الذى يراه مناسباً لحساب الملتزم الاصلي مع حق المراجعة لهذا الاخير لتضمين نقصان البدل والفائض النظامي اعتباراً من لحوق صلاحية الفسخ .

The Lay Council of the Jewish Community in Baghdad List of Auction Conditions for the Ghabila and Intestines Contract In the statement of the auction list for the Ghabila and intestines for a full year starting from April 1, 19 to the end of March 19 concerning sheep and goats slaughtered in the Jewish slaughterhouse in Baghdad according to the following conditions: First - The Lay Council in Baghdad has the right to grant the contract for the Ghabila and intestines together, or the Ghabila alone, or the intestines alone, whether by number or in bulk. Second - The Ghabila is a fee of fifteen fils per kilogram of Kosher meat, eggs, kidneys and their fat, and the fetus (Al-Quzi) found inside its mother, and the intestines according to current practice, provided that the fetus is excluded from the Ghabila fee if the slaughter of pregnant ewes is not permitted by any government authority. This fee is collected from the slaughters of the Jewish community's slaughterhouse in Baghdad, Adhamiya, and Karrada which are offered for sale to Jews. Third - The intestines are taken in kind from Kosher and Taref sheep, goats, and cows slaughtered in the community's slaughterhouse mentioned in the center of the Baghdad Governorate, provided that the contractor receives them at the slaughterhouse where he is responsible for the cost of collecting and transporting them without any prior objection from him if they appear cut, small, or black. Fourth - Cash security must be paid at a rate of ten percent 10% to the Lay Council's fund for the account of the contract value, provided that this is calculated for the last two months of the contract period, and the remainder of the value is collected in twenty installments. Each of the mentioned installments is linked to a note issued to the order of the Lay Council. The note for the first installment is due on April 15, 19, and so on, the maturities of the notes linked to successive installments follow every fifteen consecutive days, so that the last installment ends on January 30, 19. Fifth - A reliable guarantee is taken from the contractor ensuring the execution of the contract terms and the payment of the notes when their due dates arrive in sequence. In case of failure to do so, the cash security is increased to twenty percent 20% instead of the aforementioned guarantee. Sixth - The arrival of the due date for each of the mentioned promissory notes implies the necessity of immediate and instant payment. In case of refusal to pay as mentioned, the Council alone has the right to choose to terminate the contract without the need for prior notice and to grant it to others for the value it deems appropriate for the account of the original contractor, with the right to claim against the latter for the deficiency in value and the legal interest starting from the date the right of termination becomes valid.

سابعاً - ان اعتصاب القصابين وامتناعهم عن ذبح الغنم لاى سبب كان واحتكارهم الغنم بقصد تقليل ما يعرض للبيع من اللحم وتزييد سعره كل ذلك يؤدى بالملتزم وحده الى وجوب احضار عدد كاف من الاغنام للذبح لسد ما تحتاجه الطائفة الاسرائيلية في بغداد من اللحم الكاشير بمعدل ٤٨٠٠ كيلو في كل يوم و ٥٢٠٠ كيلو لكل يوم جمعة عدا ايام السبت وذلك ما دام الاعتصاب والاحتكار قائمين وعند عدم قيام الملتزم بذلك فللمجلس وحده ان يفسخ الالتزام حالاً ويعطيه الى الغير ويطالب الملتزم بالتعويض وفقاً لما جاء في الفقرة السابقة فيما يتعلق باتخاذ التدابير المقتضية لسد ما تحتاجه اليه الطائفة من اللحم لحساب الملتزم المذكور ومطالبته بالفرق الذي ينشأ عن نقصان البدل مع الفائض النظامي اعتباراً من تاريخ حدوث الاعتصاب والاحتكار .

ثامناً - لا يكلف المجلس الجسماني باى تعويض كان من اجل حادثة او حادثات كانت قد نشأت عن اسباب قهرية كحدوث افات سماوية او عوارض ارضية او صدور اوامر حكومية او حالات اخرى تتعلق بقلة اللحم الكاشير او بانقطاع الذبحية ضمن عذر مشروع او مجابهة صعوبة في بيع اللحم الطاريف او اعتصاب القصابين او احتكارهم الاغنام وغير ذلك من الاسباب التي لم يكن دفعها داخل الامكان .

تاسعاً - ان الايام المعفاة المستثناة من الدخول في مدة الالتزام هي تسعة الايام الاولى من شهر آب العبرى ويوم الكيبور (الغفران) اى يوم العاشر من شهر تشرى العبرى واحد اليومين الاولين والاخرين لكل من اعياد السكوت (المظلة) اى الخامس عشر والسادس عشر والثاني والعشرين والثالث والعشرين من شهر تشرى العبرى والفطير (الفصح) اى الخامس عشر والسادس عشر والحادي والعشرين والثاني والعشرين من شهر نيسان العبرى والشابوعوث (نزول التورات) اى السادس والسابع من شهر سيوان العبرى وايام السبت باجمعها .

عاشراً - ان كل ما يقتضي من مصارف للمجزرة خلال مدة الالتزام من تنوير وتنظيفات وحراسة وبدلات ماء وغيرها تعود على الملتزم وليس على المجلس تأدية شيء منها .

احد عشر - ان معاملة المقاولة والقيام بتنظيم السندات وتسليمها الى من تحرر لامره واعطاء الكفالة اللائقة الذكر والاهتمام بدفع باقي الدوبازيتو والدلالية التي سيرد ذكرها في الفقرة (ب) من المادة ١٤ كل ذلك ينبغي ان يتم خلال اسبوع واحد اعتباراً من تاريخ تقرير المجلس الاحالة القطعية للالتزام هذا واذا تخلف الملتزم عن القيام باحد الشروط المذكورة فللمجلس ان يفسخ الالتزام ويحمل الملتزم كلما ينتج من جراء ذلك من ضرر وخسارة وتعويض وفائض كما جاء في البندين السادس والسابع من هذه المقاولة .

اثنا عشر - ان امر انضباط الكاشير والطريف وما يتفرع منه من المعاملة الدينية يعود الى الحاخامين المختصين بذلك فقط فلا يحق للملتزم الاتيان باى اعتراض واية معارضة ضد اى تدبير او اجراءات يقوم بها الحاخامون المومى اليهم حيث لهم وحدهم حق تقرير ما يتعلق بالانضباط من دون تدخل احد غيرهم حتماً.

2 Seventh - That the strike of the butchers and their refusal to slaughter sheep for any reason whatsoever, and their monopolization of sheep with the aim of reducing what is offered for sale of meat and increasing its price, all of this leads the contractor alone to the obligation of providing a sufficient number of sheep for slaughter to cover what the Jewish community in Baghdad needs of Kosher meat at a rate of 4800 kilograms every day and 5200 kilograms for every Friday, excluding Saturdays, for as long as the strike and monopoly persist. Should the contractor fail to do so, the Council alone has the right to terminate the contract immediately and grant it to others, and demand compensation from the contractor in accordance with what was stated in the previous paragraph regarding taking the necessary measures to cover what the community needs of meat at the expense of the mentioned contractor, and demanding the difference resulting from the decrease in the substitute amount along with the statutory surplus starting from the date of the occurrence of the strike and monopoly. Eighth - The Physical Council shall not be charged with any compensation whatsoever for an incident or incidents that may have arisen from force majeure causes such as the occurrence of heavenly pests or earthly accidents or the issuance of government orders or other cases related to the shortage of Kosher meat or the interruption of slaughtering within a legitimate excuse or facing difficulty in selling Treif meat or the strike of butchers or their monopoly on sheep and other reasons that were not within the possibility to prevent. Ninth - The exempt days excluded from entry into the contract period are the first nine days of the Hebrew month of Ab, and Yom Kippur (Day of Atonement), which is the tenth day of the Hebrew month of Tishrei, and one of the first and last two days of each of the Sukkot festivals (Tabernacles), namely the fifteenth, sixteenth, twenty-second, and twenty-third of the Hebrew month of Tishrei, and Passover (Pesach), namely the fifteenth, sixteenth, twenty-first, and twenty-second of the Hebrew month of Nisan, and Shavuot (Descent of the Torah), namely the sixth and seventh of the Hebrew month of Sivan, and all Saturdays. Tenth - All necessary slaughterhouse expenses during the contract period, including lighting, cleaning, security, water fees, and others, are the responsibility of the contractor, and the Council is not required to pay any part of them. Eleven - The contracting procedure, the organization of bonds and their delivery to the person in whose name they were written, the provision of the aforementioned appropriate guarantee, and taking care of paying the remainder of the deposit and brokerage fees that will be mentioned in paragraph (b) of Article 14, all of this should be completed within one week starting from the date of the Council's decision on the final awarding of this contract. If the contractor fails to fulfill one of the mentioned conditions, the Council may terminate the contract and hold the contractor liable for everything resulting from that of damage, loss, compensation, and surplus, as stated in items six and seven of this contract. Twelve - The matter of Kosher and Treif discipline and the religious procedures arising from it belongs to the specialized Rabbis only, so the contractor has no right to make any objection or opposition against any measure or procedures undertaken by the aforementioned Rabbis, as they alone have the right to decide what pertains to discipline without any intervention from anyone else whatsoever.

ثلاث عشر — اذا قام ذباحو المجزرة باعتصاب وامتنعوا عن الذبحية بناء على اختلافات طائفية واخذ المجلس على عهدته عملية الذبح في المجزرة بناء على الاعتصاب الناشئ من جراء الاختلافات الطائفية المذكورة فللملتزم الحق بمطالبة المجلس ببدل الالتزام اليومي عن مدة الاعتصاب فقط ( بدل الالتزام اليومي عبارة عن خارج قسمة بدل الالتزام الكلي على عدد الايام التي يجرى فيها الذبح خلال السنة ) اربع عشر — يحتفظ المجلس الجسماني بالنقاط الآتية : ( أ ) للمجلس ان ينظم المقاولة على الاسس المار ذكرها ضمن الاصول وذلك لتأمين حقوقه على اسس الالتزام ( ب ) كل ما يقتضى من المصاريف كدلالية نصف بالمائة وتصديق مقاولة الالتزام من كاتب العدل وقيمة طوابع وغيرها من الرسوم تكون بعهدة الملتزم فقط ولا يشترك فيها المجلس . 3 Thirteen — If the slaughterhouse slaughterers go on strike and refrain from slaughtering based on sectarian differences, and the council takes upon itself the slaughtering process in the slaughterhouse based on the strike arising from the aforementioned sectarian differences, then the contractor has the right to demand from the council the daily contract fee for the duration of the strike only (the daily contract fee is the quotient of the total contract fee divided by the number of days on which slaughtering is carried out during the year). Fourteen — The Physical Council reserves the following points: (a) The council may organize the agreement on the aforementioned bases within the regulations in order to secure its rights on the bases of the commitment. (b) All necessary expenses such as half a percent brokerage fee, notarization of the commitment agreement by the notary public, the value of stamps, and other fees shall be the responsibility of the contractor only, and the council shall not participate in them. (c) What is relied upon regarding this commitment is the written agreement only. (d) The council has the option to extend the final referral period if it deems it necessary, and it alone has the right to confirm the final referral, cancel it, or accept other additions within three full days starting from the day following the aforementioned referral. (e) Half of the brokerage fee mentioned in paragraph (b) of this article shall be due to the broker appointed by the council, who is ⟦line⟧ and the other half to the broker who brings the final bidder and through whom the contract is concluded and referred in a final manner, and the full brokerage amount shall be collected from the contractor and given to the two aforementioned brokers by the council.
