راجع هذه المحكمة الحاخام ساسون خضوري وكيل رئيس الطائفة الاسرائيلية ببغداد بعريضته المؤرخة ٢٢ / ٢ / ٩٥٦ والمرقمة ط ٥٦/٣٦٦٢ التي تتضمن ان السيد مير يعقوب روبين الصائغ كان قد اوقف داريه الصادر بهما الحجة الوقفية المرقمة بعدد اضبارة ١٢٦ / ٤٤ والمؤرخة ٢٥ / ٤ / ١٩٤٥ واشترط ان تكون التولية لنفسه ما دام حيا ومن بعده الى رئيس لجنة ادارة مستشفى مير الياس وناظرا عليه رئيس المجلس الروحاني للطائفة الاسرائيلية في بغداد واذا بطلت مستشفى مير الياس تعود التولية لرئيس المجلس الجسماني في بغداد . ولما كان المتولى المومى اليه قد سافر الى خارج العراق وسقطت عنه الجنسية العراقية ويتعذر ممارسته التولية وحيث ان المستشفى المذكورة بطلت ولا يوجد لجنة لادارتها كما انه لا يوجد مجلسا روحيا للطائفة الاسرائيلية ببغداد بالطريقة المنصوص عليها في قانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ لذلك آلت التولية الى السيد فريد داود سمرة رئيس لجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا للقانون المذكور اللجنة المتشكلة حسب امر وزارة العدلية المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ١٩٥٣ لذلك انه يطلب اصدار حجة لاعتبار السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد متوليا على الوقف المذكور . وقدم السيد فريد داود سمرة بصفته المذكورة آنفا عريضة بتاريخ / / ٩٥٦ ايد الطلب باعتباره متوليا على الوقف المذكور .

وقد وضع هذا الطلب موضع التدقيق واتخذت الاجراءات الآتية :-

١- حضر المحامي صيون حيحي بصفته الوكيل العام عن طالب التولية وايد عريضة موكله المذكورة واطلعت المحكمة على الوكالة العامة المعطاة له من قبل السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد المصدقة من كاتب عدل جنوبي بغداد الاول بعدد عمومي وتاريخ

٢- اطلعت المحكمة على امر وزارة العدلية المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ١٩٥٣ الذي قضى بتأليف لجنة للقيام بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ من الذوات المذكورين فيه على ان ينتخبوا احدهم ليتولى رئاستها واطلعت المحكمة على كتاب رئاسة الطائفة المرقم ط ٥٣/٣٢٤٠ والمؤرخ ٣٠ / ١١ / ١٩٥٣ الذي تبين منه ان السيد فريد داود سمرة قد انتخب رئيسا للجنة المذكورة .

٣- اطلعت المحكمة على صورتي قيد الطابو الواردتين طي كتاب مدير طابو بغداد الرصافة المرقم ٤١٩١ والمؤرخ ١٩ / ٣ / ١٩٥٦ وتبين منهما ان القيد الاول يختص بالدار المرقمة برقم ابواب ١٤٨ / ١١٣ ذات تسلسل ١٣٧ قنبر علي والثاني يختص بالدار المرقمة ١٥٠ / ١١٣ ذات تسلسل ١٣٨ قنبر علي وانهما مسجلتين وقف من اوقاف مير يعقوب روبين الصائغ بموجب الحجة الصادرة من هذه المحكمة المرقمة ١٢٦ / ٤٤ شرعا والمؤرخة ٢٥ / ٤ / ١٩٤٥ ولدى ملاحظة هذه

⟦Amended⟧ Court of Personal Matters in Baghdad The Judge - Mr. Sadiq Haidar File Number - /Sh/1956 Date March 26, 1956 Rabbi Sassoon Khedhouri, representative of the head of the Jewish community in Baghdad, approached this court with his petition dated February 22, 1956, and numbered T 56/3662, which states that Mr. Meir Yaqub Roubin the goldsmith, had endowed his two houses as per the endowment deed numbered under file 126/44 and dated April 25, 1945, and stipulated that the guardianship be for himself as long as he lives, and after him to the head of the management committee of Meir Elias Hospital, and as a supervisor over it the head of the Spiritual Council of the Jewish community in Baghdad, and if the Meir Elias Hospital ceases to exist, the guardianship returns to the head of the Lay Council in Baghdad. Since the aforementioned trustee has traveled outside Iraq and his Iraqi citizenship has been dropped, making it impossible for him to practice guardianship, and since the mentioned hospital has ceased to exist and there is no committee for its management, and there is also no spiritual council for the Jewish community in Baghdad in the manner stipulated in the Jewish Community Law No. 77 of 1931, therefore, the guardianship devolved to Mr. Farid Daoud Samra, head of the Jewish Community Management Committee in Baghdad, which is undertaking the management of what was entrusted to the Lay Council to perform according to the aforementioned law, the committee formed as per the Ministry of Justice order No. 1944 dated November 24, 1953. Therefore, he requests the issuance of a deed to consider Mr. Farid Daoud Samra, in his capacity as the head of the Jewish Community Management Committee in Baghdad, as the trustee over the mentioned endowment. Mr. Farid Daoud Samra, in his aforementioned capacity, submitted a petition dated / / 956 supporting the request as the trustee over the mentioned endowment. This request was placed under scrutiny and the following procedures were taken:- 1- The lawyer Sion Hehy attended in his capacity as the general agent for the petitioner for guardianship and supported his client's mentioned petition. The court reviewed the general power of attorney given to him by Mr. Farid Daoud Samra in his capacity as the head of the Jewish Community Management Committee in Baghdad, certified by the First South Baghdad Notary Public under public number and date 2- The court reviewed the Ministry of Justice order No. 1944 dated November 24, 1953, which stipulated the formation of a committee to undertake the management of what was entrusted to the Lay Council to perform according to the Jewish Community Law No. 77 of 1931, consisting of the individuals mentioned therein, provided that they elect one of them to assume its chairmanship. The court reviewed the letter from the community presidency No. T 53/3240 dated November 30, 1953, from which it appeared that Mr. Farid Daoud Samra was elected as head of the mentioned committee. 3- The court reviewed the two copies of the land registry records received within the letter of the Director of Baghdad Land Registry - Rusafa No. 4191 dated March 19, 1956, and it appeared from them that the first record concerns the house numbered doors 148 / 113 with sequence 137 Qambar Ali, and the second concerns the house numbered 150 / 113 with sequence 138 Qambar Ali, and that they are registered as an endowment of the endowments of Meir Yaqub Roubin the goldsmith according to the deed issued by this court No. 126/44 Sharia and dated April 25, 1945. Therefore, he requests the issuance of a deed to consider Mr. Farid Daoud Samra, in his capacity as head of the Management Committee of the Jewish community in Baghdad, as the trustee over the aforementioned endowment. Mr. Farid Daoud Samra, in his aforementioned capacity, submitted a petition dated 26 / 3 / 1956 supporting the request to be considered the trustee over the aforementioned endowment. This request was placed under scrutiny and the following measures were taken: - 1- Lawyer Sion Hayhi appeared in his capacity as the general attorney for the trusteeship applicant and supported his client's petition aforementioned, and the court reviewed the general power of attorney granted to him by Mr. Farid Daoud Samra in his capacity as head of the Management Committee of the Jewish community in Baghdad, certified by the Notary Public of South Baghdad the first, under general number 1857 and dated 15 / 5 / 1956. 2- The court reviewed a copy of the Ministry of Justice order No. 1944 dated 24 / 11 / 953 which decreed the formation of a committee to carry out the management of what was entrusted to the Lay Council to perform in accordance with the Jewish Community Law No. 77 of 1931, consisting of the individuals mentioned therein, provided they elect one of them to assume its chairmanship. If Meir Elias Hospital ceases to exist, the trusteeship reverts to the head of the Lay Council in Baghdad. راجع هذه المحكمة الحاخام ساسون خضوري وكيل <ins>رئيس</ins> الطائفة الاسرائيلية ببغداد بعريضته المؤرخة 1956/2/22 والمرقمة ط 56/2662 التي تتضمن ان السيد مير يعقوب روبين الصائغ كان قد اوقف داريه الصادر بهما الحجة الوقفية المرقمة بعدد اضبارة 44/126 والمؤرخة 25/4/45 واشترط ان تكون التولية لنفسه ما دام حيا ومن بعده الى رئيس لجنة ادارة مستشفى مير الياس - وناظرا عليه رئيس المجلس الروحاني للطائفة الاسرائيلية في بغداد واذا بطلت مستشفى مير الياس تعود التولية لرئيس المجلس الجسماني في بغداد . ولما كان المتولي قد سافر الى خارج العراق وسقطت الجنسية العراقية عنه ويتعذر ممارسة التولية وحيث ان المستشفى المذكور بطلت ولا يوجد لجنة لادارتها كما انه لا يوجد مجلسا روحانيا للطائفة الاسرائيلية ببغداد بالطريقة المنصوص عليها في قانون الطائفة الاسرائيلية رقم 77 لسنة 1931 لذلك آلت التولية الى السيد فريد داود سمرة رئيس لجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا للقانون المذكور اللجنة المتشكلة حسب امر وزارة العدلية المرقم 1944 والمؤرخ 24/11/1953 لذلك انه يطلب اصدار حجة لاعتبار السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد متوليا على الوقف المذكور . وقدم السيد فريد داود سمرة بصفته المذكورة آنفا عريضة بتاريخ 26/3/1956 أيد الطلب باعتباره متوليا على الوقف المذكور . وقد وضع هذا الطلب موضع التدقيق واتخذت الاجراءات الآتية :- 1 - حضر المحامي صيون حيحي بصفته الوكيل العام عن طالب التولية وأيد عريضة موكله المذكورة واطلعت المحكمة على الوكالة العامة المعطاة له من قبل السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد المصدقة من كاتب عدل جنوبي بغداد الاول بعدد ⟦illegible⟧ 1857 وبتاريخ 10/5/1956 . 2 - اطلعت المحكمة على صورة امر وزارة العدلية المرقم 1944 والمؤرخ 24/11/1953 الذي قضى بتأليف لجنة للقيام بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم 77 لسنة 1931 من الذوات المذكورين فيه على ان ينتخبوا احدهم ليتولى رئاستها واطلعت المحكمة على كتاب رئاسة الطائفة المرقم ط 3240 والمؤرخ 30/11/1953 الذي تبين منه ان السيد فريد داود سمرة قد انتخب رئيسا للجنة المذكورة . 3 - جلبت المحكمة صورتي قيد الطابو للدارين الموقوفتين المذكورتين وتبين منهما ان القيد الاول يختص بالدار المرقمة برقم ابواب 148 / 113 ذات تسلسل 137 قنبر علي والثاني يختص بالدار المرقمة 150 / 113 ذات تسلسل 138 قنبر علي وانهما مسجلتين وقفا من اوقاف مير يعقوب روبين الصائغ بموجب الحجة الصادرة من هذه المحكمة المرقمة 44/126 والمؤرخة 25/4/1945 . 4 - اطلعت المحكمة على حجة الوقف موضوعة البحث الصادرة من هذه المحكمة فظهر انها تؤيد وقف مير المذكور لداريه المرقمين 148 / 113 و 150 / 113 الواقعتين في محلة قنبر علي وبخصوص التولية فقد اشترط ان تكون بيده ما دام في قيد الحياة ومن بعده تنتقل الى رئيس لجنة

Since the trustee has traveled outside Iraq and his Iraqi citizenship has been revoked, and it is impossible to exercise the trusteeship; and since the aforementioned hospital has ceased and there is no committee for its management, and there is no Spiritual Council for the Jewish Community in Baghdad in the manner stipulated in the Jewish Community Law No. 77 of 1931, therefore the trusteeship devolved to Mr. Farid Daoud Samra, the head of the management committee of the Jewish Community in Baghdad, which is carrying out the management entrusted to the Secular Council according to the aforementioned law, the committee formed as per the Ministry of Justice order No. 1944 dated 24/11/1953. Therefore, he requests the issuance of a deed to consider Mr. Farid Daoud Samra, in his capacity as the head of the management committee of the Jewish Community in Baghdad, as the trustee over the aforementioned endowment. Mr. Farid Daoud Samra, in his aforementioned capacity, submitted a petition dated 26/3/1956 supporting the request to be considered the trustee over the aforementioned endowment. This request was put under scrutiny and the following procedures were taken:- 1 - Lawyer Sion Hayahi attended in his capacity as the general agent for the trusteeship petitioner and supported his aforementioned client's petition. The court examined the general power of attorney granted to him by Mr. Farid Daoud Samra in his capacity as head of the committee for the management of the Jewish Community in Baghdad, certified by the First Notary Public of South Baghdad under number ⟦illegible⟧ 1857 and dated 10/5/1956. 2 - The court examined a copy of the Ministry of Justice order No. 1944 dated 24/11/1953, which decreed the formation of a committee to carry out the management entrusted to the Secular Council according to the Jewish Community Law No. 77 of 1931, consisting of the individuals mentioned therein, provided they elect one of them to assume its presidency. ٥ - اطلعت المحكمة على كتاب مديرية شرطة السفر والجنسية (مكتب الاسقاط) ببغداد المرقم ٣٤٥ والمؤرخ ١٣ / ٢ / ١٩٥٦ الذي ايد بأن مئير يعقوب الصائغ قد اسقطت الجنسية العراقية عنه برقم ٢٩٣٨٢ .

القرار :

حيث قد تحقق للمحكمة بأن الواقف مئير يعقوب روبين الصائغ كان في صحة وتصرف داريه التي تناولتها الحجة المؤرخة ٢٥ / ٤ / ١٩٤٥ وتحت رقم اضبارة ١٢٦ / ٤٤ ش - الصادرة من هذه المحكمة قد اشترط ان تكون التولية بيده ما دام حيا ومن بعده تنتقل الى رئيس لجنة ادارة مستشفى مئير الياس بنظارة المجلس الروحاني للطائفة الاسرائيلية ببغداد واذا بطلت لجنة ادارة المستشفى المذكورة تنتقل التولية لرئيس المجلس الجسماني في بغداد <del>⟦illegible⟧</del> وحيث قد تحقق للمحكمة ان الجنسية العراقية قد اسقطت عن المتولي مئير يعقوب روبين الصائغ فتصبح التولية منحلة لتعذر قيامه بامور التولية فحسب والحالة هذه تنفيذ شرط الواقف بان تنتقل الى رئيس لجنة ادارة مستشفى مئير الياس تحت نظارة رئيس المجلس الروحاني للطائفة . وحيث قد تبين من كتاب رئاسة الطائفة الاسرائيلية المرقم ط / ٢٦٦٢ / ٥٦ والمؤرخ في ٢٢ / ٢ / ١٩٥٦ بانه نظرا لقلة تشكيلات الطائفة واشغال المستشفى المذكور من قبل وزارة الصحة لم يبق هناك لجنة لادارة هذه المستشفى ولم يبق كذلك مجلس روحاني للطائفة . لذلك اقتضى انتقال التولية لرئيس المجلس الجسماني وفق شرط الواقف . ولما كانت اللجنة الادارية للطائفة الاسرائيلية ببغداد التي يرأسها المستدعي السيد فريد داود سمرة هي القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ ⟦بموجبه⟧ كما تأيد ذلك من اسس

راجع هذه المحكمة الحاخام ساسون خضوري وكيل رئيس الطائفة الاسرائيلية ببغداد بعريضته المؤرخة ٢٢ / ٢ / ١٩٥٦ والمرقمة ط ٥٦ / ٣٦٦ التي تتضمن ان السيد مير يعقوب روبين الصائغ كان قد اوقف داريه الصادر بهما الحجة الوقفية المرقمة بعدد اضبارة ١٢٦ / ٤٤ والمؤرخة ٢٥ / ٤ / ١٩٤٥ واشترط ان تكون التولية لنفسه ما دام حيا ومن بعده الى رئيس لجنة ادارة مستشفى مير الياس وناظرا عليه رئيس المجلس الروحاني للطائفة الاسرائيلية في بغداد واذا بطلت مستشفى مير الياس تعود التولية لرئيس المجلس الجسماني في بغداد . ولما كان المتولي المومى اليه قد سافر الى خارج العراق وسقطت الجنسية العراقية عنه ويتعذر ممارسته التولية وحيث ان المستشفى المذكورة بطلت ولا يوجد لجنة لادارتها كما انه لا يوجد مجلسا روحيا للطائفة الاسرائيلية ببغداد بالطريقة المنصوص عليها في قانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ لذلك آلت التولية الى السيد فريد داود سمرة رئيس لجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بالمادة ما عهد للمجلس الجسماني القيام به وفقا للقانون المذكور اللجنة المتشكلة حسب امر وزارة العدلية المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ٥٣ لذلك انه يطلب اصدار حجة لاعتبار السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد متوليا على الوقف المذكور . وقدم السيد فريد داود سمرة بصفته المذكورة آنفا عريضة بتاريخ ٢٦ / ٣ / ١٩٥٦ ايد الطلب باعتباره متوليا على الوقف المذكور . وقد وضع هذا الطلب موضع التدقيق واتخذت الاجراءات الاتية :-

١- حضر المحامي صيون جيجي بصفته الوكيل العام عن طالب التولية وايد عريضة موكله المذكورة واطلعت المحكمة على الوكالة العامة المعطاة له من قبل السيد فريد داود سمرة بصفته رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد المصدقة من كاتب عدل جنوبي بغداد الاول بعدد عمومي ١٨٥٧ وبتاريخ ١٥ / ٥ / ١٩٥٦ . ٢- اطلعت المحكمة على صورة من امر وزارة العدلية المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ٩٥٣ الذي قضى بتأليف لجنة للقيام بأدارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ من الذوات المذكورين فيه على ان ينتخبوا احدهم ليتولى رئاستها . واطلعت المحكمة على كتاب رئاسة الطائفة المرقم ط ٥٣ / ٣٢٤٠ والمؤرخ ٣٠ / ١١ / ١٩٥٣ الذي تبين منه ان السيد فريد داود سمرة قد انتخب رئيسا للجنة المذكورة .

Personal Matters Court in Baghdad Case Number - 860 / Sh / 1956 To Mr. - Sayyid Sadiq Haider Rabbi Sassoon Khedhouri, acting head of the Jewish community in Baghdad, approached this court with his petition dated 2/22/1956 and numbered T 56/366, which states that Mr. Meir Yaqub Rubin the Goldsmith had endowed his two houses under the endowment deed (waqfiyah) numbered case file 126 / 44 and dated 4/25/1945, and stipulated that the guardianship (tawliya) be for himself as long as he lives, and after him to the head of the management committee of Meir Elias Hospital, with the head of the Spiritual Council of the Jewish community in Baghdad as its supervisor. If Meir Elias Hospital ceases to exist, the guardianship reverts to the head of the Lay Council in Baghdad. Since the aforementioned trustee has traveled outside Iraq and his Iraqi citizenship has been revoked, making it impossible for him to practice guardianship, and since the aforementioned hospital has ceased to exist and there is no committee for its management, just as there is no spiritual council for the Jewish community in Baghdad in the manner stipulated in the Jewish Community Law No. 77 of 1931, the guardianship has therefore devolved to Mr. Farid Daoud Samra, the head of the Jewish Community Management Committee in Baghdad, which carries out the duties entrusted to the Lay Council in accordance with the aforementioned law, a committee formed as per Ministry of Justice order No. 1944 dated 11/24/53. Therefore, he requests the issuance of a deed to consider Mr. Farid Daoud Samra, in his capacity as head of the Management Committee of the Jewish Community in Baghdad, as the trustee over the aforementioned endowment. Mr. Farid Daoud Samra, in his aforementioned capacity, submitted a petition dated 3/26/1956 supporting the request to be considered the trustee of the mentioned endowment. This request was placed under review and the following procedures were taken:- 1- The lawyer Sion Chi-chi attended in his capacity as the general attorney for the guardianship applicant and supported his client's aforementioned petition, and the court reviewed the general power of attorney granted to him by Mr. Farid Daoud Samra in his capacity as head of the Jewish Community Management Committee in Baghdad, certified by the Notary Public of South Baghdad the First, under general number 1857 and dated 5/15/1956. 2- The court reviewed a copy of Ministry of Justice order No. 1944 dated 11/24/953 which decreed the formation of a committee to manage the duties entrusted to the Lay Council in accordance with the Jewish Community Law No. 77 of 1931 from the individuals mentioned therein, provided that they elect one of them to assume its presidency. The court reviewed the letter from the community leadership numbered T 53/3240 and dated 11/30/ 1953, which showed that Mr. Farid Daoud Samra was elected head of the aforementioned committee. ٤ - اطلعت المحكمة على كتاب مديرية شرطة السفر والجنسية ( مكتب الاسقاط ) بغداد المرقم ٢٤٥ والمؤرخ ١٣ / ٣ / ١٩٥٦ وتبين منه ان مير يعقوب الصائغ قد سقطت الجنسية العراقية عنه برقم ٢٩٣٨٢ .

واما فيما يتعلق بالواقف الذي اشترط التولية لنفسه المدعو مير يعقوب روبين الصائغ فانه قد سافر الى خارج العراق واقام في اسرائيل وسقطت عنه الجنسية العراقية واصبحت التولية على الوقف المذكور منحلة لتعذر ممارسة المومى اليه التولية وحيث ان امر سقوط الجنسية العراقية عن المتولى يعتبر موت حكمي فتؤول التولية في هكذا احوال الى من يخلفه في التولية وهو رئيس لجنة ادارة مستشفى مير الياس بنظارة المجلس الروحاني . ونظرا لنقل تشكيلات الطائفة واشغال المستشفى المذكور من قبل وزارة الصحة لم يبق هناك لجنة لادارة المستشفى المذكور ولا مجلسا روحيا للطائفة الاسرائيلية ببغداد بالطريقة المنصوص عليها في قانون الطائفة الاسرائيلية ببغداد رقم ٧٧ لسنة ١٩٣١ لذلك ⟦illegible⟧ آلت التولية الى السيد فريد داود سمرة رئيس لجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ حسب الامر الصادر من وزارة العدلية الجليلة المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ١٩٥٣ . وعليه نرجو اصدار القرار بتعيين السيد فريد داود سمرة المومى اليه متوليا على الدارين الموقوفتين من قبل السيد مير يعقوب روبين الصائغ بموجب الحجة المنوه عنها اعلاه واصدار الحجة اللازمة بذلك .

عطفا على عريضة الحاخام ساسون خضوري وكيل رئاسة الطائفة الاسرائيلية ببغداد المرقمة ط/٥٦/٣٦٦٢ والمؤرخة ٢٢/٢/١٩٥٦ أيد الطلب الوارد في العريضة المشار اليها اعلاه ونظرا للاسباب المشروحة فيها <del>⟦illegible⟧</del> اطلب ( بصفتي رئيسا للجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ اعتباري متوليا على داري الوقف مير يعقوب روبين الصائغ الموقوفتين بموجب الحجة الصادرة من محكمتكم المحترمة بعدد ١٢٦/٤٤ وتاريخ ٢٥/٤/١٩٤٥ واربط طيا ما يلي :-

١- صورة مصدقة من امر وزارة العدلية المرقم ١٩٤٤ والمؤرخ ٢٤/١١/١٩٥٣ بتشكيل اللجنة الادارية لادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ ٢- صورة مصدقة من كتاب الطائفة الاسرائيلية ببغداد المرقم ط/٥٣/٣٢٤٠ والمؤرخ ٣٠/١١/١٩٥٣ الذي يؤيد انتخابي رئيسا للجنة الادارية المنوه عنها اعلاه .

بموجب حجة الوقف الصادرة من محكمتكم المحترمة بتاريخ ٢٥ / ٤ / ١٩٤٥ وعدد ⟦لا⟧ ١٢٦ / ٤٤ كان السيد مير يعقوب روبين الصائغ قد اوقف داريه المرقمتين ١٤٨ / ١١٣ و ١٥٠ / ١١٢ الواقعتين في محلة قنبر علي واشترط ان تكون التولية على الوقف المذكور لنفسه ما دام حيا ومن بعده الى رئيس لجنة ادارة / مستشفى مير الياس وناظرا عليه رئيس مجلس الروحاني للطائفة الاسرائيلية في بغداد واذا بطلت مستشفى مير الياس تعود التولية لرئيس مجلس الجسماني في بغداد . واما فيما يتعلق بالواقف الذي اشترط التولية لنفسه المدعو مير يعقوب روبين الصائغ فانه قد سافر الى خارج العراق واقام في اسرائيل وسقطت عنه الجنسية العراقية واصبحت التولية على الوقف المذكور منحلة لتعذر ممارسة المومى اليه التولية وحيث ان امر سقوط الجنسية العراقية عن المتولي يعتبر موت حكمي فتؤول التولية في هكذا احوال الى من يخلفه في التولية وهو رئيس لجنة ادارة مستشفى مير الياس بنظارة المجلس الروحاني . ونظرا لتقليص تشكيلات الطائفة واشغال المستشفى المذكور من قبل وزارة الصحة لم يبق هناك لجنة لادارة المستشفى المذكور ولا مجلسا روحيا للطائفة الاسرائيلية ببغداد بالطريقة المنصوص عليها في قانون الطائفة الاسرائيلية ببغداد رقم ٧٧ لسنة ١٩٣١ لذلك ⟦فقد⟧ آلت التولية الى السيد فريد داود سمرة رئيس لجنة ادارة الطائفة الاسرائيلية ببغداد القائمة بادارة ما عهد للمجلس الجسماني القيام به وفقا لقانون الطائفة الاسرائيلية رقم ٧٧ لسنة ١٩٣١ حسب الامر الصادر من وزارة العدلية الجليلة المرقم ١٩٤٤ والمؤرخ ٢٤ / ١١ / ١٩٥٣ . وعليه نرجو اصدار القرار بتعيين السيد فريد داود سمرة المومى اليه متوليا على الدارين الموقوفتين من قبل السيد مير يعقوب روبين الصائغ بموجب الحجة المنوه عنها اعلاه واصدار الحجة اللازمة بذلك .

His Excellency the Judge of Personal Status, the Respected Baghdad According to the endowment deed issued by your respected court dated 25 / 4 / 1945 and number ⟦no⟧ 126 / 44, Mr. Mir Yaqub Rubin Al-Sayegh had endowed his two houses numbered 148 / 113 and 150 / 112 located in the Qanbar Ali neighborhood and stipulated that the trusteeship of the mentioned endowment shall be for himself as long as he lives, and after him to the Chairman of the Management Committee / Mir Elias Hospital, with the Head of the Spiritual Council of the Jewish community in Baghdad as supervisor. If the Mir Elias Hospital ceases to exist, the trusteeship shall devolve to the Head of the Lay Council in Baghdad. As for the endower who stipulated the trusteeship for himself, namely Mir Yaqub Rubin Al-Sayegh, he has traveled outside Iraq and settled in Israel, and his Iraqi citizenship was revoked, and the trusteeship of the mentioned endowment became vacant due to the inability of the aforementioned person to exercise the trusteeship. Since the matter of the revocation of Iraqi citizenship from the trustee is considered a legal death, the trusteeship in such cases passes to whoever succeeds him in the trusteeship, which is the Chairman of the Management Committee of the Mir Elias Hospital under the supervision of the Spiritual Council. Given the reduction of the community's formations and the occupation of the mentioned hospital by the Ministry of Health, there is no longer a committee to manage the mentioned hospital, nor a spiritual council for the Jewish community in Baghdad in the manner prescribed in the Jewish Community Law in Baghdad No. 77 of 1931.
