1. Purpose and Acceptance
These general terms of use (the « Terms ») govern access to and use of the Zakhor platform (zakhor.ai) in all its languages and on all its media. Zakhor is published by the Zakhor Collective, an informal unincorporated collective (see legal notices). Consulting the platform, creating an account on it, or posting a contribution constitutes full and unconditional acceptance of these Terms. If you do not accept them, you must not use the platform.
2. The Platform
Zakhor is a memory platform. It assembles, structures, and publishes Great Books — family lineages, places, communities, works, figures, objects, and themes — grounded in a corpus of archival items, manuscripts, and bibliographic references, as well as genealogical tools and contribution features.
Accessing the platform is free. Certain features — full reading of a Great Book, posting contributions, genealogical spaces, book tracking, and newsletter — require creation of a free account. The Collective continuously evolves the platform: it may add, modify, suspend, or remove any or all features, and endeavors to inform members when changes are substantial.
Zakhor constantly distinguishes between Memory (what is transmitted) and History (what is established by the archive). This requirement, as well as the spirit in which the platform is maintained, are set out in the manifesto and the internal regulations, which supplement these Terms of Use.
3. Member Account
- Age: account creation is reserved for individuals aged at least 15 years old. Below that age, it requires the consent of the holder of parental authority, who remains responsible for the platform's use.
- Accuracy and Security: you provide a valid email address and accurate information. The account is personal and non-transferable; you are responsible for access (password, magic link, associated Google account) and must notify us without delay of any unauthorized use.
- Roles: member, contributor, coordinator, expert, administrator. The rights attached to each role are assigned by the Collective in light of the member's commitment; they may be revoked, in particular in case of breach of these Terms of Use.
- Deletion: you may delete your account at any time from the Edit my account page. Your access, profile and subscriptions are erased; the contents you have deposited remain preserved and dissociated from your identity (see §5).
4. Terms of Use
You commit to loyal use of the platform, in compliance with the law, the manifesto and the internal regulations. In particular, the following are prohibited:
- the publication of unlawful, hateful, denialist, defamatory, offensive, or privacy-infringing content, or content damaging to the dignity or memory of individuals;
- the publication of information about living persons without authorization, and the usurpation of the identity of a third party, living or deceased;
- the mass or automated extraction of the corpus (harvesting, scraping, creation of derived databases, model training), beyond what is authorized by the robots.txt file and the licenses of the sources;
- any impairment of service operation: circumvention of technical measures, attempted access to data or administration spaces not open to the public, deliberate overloading of the infrastructure.
In case of breach, the Collective may remove the content in question and suspend or delete the account, without notice where the breach is serious or manifestly unlawful.
5. Your contributions
You warrant that you hold the necessary rights over what you submit—documents, photographs, GEDCOM files, audio or video recordings, narratives, testimonies, objects and associated information—that you infringe no third-party rights, and that you are entitled to transmit the information relating to the persons appearing therein. You remain responsible for your contributions.
You retain full ownership of your rights. You grant the Zakhor Collective a non-exclusive, free, worldwide licence for the duration of publication, for the purpose of hosting, reproducing, translating into the languages of the platform, adapting (formatting, excerpts, chapters, illustration) and making your contribution publicly available on the platform, as well as in PDF and printed editions derived from the Great Books (§8) and in communications announcing them. This licence is granted solely for the purposes of Zakhor's mission; your contribution is credited whenever the format allows.
Preservation. Contributions submitted are entrusted to Zakhor to sustainably enrich collective memory: they remain preserved and published after deletion of your account, dissociated from your identity, as explained in the privacy policy. To request the withdrawal of a specific document, write to admin@zakhor.ai indicating the relevant page and reason; the Collective will act upon the request when it is justified.
6. Content assisted by artificial intelligence
The Great Books are written with the assistance of artificial intelligence models, based on documented and cited sources, under the editorial responsibility of the Collective. They distinguish Memory from History and indicate their sources, but may contain errors, approximations or gaps. They are offered as documented narrative: they do not constitute genealogical proof, historical expertise, or advice of any kind, and do not engage the Collective's responsibility for the use you make of them.
Correction is part of the project. Any error reported to admin@zakhor.ai or via the contribution forms is examined, and the book is corrected, enriched or withdrawn if necessary. No content is deemed final.
7. Intellectual property
Content produced by Zakhor — editorial texts, chapters of the Great Books, formatting, editorial iconography, database, code — is protected. Any reproduction, extraction or substantial reuse, in particular for commercial purposes or model training, requires prior written authorisation. Short quotation, with source attribution and a link to the page, remains free.
The corpus also aggregates resources from third parties — records, digitisations and images from heritage institutions and open collections. Each remains the property of its holder and is subject to its own licence; it is cited and credited. If you believe a resource is published in error, write to us: it will be withdrawn without delay pending examination.
8. Print-on-demand book
When this feature is available, a Great Book may be ordered in printed volume form. The all-inclusive price, including manufacturing, shipping fees and contribution to the project, is displayed before any payment; the order is only binding upon payment, processed by our payment service provider. The book is manufactured as a single unit and then shipped by a partner printer, within the timeframes announced at the time of order, which are given for guidance only.
As each volume is printed individually according to personalised content, it falls under the exception to the right of withdrawal provided for in article L221-28 3° of the French Consumer Code: withdrawal is no longer possible once manufacturing has begun.
Legal warranties for conformity and hidden defects apply: a damaged, incomplete or non-conforming copy will be replaced or refunded, upon notification within a reasonable time after receipt, with photographs as evidence.
9. Availability and liability
The platform is provided as is, without guarantee of availability or continuity: maintenance, technical incidents, dependence on third-party services or force majeure may interrupt it. The Collective uses reasonable means for the security and preservation of content, without its responsibility being engaged for indirect damages, or for the loss of content of which you have not kept a copy.
Contributions and statements by members engage only their authors. With respect to such content, the Collective acts as host within the meaning of the law for confidence in the digital economy: it does not monitor it generally, but promptly removes any manifestly unlawful content reported to it (§10).
10. Reporting and removal
Any content may be reported to admin@zakhor.ai. To be dealt with usefully, the report should specify the page concerned (URL), the content in question and the reason (rights infringement, factual error, personal data, licence). The Collective examines each report, removes or corrects what should be removed or corrected, and informs the contributor concerned when a contribution is removed.
11. Links and external resources
The platform links to third-party sources, catalogues and websites, which are essential for verifying content. The Collective exercises no control over these resources and is not responsible for their content, their availability, or the data processing they carry out.
12. Personal data
The processing of your personal data, the legal bases and the exercise of your rights are described in our privacy policy, which forms an integral part of these Terms and Conditions.
13. Modification of the Terms and Conditions
These Terms and Conditions may evolve with the platform; the applicable version is the one published on this page on the date of your use. Any substantial modification will be communicated to members by email or by a notice on the site. Continued use after this information constitutes acceptance of the new version.
14. Applicable law and disputes
These Terms and Conditions are governed by French law. In the event of difficulty, please first write to admin@zakhor.ai: the Collective undertakes to seek an amicable solution. Failing agreement, the dispute falls within the jurisdiction of the competent French courts; if you are a consumer, you retain the right to bring proceedings in the courts of your place of residence and to resort to conventional mediation.
