ثالثاً - ذات استحقاق كل احدى من الكمبيالات المذكورة يعتبر بحكم البروتوستو على الملتزم والكفيل . ولهذا اذا لا يدفع الملتزم او كفيله احدى الكمبيالات باستحقاقها او تأخرا دفع قسماً منها فيحق للحاخامباشي او لرئيس المجلس الجسماني ان يعين وكيل من قبله لجمع الغباية ولاستيفائها لحساب الملتزم . وفي هذا الحال يختار بوضع واردات الغباية بالمزايدة مجدداً لحساب الملتزم وبالاستيفاء النقيصة منه او من الكفيل وبتضمينها ما ينتج من الخسار وذلك من دون اجراء البروتوستو ومعاملات الرسمية في كل الاحوال المذكورة . -

رابعاً - اذا اعتصب القصابون وامتنعوا من ذبح الغنم لاي سبب كان او اذا احتكروا الغنم بقصد تعذر اللحم وتصعيد سعره عند الموسويين فعلى الملتزم ان يقدم اغناماً للذبح لسد حوائج الجماعة الموسوية ببغداد اقله اربعة الاف وثمانماية كيلو يومياً واما في كل يوم من ايام الجمعة فخمسة الاف ومائتين كيلو ⟦٤٨٠٠/٥٢٠٠⟧ من لحم الطاهر واذا لم يمتثل هذا الشرط ويسبب بذلك قلة اللحم وصعود سعره فالحاخامباشي او رئيس المجلس الجسماني يكون مختاراً اما ان يعرض اغناماً للذبح ببغداد يكفي لوفيات الجماعة ويحمل الملتزم بجميع الخسار والضرر الذي يحصل من ذلك واما ان يضع واردات الغباية بالمزايدة مجدداً لحساب الملتزم ويستوفي النقيصة منه وتضمنه ما ينتج من الخسار وجميع ذلك بدون اجراء البروتوستو والمعاملات الرسمية . -

خامساً - لا يحق للملتزم بمطالبة اي تنزيل او تعويض اذا حصلت لا سمح الله افات سماوية او ارضية او اذا حددت الحكومة مقدار الغنم للذبح او اذا اخذ بالصعوبة بيع لحم الطاريف او اذا امتنع او اعتصب القصابون من الذبح لاي سبب كان او اذا احتكروا الاغنام ، بل في كافة الاحوال المذكورة على الملتزم ان يدفع الاقساط باستحقاقها . -

سادساً - كما هي العادة الجارية لا يذبح غنم في تسعة ايام المعروفة بتسعة آب العبراني وفي احد اليومين من روش هشنا وفي يوم الكيبور وفي احد من اليومين من كل من عيد السكة والبيسح والشابوعوت . -

سابعاً - للحاخامباشي ان يمنع من الذبح القصابين الذين تتحقق لديه سوء معاملاتهم بالمصلحة من التجاوز بالكلام وغيره ولا يحق للملتزم الاحتجاج بادعاء ان ذلك اوجب قلة الذبح . كما بما ان كل من ذبح غنم ⟦اغناماً⟧ في مسلخ الجماعة ملزوم بتسليم المصاريف للكاتب الموظف بها فيحق للحاخامباشي ان يأمر الذباحين بالامتناع عن الذبح لكل من امتنع عن تسليمها وذلك الى حين الاستيفاء منه تعزيراً . -

Therefore, if the contractor or his guarantor does not pay one of the promissory notes upon its maturity or delays paying a portion of it, the Hakham Bashi or the President of the Lay Council has the right to appoint an agent on his behalf to collect the fees and fulfill them for the contractor's account. In this case, he chooses to put the fee revenues up for bidding again for the contractor's account and to recover the deficit from him or the guarantor and to hold them liable for whatever loss results, without performing a protest or official procedures in all the mentioned cases. - Fourth - If the butchers strike and refuse to slaughter sheep for any reason, or if they hoard sheep with the intention of making meat scarce and raising its price for the Israelites, the contractor must provide sheep for slaughter to meet the needs of the Jewish community in Baghdad, at least four thousand eight hundred kilos daily, and on every Friday, five thousand two hundred kilos ⟦4800/5200⟧ of Kosher meat. If he does not comply with this condition and causes a meat shortage and a price increase, the Hakham Bashi or the President of the Lay Council shall be free to either offer sheep for slaughter in Baghdad sufficient for the community's needs and charge the contractor for all the loss and damage resulting therefrom, or to put the fee revenues up for bidding again for the contractor's account and recover the deficit from him and hold him liable for the resulting loss, all of which without performing a protest or official procedures. - Fifth - The contractor has no right to demand any reduction or compensation if, God forbid, heavenly or earthly disasters occur, or if the government limits the amount of sheep for slaughter, or if selling Treif meat becomes difficult, or if the butchers refuse or strike from slaughtering for any reason, or if they hoard sheep; rather, in all mentioned cases, the contractor must pay the installments at their maturity. - Sixth - As is the current custom, no sheep are slaughtered during the nine days known as the Hebrew Ninth of Av, nor on either of the two days of Rosh Hashanah, nor on Yom Kippur, nor on either of the two days of Sukkot, Pesach, and Shavuot. - Seventh - The Hakham Bashi may prevent from slaughtering those butchers whose ill-treatment of the business is proven through verbal abuse or otherwise, and the contractor has no right to protest by claiming that this caused a decrease in slaughtering. Also, since everyone who slaughters sheep ⟦sheep⟧ in the community slaughterhouse is required to hand over the fees to the clerk assigned to it, the Hakham Bashi has the right to order the slaughterers to refrain from slaughtering for anyone who refuses to hand them over, until the collection is made as a penalty. -

B01 · paragraph / arabic عروضة للمزايدة المصارين من حيث المجموع التي تستخرج من الاغنام التي تذبح في مسلخ جماعة الموسوية في بغداد فقط من كاشير وطاريف وذلك بدون النظر لعددها لمدة سنة واحدة اعتباراً من واحد ابريل ٩٤٧ لغاية مارس ٩٤٨ تحت الشرائط الاتية :- اولاً - يأخذ الملتزم عيناً مصارين الغنم والمعز الكاشير والطاريف التي تذبح في مسلخ جماعة الموسوية في بغداد فقط. ثانياً - على الملتزم ان يستلم المصارين المذكورة المطروحة في حوش المسلخ وعليه انه ملزوم بتسوية المصارف المقتضية لجمعها ونقلها . ثالثاً - لا يسوغ للملتزم الامتناع من قبول واخذ اي مصران كان بحجة انه ضعيف او صغير او مقطع او اسود بل انه ملزوم باخذها وقبولها مهما تكون . رابعاً - على الملتزم الذي يتقرر عليه الالتزام ان يدفع الى صندوق الجماعة نقداً بطريق الديبوزيتو بالمائة عشرة من مجموع بدل الالتزام ويحسب له هذا المبلغ من بدل الشهر ونصف الشهر الاخيرين . واما الباقي من بدل الالتزام يدفع مقسطاً في واحد وعشرين قسط يؤخذ عوض كل منها سند كمبيالة لامر الحاخامباشي في بغداد اضافة الى صندوق الجماعة . فالاولى مؤرخة بتاريخ واحد ابريل ٩٤٧ استحقاق ١٥ ابريل ٩٤٧ وتعاقب كل من الاخرى بخمسة عشر يوماً بصورة ان قسط الاخير يستحق في ١٥ فروري ٩٤٨ وملزوم ايضاً باعطاء كفيل معتبر يتعهد بمقاولة الالتزام وبسندات الكمبيالات . وعند عدم تمكنه من تقديم الكفيل فعليه ابلاغ الديبوزيتو الى خمس البدل ويقطع مجموع الديبوزيتو المذكور من اقساط الشهر ونصف الشهر الاخيرين . خامساً - ذات استحقاق كل احدى من الكمبيالات المذكورة يعتبر بحكم البروتستو على الملتزم والكفيل ، وعليه لا يلزم بهذا الحال اجراء البروتستو وسائر معاملات الرسمية . ولهذا اذا لم يدفع الملتزم او كفيله احدى الكمبيالات باستحقاقها او تأخر دفع قسماً منها يحق للحاخامباشي او لرئيس المجلس الجسماني ان يعين وكيل من قبله لجمع المصارين ويبيعها على الغير بسعر وقتها ويستوفي الثمن لحساب الملتزم . وكذا في هذا الحال مختار بوضع المصارين بالمزايدة مجدداً لحساب الملتزم وباستيفاء النقيصة منه وتضمينه بما ينتج من الخسار وجميع ذلك من دون حاجة لاجراء البروتستو وغير معاملات رسمية . سادساً - لا يحق للملتزم المطالبة بتنزيل او تعويض او تضمين شيء ما اذا حصل قلة في حاصلات المصارين بسبب اعتصاب القصابين من الذبح لاي سبب كان او بسبب آفات سماوية او ارضية او بموجب امر الحكومة ومهما تمادى الاعتصاب المذكور ومهما دامت الافات المذكورة لاي سماوية او امر الحكومة . سابعاً - كما هي العادة الجارية لا يذبح غنم في تسعة ايام المعروفة بتسعة آب العبراني وفي احد اليومين من روش هشانا وفي يوم الكيبور وفي احد اليومين من كل من عيد السكة والبيسح والشابوعوت . ثامناً - للحاخامباشي ان يمنع من الذبح القصابين الذين تتحقق لديه سوء معاملاتهم بالمسلخ ولا يحق للملتزم الاحتجاج بادعاء ان ذلك اوجب القلة في حاصلات المصارين الا اذا غصب في المسلخ احد القصابين مقدار من المصارين من طاريف وكاشير او اهمل تسليمها الى الملتزم فعلى الملتزم ان يخبر بذلك الحاخامباشي تحريرياً ويعرفه اسم الغاصب وعلى الحاخامباشي ان يمنع حينئذ من الذبح القصاب الغاصب الى حين اعادته المصارين المغصوبة او ثمنها الى الملتزم . وليس للملتزم حق بالمطالبة بشيء عوض المصارين المغصوبة . تاسعاً - تعتبر الشرائط التحريرية فقط المندرجة بهذه البوصلة ولا اعتبار لاي كلام شفاهي يجري بين العاقدين .

Offered for auction are the intestines in total that are extracted from sheep slaughtered in the slaughterhouse of the Musawiya community in Baghdad only from Kosher and Taref, without regard to their number, for a period of one year starting from April 1, 947 until March 948 under the following conditions:- First - The contractor shall take in kind the intestines of sheep and goats, Kosher and Taref, which are slaughtered in the slaughterhouse of the Musawiya community in Baghdad only. Second - The contractor must receive the aforementioned intestines placed in the slaughterhouse yard, and he is obliged to settle the expenses necessary for collecting and transporting them. Third - The contractor is not permitted to refrain from accepting and taking any intestine on the pretext that it is weak, small, cut, or black, but rather he is obliged to take and accept them whatever they may be. Fourth - The contractor to whom the contract is awarded must pay to the community fund in cash by way of deposit ten percent of the total contract value, and this amount shall be credited to him from the payment of the last month and a half. As for the remainder of the contract value, it shall be paid in installments in twenty-one installments, for each of which a promissory note shall be taken to the order of the Hakham Bashi in Baghdad in addition to the community fund. The first is dated April 1, 947, due April 15, 947, and each of the others follows by fifteen days, such that the last installment is due on February 15, 948. He is also obliged to provide a reputable guarantor who undertakes the contract agreement and the promissory notes. If he is unable to provide the guarantor, he must increase the deposit to one-fifth of the value, and the total of the mentioned deposit shall be deducted from the installments of the last month and a half. Fifth - The maturity of each of the mentioned promissory notes is considered as a protest against the contractor and the guarantor; therefore, it is not necessary in this case to carry out a protest or other formal proceedings. For this reason, if the contractor or his guarantor does not pay one of the promissory notes upon its maturity or delays the payment of a part of it, the Hakham Bashi or the head of the Lay Council has the right to appoint a representative on his behalf to collect the intestines and sell them to others at the current price and collect the price for the contractor's account. Likewise, in this case, he has the choice to put the intestines up for auction again for the contractor's account and to collect the deficiency from him and hold him liable for the resulting loss, all of this without the need to carry out a protest or other formal proceedings. Sixth - The contractor has no right to demand a reduction, compensation, or indemnity for anything if a shortage occurs in the yield of intestines due to a strike by the butchers from slaughtering for any reason whatsoever, or due to heavenly or earthly disasters, or by order of the government, no matter how long the mentioned strike lasts and no matter how long the mentioned disasters last, whether heavenly or by government order. Seventh - As is the current custom, no sheep are slaughtered during the nine days known as the Hebrew Ninth of Av, nor on one of the two days of Rosh Hashanah, nor on Yom Kippur, nor on one of the two days of each of the Sukkot, Passover, and Shavuot holidays. Eighth - The Hakham Bashi may prevent from slaughtering those butchers whose ill-treatment in the slaughterhouse is proven to him, and the contractor has no right to protest by claiming that this caused a shortage in the yield of intestines, unless one of the butchers in the slaughterhouse usurps a quantity of intestines, whether Taref or Kosher, or neglects to deliver them to the contractor. In that case, the contractor must inform the Hakham Bashi in writing and identify the name of the usurper, and the Hakham Bashi must then prevent the usurping butcher from slaughtering until he returns the usurped intestines or their price to the contractor. The contractor has no right to demand anything in exchange for the usurped intestines. Ninth - Only the written conditions included in this voucher are considered, and no verbal statements made between the contracting parties shall be considered.

Bidding conditions for the commitment of meat tax (Ghabala) and the prices of intestines in total that come from sheep slaughtered in the slaughterhouse of the Mosaic community in Baghdad only, both Kosher and Taref, without exception, for a period of one year starting from April 1, 1946, until March 31, 1947, under the following conditions:- First - The contractor shall collect the Kosher meat tax at a rate of two per kilo including eggs and kidneys, as determined by previous practice. As for the fetus, i.e., the immediate one that appears inside its mother, it also belongs to the contractor, but he forfeits his right to claim or protest if the government does not allow the slaughter of pregnant ewes. This fee is collected from the carcass that is slaughtered in the community slaughterhouse, Adhamiya, and Karrada, which is offered for sale to the Jews. Likewise, the contractor takes in kind the intestines of Kosher and Taref sheep and goats slaughtered in the slaughterhouse of the Mosaic community in Baghdad only, and he receives the aforementioned intestines delivered in the slaughterhouse hall, and he is obliged to carry out the necessary processing of the intestines for their collection and transport. The contractor is not permitted to refuse to accept or take any intestines on the pretext that they are weak, small, cut, or black; rather, he is obliged to take and accept them regardless of their condition. Second - The contractor must pay to the community treasury in cash as a deposit ten percent (10%) of the total commitment value, and this amount shall be credited to him from the payment of the last month and a half. As for the remainder of the commitment value, it shall be paid in installments in twenty-one installments, for each of which a promissory note is taken to the order of the Hakham Bashi in Baghdad in addition to the community treasury. The first is dated April 1, 1946, due April 15, 1946, and each installment follows the other by fifteen days in such a way that the last installment is due on February 15, 1947. He is also obliged to provide a reputable guarantor who undertakes the commitment contract and the promissory notes. If he is unable to provide a guarantor, he must increase the deposit to one-fifth of the value, and the total of the aforementioned deposit shall be deducted from the installments of the last month and a half. Third - The maturity of each of the aforementioned promissory notes is considered as a protest against the contractor and the guarantor. Therefore, if the contractor or his guarantor does not pay one of the promissory notes upon its maturity or delays in paying a part of it, the Hakham Bashi or the President of the Lay Council has the right to appoint an agent on his behalf to collect the tax and fees for the account of the contractor in this case. Likewise, to collect the intestines and sell them to others at the price of that time and collect the price for the account of the contractor. In this case, he may choose to put the tax revenues and the prices of the intestines up for bidding again for the account of the contractor and collect the deficit from him or from the guarantor and hold them liable for any resulting loss, without the need for a protest or official proceedings in all the aforementioned cases. Fourth - If the butchers go on strike and refuse to slaughter sheep for any reason, or if they monopolize sheep with the intent of reducing meat and inflating its price for the Mosaics, the contractor must provide sheep for slaughter to meet the needs of the Mosaic community in an amount of at least four thousand eight hundred kilos daily, and on every Friday, five thousand eight hundred kilos of Kosher meat. If he does not comply with this condition, causing a shortage of meat and a rise in its price, the Hakham Bashi or the President of the Lay Council shall have the choice either to offer sheep for slaughter in an amount sufficient for the community's consumption and charge the contractor for all the loss and damage resulting from that, or to put the tax revenues and intestines up for bidding again for the account of the contractor and collect the deficit from him and hold him liable for any resulting loss, all without the need for a protest or official proceedings. Fifth - The contractor has no right to demand any reduction or compensation if, God forbid, celestial or terrestrial disasters occur, or if the government limits the number of sheep for slaughter, or if difficulty arises in selling Taref meat, or if the butchers refuse or strike from slaughtering for any reason, or if they monopolize the sheep; rather, in all the aforementioned cases, the contractor must pay the installments upon their maturity.

اولاً - يأخذ الملتزم عيناً مصارين الغنم والمعز الاشاير والطايف التي تذبح في مسلخ الطائفة الموسوية ببغداد باعتبار المائة مصارين بقيمة التي تتقرر بالمزايدة على الملتزم بوجه ادناه .

ثانياً - على الملتزم ان يستلم المصارين المذكورة مطروحة في حول المسلخ وعليه انه ملزوم بتسوية المصارين المقتضية لجمعها ونقلها ، وملزوم باعطاء كل يوم وصل من امضائه الى الوكيل الذي يعينه الحاخام باشي او رئيس المجلس الجسماني ويتضمن وصل المذكور عدد المصارين التي استلمها الملتزم بذلك اليوم .

ثالثاً - لا يسوغ للملتزم الامتناع من قبول واخذ اي مصارين لان بحجة انه ضعيف او صغير او مقطوع او اسود بل عليه اخذها وقبولها مهما تكون ، والمصارين الذي لا يقبله يحسب عليه ثمنه حتى اذا تعذر من اخذه بحسب القول المجرد للموظف .

رابعاً - على الملتزم الذي يتقرر عليه الالتزام ان يدفع الى صندوق الجماعة نقداً بطريق الديبوزيتو بالمائة ⟦...⟧ من قيمة ما يبلغ عدد مائة وعشرين الف مصارين ويحسب له هذا المبلغ من بدل الشهر ونصف الشهر الاخيرة . وملزوم باعطاء كفيل معتبر يتعهد بمقاولة الالتزام . وعند عدم تمكنه من تقديم الكفيل فعليه ابلاغ الديبوزيتو الى خمس البدل ويقطع مجموع الديبوزيتو المذكور من اثمان المصارين لشهرين ونصف الاخيرة من مدة الالتزام .

خامساً - بختام كل خمسة عشر يوماً يدفع الملتزم نقداً الى الحاخامباشي او الى رئيس المجلس الجسماني قيمة ما يبلغ من المصارين بظرف تلك الخمسة عشر يوماً حتى انتهاء مدة المقاولة .

سادساً - اذا امتنع الملتزم عن استلام المصارين او اذا تأخر عن دفع قيمة ما استلمه في حينه فيحق للحاخامباشي او لرئيس المجلس الجسماني ان يجمع المصارين ويبيعها على الغير بسعر وقتها ويرجع الملتزم بنقصان الثمن والمصاريف من دون احتياج لاجراء الاخطارات ومعاملات الرسمية . وكلما عند تعذر الملتزم عن الدفع بالاستحقاق فعلى الكفيل ان يدفع عند المطالبة من دون لزوم لاخطارات ومعاملات الرسمية .

سابعاً - ان عدد المصارين يصح من مجموع الغنم التي تذبح من قبل الحاخام من طايف واشاير اي ذبح الغنم من قبل الحاخام فيترتب الدين على الملتزم لاداء ثمن مصارينها ومن ثم ان الحاخامباشي لا ⟦يقوم⟧ بتوظيف احد لتسليم المصارين الى الملتزم . ويضبط عدد اغنام المذبوحة على قول موظف الجماعة والقيد بدفتره ولا يحق للملتزم الاعتراض عليه .

ثامناً - اذا غصب احد القصابين مصارين في المسلخ من طايف واشاير التي تعود للجماعة واخر بعدم تسليمها للملتزم فعلى الملتزم ان يخبر بذلك تحريرياً الحاخامباشي ويعرفه اسم الغاصب وعلى الحاخامباشي ان يمنع حينئذ القصاب الغاصب من الذبح الى حين اعادته المصارين المغصوبة او قيمتها الى الملتزم .

تاسعاً - تعتبر الشرائط التحريرية فقط المندرجة بهذه البوصلة ولا اعتبار لاي كلام شفاهي يجري بين العاقدين .

عاشراً - على الملتزم ان يدفع ولاولية المائة نصف على مجموع البدل وتتنزل هذا المبلغ من اصل الديبوزيتو المذكور ويحفظ عند سكرتير المجلس الجسماني دون احضار شخص الدلال ، والملتزم ملزوم باكمال الديبوزيتو .

Offered for bidding: the intestines contract for the slaughter of the Musawiya (Jewish) community for one year starting from April 1, ⟦1926⟧ until ⟦...⟧ Under the following conditions :- First - The contractor shall take in kind the intestines of sheep and goats (Ashayir and Taif) slaughtered in the slaughterhouse of the Musawiya community in Baghdad, considering the hundred intestines at the value determined by bidding upon the contractor as follows. Second - The contractor must receive the aforementioned intestines laid out in the slaughterhouse yard, and he is obliged to prepare the intestines necessary for gathering and transporting them, and is obliged to give a daily signed receipt to the agent appointed by the Hakham Bashi or the President of the Lay Council, and the said receipt shall include the number of intestines received by the contractor on that day. Third - The contractor may not refrain from accepting and taking any intestines on the pretext that they are weak, small, cut, or black; rather, he must take and accept them regardless of their condition, and any intestines he does not accept shall have their price charged to him even if it is impossible for him to take them, based solely on the word of the official. Fourth - The contractor to whom the contract is awarded must pay into the community fund in cash by way of deposit at ⟦...⟧ percent of the value of one hundred and twenty thousand intestines, and this amount shall be credited to him from the final month and a half payment. He is obliged to provide a reliable guarantor who undertakes the commitment of the contract. In the event of his inability to provide a guarantor, he must increase the deposit to one-fifth of the contract value, and the total of the aforementioned deposit shall be deducted from the prices of the intestines for the final two and a half months of the contract period. Fifth - At the end of every fifteen days, the contractor shall pay in cash to the Hakham Bashi or to the President of the Lay Council the value of the intestines reached within those fifteen days until the end of the contract period. Sixth - If the contractor refrains from receiving the intestines or if he delays paying the value of what he received on time, then the Hakham Bashi or the President of the Lay Council has the right to collect the intestines and sell them to others at the market price at the time, and the contractor shall be liable for the decrease in price and expenses without the need for notifications and formal procedures. Whenever the contractor is unable to pay upon maturity, the guarantor must pay upon demand without the need for notifications and formal procedures. Seventh - The number of intestines is derived from the total sheep slaughtered by the Rabbi from Taif and Ashayir, i.e., sheep slaughtered by the Rabbi, and thus the debt is established against the contractor to pay the price of their intestines, and furthermore, the Hakham Bashi does not ⟦appoint⟧ someone to deliver the intestines to the contractor. The number of slaughtered sheep shall be recorded according to the statement of the community official and the entry in his ledger, and the contractor has no right to object to it. Eighth - If one of the butchers seizes intestines in the slaughterhouse from Taif and Ashayir belonging to the community and causes a delay in delivering them to the contractor, the contractor must inform the Hakham Bashi in writing and identify the name of the seizer, and the Hakham Bashi must then prevent the seizing butcher from slaughtering until he returns the seized intestines or their value to the contractor. Ninth - Only the written conditions included in this voucher are considered, and no oral statements made between the contracting parties shall be considered. As for the 'Abar, i.e., the lamb found inside its mother, it also belongs to the contractors, except that they waive their right to claim production thereof if the government does not allow the slaughter of pregnant ewes. This fee is collected from the slaughtering that takes place in the congregation's slaughterhouse, Adhamiya, and Karrada, from what is offered for sale to the Jews, and they also take in kind the aforementioned intestines, and they must receive them laid out on the floor of the slaughterhouse, but they are obliged to settle the necessary expenses for collecting and transporting them. Second - The contractors have no right to refuse to accept or take any intestines on the pretext that they are weak, small, cut, or black, but they must take and accept them regardless. Likewise, the contractors have no right to claim a reduction, compensation, or indemnification for anything if an obstruction occurs in the yield of intestines due to the butchers' strike from slaughtering for any reason, or due to celestial or terrestrial disasters, or due to a government order, no matter how long the said strike lasts and no matter how long the said disasters last - God forbid - or the government order; rather, in all the aforementioned cases, the contractors must pay the installments upon their maturity. Third - The Haham Bashi has the right to prevent from slaughtering those butchers whose misconduct in the slaughterhouse is proven to him, and the contractors have no right to protest claiming that such prevention caused a decrease in slaughtering or a decrease in the yield of intestines, unless someone in the slaughterhouse forcibly takes from the butchers a quantity of intestines from Taref and Kasher or neglects to deliver them to the contractors, then the contractors must inform the Haham Bashi of that in writing and at the time with the name of the usurper, and the Haham Bashi must then prevent the usurping butcher from slaughtering until the usurped intestines or their price are returned to the contractors, and the contractors have no right to claim anything in exchange for the usurped intestines. Fourth - The contractors have no right to compel or designate one of the slaughtering Rabbis to examine the lungs, but the Rabbis are free to appoint any slaughterer to complete this transaction. And to manage the 'Rawasun' (slaughter revenue) by arranging the rows of sheep heads outside the slaughterhouse unless the slaughtering Rabbis permit it. In conclusion, the contractors have no right to protest or object to any order issued by the Rabbis regarding ensuring the discipline of Taref and Kasher. Fifth - If the butchers strike and refuse to slaughter sheep for any reason, or if they monopolize sheep with the intention of reducing meat and raising its price for the Mosaic people, the contractors must provide sheep for slaughter to meet the needs of the Mosaic congregation in an amount of at least four thousand five hundred kilos ⟦illegible⟧ daily, and on every Friday, five thousand two hundred kilos ⟦illegible⟧ of Kasher meat. If they do not comply with this condition and because of that meat becomes scarce and its price rises, the Haham Bashi or the President of the Lay Council shall have the choice either to offer sheep for slaughter in an amount sufficient for the congregation's needs and charge the contractors the loss and damage resulting from that, or to put the revenues of the fat and intestines up for auction again for the account of the contractors, charging them the deficit and holding them liable for the resulting loss, all without performing a protest or official proceedings. Sixth - As is the current custom, no sheep are slaughtered during the nine days known as the Hebrew Ninth of Av, nor on either of the two days of Rosh Hashanah, nor on Yom Kippur, nor on either of the two days of each of the Sukkot, Pesach, and Shavuot holidays. However, some butchers in the Jewish slaughterhouse have begun preventing meat sellers from purchasing it in the slaughterhouse and creating disturbances that would cause damages to the contractor and the community. Since the contractor is the one responsible (per the contract concluded between us and him) for providing sufficient sheep for slaughter and meeting the community's meat needs, and since he has the right to request the prevention of butchers who provide sheep for slaughter against his will, and to maintain order and protect the rights of the contractor and prevent damages, it has become necessary to prevent these troublemakers from slaughtering entirely.
