Article Nine - The liquidated endowment shall be divided among the heirs of the endower who are alive at the time of this law, each according to their legal entitlement from the inheritances of the endowment's assets or its price, regardless of whether the heir was entitled to benefit or not, and the provision of this paragraph does not apply to the heirs of the deceased who were not entitled to benefit before the entry into force of this law. 3 Article Four - A - The Courts of First Instance in the areas where the endowment is located shall consider the liquidation of these endowments. If there are multiple endowed properties, the lawsuit may be filed in any court in whose area one of those endowed properties is located, and in that case, no other court shall consider it. B - It shall be within the jurisdiction of this court to consider the proof of the endowment, the identification of the endowed assets, the determination of their two categories (family and joint), the interpretation of the conditions of the endowers regarding entitlement, the invalidity of the endowment, and in general all disputes related to the liquidation of family and joint endowments and what branches out from that. C - The trial shall be conducted according to the provisions of this law and the Law of Civil Procedure in an expedited manner, and the judgments shall be subject to appeal by cassation. Article Five - A - When a lawsuit for the liquidation of an endowment is filed in a competent Court of First Instance according to the provisions of this law, it shall become within the jurisdiction of this court to consider all lawsuits filed in other courts related to that endowment that fall within the jurisdiction of the court mentioned in paragraph (B) of Article Four, and in this case, those lawsuits shall be referred to the aforementioned court.

Third - If the lessee delays in paying any (installment of the installments) or a promissory note of the promissory notes issued above upon maturity - the debt becomes entirely accelerated and due immediately, and the lessor has the option to terminate this contract and lease the leased property to others, and the lessee shall be liable for the difference in rent if there is a deficiency, without the need to give a formal notice to the aforementioned lessee. Fourth - The lessee has the right to ⟦line⟧ in the leased property for the duration of the lease and does not have the right to lease it to others without written consent from the lessor. And at the end of the lease term, the lessee is obligated to vacate the leased property to the lessor free of occupants, and if he delays in doing so, he shall be obligated to pay for the period of delay a daily rent amounting to ⟦line⟧ without the need for a formal notice. Fifth - The lessee undertakes to return the leased property to the lessor at the end of the contract safe from any damage or deficiency and to compensate him for all deficiencies and damages that occur in the leased property in kind or in value. Sixth - The property tax shall be the responsibility of the lessor, while the water, electricity, security, and cleaning fees are on the lessee and he is obligated to pay them regularly. Number (28) of the year 1954 Law Permissibility of Liquidating Family Endowments (Waqf) We, Faisal II, King of Iraq After reviewing the first paragraph of Article Twenty- Six of the Basic Law and with the approval of the Parliament We have ratified the following law: - Article One - A - Family Endowment (Waqf Dhurri) means what the endower has endowed upon himself or his descendants, or both together, or upon a specific person or his descendants, or both together, provided that it reverts to a charitable cause upon the extinction of the beneficiary or beneficiaries. B - Joint Endowment (Waqf Mushtarak) means what the endower has endowed upon a charitable cause and individuals or descendants, or upon individuals or descendants and a charitable cause. C - Charitable Endowment (Waqf Khayri) means what was endowed for a charitable cause at the time of its creation or what has finally reverted to it. D - Mercenaries (Al-Murtaziqa) - are those for whom an entitlement to the endowment's yield is stipulated according to the endower's condition or custom in its absence at the time of the enforcement 8 B - Upon appealing the judgment, a proportional fee of one per thousand of the value of his claim in the appealed lawsuit shall be collected. Article Thirteen - The provisions of this law apply to the compensation for the replacement and expropriation of family and joint endowments wherever they exist upon the enforcement of this law. Article Fourteen - The provisions of this law do not apply to family and joint endowments if the endower is alive, as he has the right to revoke what he endowed whenever he wishes. Article Fifteen - This law shall come into force from the date of its publication in the Official Gazette. Article Sixteen - The Ministers of State shall implement this law. المادة الرابعة عشرة -- لا تطبق احكام هذا القانون على الاوقاف الذريه والمشتركة اذا كان الواقف حيا اذ له حق الرجوع عما اوقفه متى شاء .

المادة الخامسة عشرة -- ينفذ هذا القانون من تاريخ نشره في الجريدة الرسميه

المادة السادسة عشرة -- على وزراء الدولة تنفيذ هذا القانون

جواز تصفية الوقف الذري

نحن فيصل الثاني ملك العراق بعد الاطلاع على الفقرة الاولى من المادة السادسة والعشرين من القانون الاساسي وبموافقة مجلس الامة صدقنا القانون الآتي :-

المادة الاولى - آ - يقصد بالوقف الذري ما وقفه الواقف على نفسه او ذريته او عليهما معا او على شخص معين او ذريته او عليهما معا على ان يؤول الى جهة من جهات الخير عند انقراض الموقوف عليه او عليهم .

ب - ويقصد بالوقف المشترك ما وقفه الواقف على جهة خير وعلى الافراد او الذراري او على الافراد او الذراري وعلى جهة خير .

ج - ويقصد بالوقف الخيري ما وقف على جهة خيرية حين انشائه او آل اليه نهائيا .

د - المرتزقة - هم المشروط لهم استحقاق في غلة الوقف حسب شرط الواقف او التعامل عند فقدانه حين نفاذ

B - Joint Waqf (Waqf Mushtarak) means what the endower has endowed upon a charitable entity and upon individuals or progeny, or upon individuals or progeny and upon a charitable entity. C - Charitable Waqf (Waqf Khairi) means what was endowed to a charitable entity at the time of its creation or what eventually reverted to it. D - Mercenaries (Al-Murtaziqa) - are those for whom an entitlement in the yield of the Waqf is stipulated according to the condition of the endower or the dealing in its absence at the time of enforcement
