١ - يوافق الطرف الثاني على ان يكون بدل ايجار العرصة المذكورة من ( ٥ / ٩ / ٩٤٦ ) الى ( ٥ / ٩ / ٩٧٤ ) بمبلغ ( ٢٠٩٥/٢٢٢ ) دينارا على ان يدفع بدل الايجار السنوي الذي مقداره ( ٧٤/٨٣٣ ) دينارا الى الطرف الثالث (مديرية اوقاف بغداد) في اول كل سنة من سني العقد ويتعهد القيام بجميع الواجبات والتعهدات المترتبة على الطرف الاول في عقد الايجار .

٢ - على الطرف الثاني ان ينشيء على العرصة المذكورة الابنية التي تحتاج اليها من خالص ماله على ان لا تقل النفقات عن ( ٩٠٠ ) دينارا على ان ليس له حق بطلب التنزيل من بدل الايجار مهما كانت كلفة البناء وحسب شروط الايجار الباقية المدرجة في قائمة المزايدة الخاصة بالعرصة المذكورة .

٣ - على الطرف الثاني ان يكمل انشاء الابنية التي يحتاج اليها حسب انظمة البلدية خلال مدة لا تتجاوز خمس سنوات من (تاريخ قرار مجلس الوزراء) واذا انتهت هذه المدة ولم يقم بذلك يعتبر العقد مفسوخا ويترتب على الطرف الثاني دفع ⟦...⟧ في الفقرة الثانية علاوة على بدلات الايجار التي قد تكون مستحقة عليه وذلك دون حاجة الى سبق انذار او الى اقامة دعوى من قبل الطرف الثالث .

٤ - ليس للطرف الثاني ايجار العرصة المذكورة الى شخص آخر الا بموافقة المالك الطرف الثالث وهذا لا يخل بحق الطرف الثاني في ايجار البناية التي يشيدها الى من يشاء حسب الاصول المتعارفة .

٥ - على الطرف الثاني ان لا يهمل صيانة البناء في خلال مدة الايجار وان لا يهدمه كلا او قسما واذا لزم هدم قسم منه حسب الضرورة الفنية او الحاجة فعليه ان يعيد انشاء ذلك القسم بمبلغ لا يقل عن كلفته الاصلية .

٦ - على الطرف الثاني عند انتهاء مدة الايجار ان يسلم البناء المشيد على العرصة المذكورة بكل مشتملاته الى الطرف الثالث في حالة يصلح معها للاستغلال باعتباره ملكا للوقف ولا يكون للطرف الثاني حينئذ اي حق في الادعاء باي شيء كان .

٧ - على الطرف الثاني ان يدفع الرسوم والضرائب والاجور التي تفرضها القوانين المرعية والتي تقررها الحكومة في المستقبل على البناء والعرصة بما في ذلك ضريبة الملك واجور التبليط ورسوم البلدية الاخرى وان يتحمل هو اجور الماء والكهرباء ايضا .

٨ - اني الطرف الثالث (مدير اوقاف بغداد بالاضافة الى وظيفتي) وافقت على تدوير الطرف الاول ايجار العرصة المذكورة رقمها وبدل ايجارها في الفقرة الاولى من هذا الصك الى الطرف الثاني بالشروط المبينة في هذه المقاولة .

وعلى هذا تم الاتفاق على العقد وجرى تسليم الطرف الثاني للمأجور وعليه نظمت هذه المقاولة .
